A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, SEPTEMBER 9, 2025 Present: Mayor Adams, Trustee Seibert, Trustee Bencivenga, Trustee Cardali, and Attorney Casolaro. On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the work session opened at 7:00 PM. On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the work session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:02 PM.

The Pledge of Allegiance was led by Trustee Siebert.

The Mayor held a moment of silence to remember Trustee Sean Goodwin.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the minutes of the August 12, 2025 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk stated there was no correspondence.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to have DeGennaro’s Landscaping maintain the property at 38 James Street and the owners of the property will be billed.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to issue partial refunds in the amounts indicated to the applicants listed below for the return of BOT signs. [Hearing Date 8/12/2025]

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to hire John Gaughan as a full-time laborer with an annual salary of $29,120, effective August 12, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to accept the attached intermunicipal agreement for shared services between the Board of Education of the Babylon Union Free School District and the Village of Babylon, for a term of July 1, 2025 through June 30, 2026.

    And

    ALSO RESOLVED to authorize the Mayor to execute the agreement. [Contract #1468]

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to accept the resignation of Parking Meter Officer Raymond Scarfi effective

    August 25, 2025.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to schedule a Public Hearing to be held on Tuesday, September 23, 2025 at 7:00 PM to consider the adoption of proposed Local Law 0923PH of 2025- Roof-Top Dining.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Rotary Club to hold its annual golf outing and barbeque at the E. Donald Conroy Golf Course on Monday, October 6, 2025, with a rain date of October 20, 2025, starting at 9:30 AM. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon list as an additional insured and a notarized hold harmless agreement,

    And,

    ALSO BE IT RESOLVED to waive the Open Container Section of the Village Code, Chapter 256, for the deck area only for this event.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried,

      WHEREAS, a Public Hearing was held on Tuesday August 12, 2025,

      BE IT HEREBY RESOLVED to approve the application of Jamie Winkler, representing Insomnia Cookies Operators, LLC, to open a late-night retail bakery.

      And, be it further

        RESOLVED to approve and adopt the attached covenants and restrictions for Insomnia Cookies Operators, LLC, 55 Deer Park Avenue. [Section 010/ Block 04/ Lot 014]

        On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

        RESOLVED to proclaim April 22nd as Sean Goodwin Day in the Village of Babylon effective immediately.

        On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

        RESOLVED to increase the annual salary of laborer Kyle Malone by $1,000 effective

        August 12, 2025, having completed his six-month probationary period.

        On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimous

        RESOLVED to hire Philip Sodano as a as a full-time laborer with an annual salary of $45,760, effective August 11, 2025.

        On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

        RESOLVED to accept Joseph Jenkins resignation to retire as a full-time laborer effective July 26, 2025. *Date correction from BOT 7/22/2025

        On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

        RESOLVED to hire Nicholas DiNicola as a full-time Mechanic 1 with an annual salary of $66,560 effective August 25, 2025.

        On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

          RESOLVED to grant permission to the residents of Gamecock Lane to hold a block party on Saturday, September 13th, 2025, from 3:00 PM to 11:00 PM, with a rain date of Sunday, September 20th, 2025. The street will be blocked between Gamecock Lane and Little East Neck Road and Greenway Terrace, subject to parking restrictions for emergency purposes.

          On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

          RESOLVED to accept the attached agreement with Mason Technologies, Inc., for phone service maintenance at Village Hall.

          And

          ALSO RESOLVED to authorize the Mayor to execute the agreement. [#1584]

            On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

            RESOLVED to grant permission to the Babylon Rotary Club to maintain 12” x 18” temporary signs at various merchants in the Village from September 8th through October 6th, 2025, to advertise the 25th Annual Charity Golf Outing on October 6th, 2025.

            On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

            RESOLVED to grant permission to Cross of Christ Lutheran Church to hold a golf outing with use of the deck for lunch, on Saturday October 4th, 2025. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a notarized hold harmless agreement.

            On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried,

            WHEREAS, a Public Hearing was held on Tuesday August 12, 2025,

            BE IT HEREBY RESOLVED to approve the application of Isaura Sanchez for a Special Use Permit to allow school field trips at her playcenter.

            And, be it further

            RESOLVED to approve and adopt the attached covenants and restrictions for My Play Space, 105 W. Main Street. [Section 010/ Block 03/ Lot 011]

              On the motion of Trustee Bencivenga seconded by Trustee Cardali and unanimously carried, it was

              RESOLVED to retain Geoffrey J. Mascaro, Esq. as Assistant Special Tax Counsel to James A. Gowan, Esq. who serves as Special Tax Counsel for the Incorporated Village of Babylon, Suffolk County, New York, for the purpose of litigating Real Property Tax Certiorari proceedings under all provisions of the New York State Real Property Tax Law and any and all statutes and laws related thereto.

              On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

              RESOLVED to increase the annual salary of laborer Endy Villalona by $1,000 effective

                August 4, 2025, having completed his six-month probationary period.

                On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to grant a license to the following applicants to drive a taxi cab for Lindy’s Taxi/Sunset Taxi in the Village of Babylon:

                  • Georgios Drineas
                  • Mohammad S. Ashraf
                  • *The Village Attorney approved these applicants.

                  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to hire Martin Candito as a full-time laborer with an annual salary of $45,760, effective August 18, 2025.

                  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to hold a bid opening on Thursday, September 25th, 2025 at 9:30 AM for the Demolition of 102 Mayhew Avenue. Bid Specifications will be available in the Office of the Village Clerk between the hours of 9AM and 5PM Monday through Friday beginning September 11th, 2025.

                  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to grant permission to the residents of Lincoln Street to hold a block party on Saturday, September 20th, 2025, from 12:00 PM to 11:00 PM, with a rain date of Sunday, September 21st, 2025. The street will be blocked between Deer Park Avenue and Siegel Boulevard, subject to parking restrictions for emergency purposes.

                  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to grant permission to the residents of Tompkins Avenue to hold a block party on Saturday, September 20, 2025 from 11:00 AM to 11:00 PM. The street will be blocked between Little East Neck Road South and just east of Mayhew Avenue (47 and 48 Tompkins Ave), subject to parking restrictions for emergency purposes.

                  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                  RESOLVED to grant permission to the Post Office Café to host the 34nd Annual 5K for MPS on Saturday, October 18th, 2025, with road closures from 9:00 AM to 11:30 AM. This permission is granted contingent upon timely receipt of required certificate of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

                  And,

                  RESOLVED to grant permission to the Post Office Café to maintain temporary signs, from September 18th through October 18th, 2025, to advertise their 34th Annual Race for MPS, at the following locations:

                  3 Signs (48” x 24”): - Rt. 231 & Montauk Hwy.

                  • - John St. & Cooper St.
                  • - Rt. 109 & Montauk Hwy.
                  • 1 Banner (36” x 120”): - Store Front of Post Office Café, 130 W Main St.

                    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

                    WHEREAS, a Public Hearing was held on Tuesday August 12, 2025,

                    BE IT HEREBY RESOLVED to approve the application of Robert Mathews for a Special Use Permit to open a brunch and mimosa restaurant.

                    • And, be it further

                    RESOLVED to approve and adopt the attached covenants and restrictions for Millies’s Mimosa House, 94 E. Main Street. [Section 014/ Block 02/ Lot 011]

                    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                    RESOLVED to approve the following warrant for September 9, 2025:

                                   General Account:              $ 649,754.97

                               Total General Fund:              $ 649,754.97

                                                     Conklin:             $         251.90

                                                        TOTAL:            $ 650,006.97

                    The following announcements were made:

                    • Trustee Seibert announce he will be taking on the Conklin House.
                    • Trustee Bencivenga stated great season at the golf course, Staff been great. Boating season coming to end. Will stay open until the late November.
                    • Trustee Cardali thanked the pool staff for a great season. Poll is drained for the winter. Also thanked the Long Island Herald for their coverage of the 1st Place Swim team. Upcoming events:
                      • Sept. 11th - 9/11 Memorial service at 8:30 AM at Argyle Park.
                      • Sept. 22nd - “Car Free Day”, all encouraged to walk to work or school.
                      • Sept 27th - STOP / SHRED Day

                    The meeting was opened to the public and the following persons addressed the Board.
