Work Session - September 20, 2023

A WORK SESSION OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE UPSTAIRS CONFERENCE ROOM,

153 WEST MAIN STREET, BABYLON, NEW YORK,

ON WEDNESDAY,

SEPTEMBER 20, 2023

Deputy Mayor Frank Seibert

Trustee Dominic Bencivenga

Trustee Anthony Cardali

Trustee KathyAnn Miga

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 6:02 PM.

The Board considered the application of Roman Development for a Seafood Market and approved the application upon certain covenants and restrictions to be agreed on by Mr. Nicolia. Specifically, the Board approved the following as to time and use:

  • No outside dining on the side of the building, in the alley or in the rear parking lot.
  • No take-out business will be behind the building or on the side of the building. No take-out window.
  • Any 3rd party delivery (Uber Eats, etc.), will be picked up in the rear of the building only.
  • The applicant shall submit the total number of employees for the facility to the Village yearly. The Village, at its discretion, may make municipal parking available to such employees in a manner prescribed by the Village. Employees shall not park on residential streets.
  • Music is limited to background music only, with no amplification and no outdoor speakers or amplification. Any “live” entertainment must be approved by the Board of Trustees.
  • Elevator must be compliant to fit comfortably an ambulance stretcher.
  • Garbage MUST be disposed of daily so that no garbage shall accumulate outside the dumpsters on site.
  • NO rooftop dining permitted.
  • Details of cooking line and exhaust is required; no noxious fumes or odors to be discharged from the building.
  • Suffolk County Department of Health must be contacted and approval for grease traps must be submitted.

The Board also stated that approval is subject to Zoning Board of Appeals in regards to height, parking, apartment dwellings, setback, and any other approval necessary that the Zoning Board of Appeals deem fit.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the work session ended at 7:09 PM.
