A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, SEPTEMBER 28, 2021. On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:00 PM. On the motion of Trustee Silvestri, seconded by Trustee Cardali and unanimously carried, the Board entered into executive session at 7:35 PM to discuss current litigation, at which time the work session was ended on the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried. On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the executive session ended at 8:04 PM.

Regular meeting of the Board of Trustees opened at 8:11 PM.

The Pledge of Allegiance was led by Trustee Cardali.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the September 14, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated September 22, 2021:

RESOLVED to accept the Fire Department actions as read.

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to amend the resolution dated September 14, 2021 to change John Broderick from full-time to part-time parking meter officer at an hourly rate of $18.48 effective September 13th, 2021.

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $50.00 to Vivian Tebcherany for the return of one Board of Trustees public hearing sign for partial refund.

    RESOLVED to grant a license to the following applicant to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:       Ryan O’Sullivan

    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to assume lead agency status pursuant to SEQRA concerning proposed Local Law 9 of 2021 and issue a negative declaration pursuant to SEQRA.

    And furthermore,

    WHEREAS a Public Hearing was held on Tuesday, September 14, 2021,

    BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 9 of 2021, is HEREBY ADOPTED as:

    Local Law 9 of 2021, to amend Village Code Chapter §343-74, Schedule XVI, regarding special permit parking on Merman Place and on the east side of Fire Island Avenue between Nereid Place and Merman Place.

    Trustee Silvestri thanked Code Enforcement, Suffolk County Police, and the Highway Department for all their help during the Bike Parade held this past Saturday.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a full refund in the amount of $770 to Bernadette Maier for boat slip #5053 at Lewis Pond for the 2021 season.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Lions Club to display No Parking signs on the parking meters in front of Café Il Villagio, 35 Deer Park Avenue, during their take-out pasta dinner fundraiser on Sunday, October 24th, 2021, from 2:00 PM to 6:00 PM.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission to the Babylon Lions Club to maintain temporary 8 ½” x 11” signs at various merchants in the Village from October 9th through October 24th to advertise their take-out pasta dinner fundraiser to be held on Sunday, October 24th, 2021.

    ALSO RESOLVED to grant permission to the Babylon Lions Club to maintain temporary 4’ x 4’ signs at the entrances to the Village from October 9th through October 24th, 2021 to advertise the take-out pasta dinner fundraiser.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to assume lead agency status pursuant to SEQRA concerning proposed Local Law 10 of 2021 and issue a negative declaration pursuant to SEQRA.

      And furthermore,

      Trustee Bencivenga commented that the golf course will be closing 90 minutes before sunset in order to provide enough time for golfers to complete the course before dark. The closing time will be adjusted as the daylight hours decrease this time of year. The Village Cup will be held on November 5th, 2021 with a rain date of November 12th.

      On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

      RESOLVED to amend the resolution dated September 14, 2021 to hire Stephanie Lino as full-time parking meter officer and to provide EMT services with an annual salary of $41,600 effective September 20th, 2021.

      On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Beautification Society to hold a Christmas Market fundraiser around the Gazebo and Bayman statue on Saturday, December 11, 2021 from 10:00 AM to 4:00 PM. This will include: closing off the area to vehicles, use of portable bathrooms, and trash removal and clean up at the end of the event. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

      On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

      RESOLVED to cancel the original contract with Gorilla Contracting for the Restoration of Argyle Falls due to unsatisfactory progress and, pursuant to item 6 of the general conditions of the contract, award the contract to the next lowest bidder, LI Craftsmanship, with a revised bid price of $245,000.

      ALSO RESOLVED to authorize the mayor the sign the contract with LI Craftsmanship for the completion of Argyle Falls restoration.

      On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

      RESOLVED to approve the following warrant for September 28, 2021:

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to increase the salary of Maureen Rigelhaupt, part-time ZBA office assistant, to $13.00 per hour effective September 27, 2021.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to approve an annual stipend of $2,500.00 to Maureen Rigelhaupt for her position as Secretary to the Zoning Board of Appeals, retroactive to her appointment on April 5, 2021.

        On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

        RESOLVED to grant permission to Babylon Jr.-Sr. High School to hold the Homecoming Parade on Saturday, October 23, 2021, at 12:30 p.m. The line-up will begin at 12:15 PM in the municipal lot behind Gemelli’s. The parade will head west on Main Street, turn north onto North Carll Avenue, and proceed to the High School football field parking lot. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

          RESOLVED that pursuant to New York State General Municipal Law section 104(b), Joseph Fraccalvieri, Matthew Arundale and James Miga are responsible for purchasing for the Babylon Village Fire Department.

          Trustee Cardali commented on the successful S.T.O.P. / Shred Day held September 25th and thanked Skip Gardner, Jay Brunjes, the Highway & Sanitation Department, and Code Enforcement for all their help.

          Mayor Adams made the following announcements:

          Village of Babylon offices will be closed and there will be no rubbish or garbage pick-up on Monday, October 11, 2021 in observance of the Columbus Day holiday. Just a reminder that residents should not put rubbish or recycling out to the curb on holidays.

          October is Breast Cancer Awareness month and the Village Hall Municipal Building and several merchants in the business district and homes in the Village will be participating in Pink by the Bay by displaying pink lights in their windows.

          A car show will be held in the Municipal Pool parking lot on Sunday, October 17th, 2021 from 10:00 AM to 2:00 PM. The American Legion will be holding a 50/50 raffle during the event. The fee for cars participating in the show is $10.00; there is no charge for guest admittance.

          The meeting was opened to the public; no one addressed the Board.

          On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting adjourned at 8:34 PM.
