A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, SEPTEMBER 13, 2022. On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 7:00 PM. On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the Board entered into executive session at 7:03 to discuss current litigation and human resource issues, at which time the work session was ended on the motion of Trustee Seibert and seconded by Trustee Bencivenga. On the motion of Trustee Miga, seconded Trustee Seibert and unanimously carried, the executive session ended at 8:03 PM.

Regular meeting of the Board of Trustees opened at 8:06 PM.

The Pledge of Allegiance was led by Trustee Cardali.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the August 9, 2022 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated August 16, 2022:

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to increase the salary of James Hanley, part-time laborer, to $12.25 per hour effective August 9, 2022.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to grant permission to Cali O’Keefe to hand out flyers within the Village of Babylon to pedestrians and local restaurant owners on Saturday, September 17, 2022 from 12:00 PM to 5:00 PM. [The flyers pertain to the upcoming community meeting to discuss the current situation with the “631 Bike Gang”.]

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the residents of East Harrison Avenue to hold a block party on Saturday, September 17, 2022, from 11:00 AM to 11:00 PM. The street will be blocked between Little East Neck Road and East Shore Drive, subject to parking restrictions for emergency purposes.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the Post Office Café to host the 31st Annual 5K for MPS on Saturday, October 15, 2022, with road closures from 9:00 AM to 11:30 AM. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED that the Babylon Rotary Club will hold its annual golf outing and barbeque at the E. Donald Conroy Golf Course on Monday, October 3, 2022, with a rain date of October 17th. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a notarized hold harmless agreement,

And,

ALSO BE IT RESOLVED to waive the Open Container Section of the Village Code Chapter 256 for the deck area only for this event.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to grant permission the West Islip School District to use the Sumpwams Golf Course for the boys’ and girls’ golf teams during the fall and spring seasons of the 2022-2023 school year. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a partial refund in the amount of $330.00 to Charles Carroll for giving up Boynes Canal boat slip #3048 during the 2022 season.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a partial refund in the amount of $280.00 to Scott Glenn for giving up East Creek boat slip #4083 during the 2022 season.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a partial refund in the amount of $543.00 to Joseph Miller for giving up Lewis Pond boat slip #50102 as of the 2022 season.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to Babylon Jr.-Sr. High School to hold the Homecoming Parade on Saturday, September 24, 2022, at 12:30 PM. The line-up will begin at 12:15 PM in the municipal lot behind Gemelli’s; the parade will head West on Main Street, turn onto North Carll Avenue, and proceed to the High School football field parking lot. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to Race Awesome to display two street banners (3’ x 20’) from September 23rd to October 23rd, 2022 to promote the 8th annual Catholic Health Suffolk County Marathon. The Village will assist in hanging the banners.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to issue a refund in the amount of $2,906.35 to Bob Patel of East Main Street Babylon LLC for overpayment of 2022 Village taxes on the property located at 260 East Main Street [due to the decrease in assessed value for the 2022 roll].

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to accept the attached “ATM Operating Agreement” with Jovia Financial Federal Credit Union to install and maintain an ATM machine at Village Hall for three years, through September 30, 2025, [Contract # 1563]

      And, be it further

      RESOLVED that the Village Mayor is hereby authorized to execute the agreement;

      And be it further

      RESOLVED that this resolution shall take effect immediately.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to appoint Kathy Ann Miga as Trustee to fulfill the unexpired term of Robyn Silvestri, which is to April of 2023, effective September 1, 2022.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED that the Village will hold a car show at the Gilbert C. Hanse Municipal Pool parking lot on Sunday, October 16, 2022 from 10:00 AM to 2:00 PM.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:                William Staiger

      RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Sunset Taxi in the Village of Babylon:

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED that the Babylon Public Library will hold the Touch a Truck program in the library parking lot on Saturday, October 29, 2022 from 11:00 AM to 2:00 PM, with participation from the Village Highway & Sanitation Department, Fire Department & Emergency Services and Code Enforcement.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Rotary Club to maintain temporary signs at various merchants in the Village from September 16 through October 3, 2022, to advertise the 22nd Annual Charity Golf Outing on October 3, 2022.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to issue a refund in the amount of $50.00 to Christina Sciuto for the return of one (1) Board of Trustees Public Hearing sign for the property located at 158 East Main Street.   [Public Hearing Date: 7-26-22]

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to accept the attached agreement with Suffolk County Water Authority regarding the paving restoration for Kensington Road, Greenway South, Greenway Terrace and Regent Street, Babylon, [Contract # 1564]

      And, be it further

      RESOLVED that the Village Mayor is hereby authorized to execute the agreement.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to increase administrative and storage fees in connection with any seizure of a bicycle to $500.00, pursuant to Chapter 93 of Village Code, effective immediately.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried,

      BE IT RESOLVED that the Board of the Village of Babylon hereby authorizes the Babylon Village Justice Court to apply for a JCAP grant in the 2022-2023 grant cycle up to $30,000.00, and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this court.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried,

      Whereas a Public Hearing was held on Tuesday, July 26, 2022,

      BE IT HEREBY RESOLVED to approve the application of Christina Sciuto of LaLaLand Play, Inc., 158 East Main Street, to open an indoor children’s play space,

      And, be it further

      RESOLVED to approve and adopt the attached covenants and restrictions for LaLaLand Play, Inc., 158 East Main Street. [SCTM: 0102–014–02–018}

        Mayor Adams made the following announcement:

        S.T.O.P. / Shred Day for Babylon Village residents will be held on Saturday, September 24, 2022 by the Highway Department on Carlston Place. The S.T.O.P. portion is from 9:00 AM to 12:00 Noon; the Shred portion is from 1:00 PM to 4:00 PM. This event is for Babylon Village residents only and ID is required. Any questions can be directed to the Highway Department at 631-669-4878.
