Public Hearings January 12, 2021- Haus of Grace and Local Law 1 of 2021

A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, DECEMBER 15, 2020.  On the motion of Trustee Davida, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 4:05 p.m.  On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the work session ended at 5:45 p.m.

A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, JANUARY 5, 2021.  On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 4:45 p.m.  On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 5:30 p.m. to discuss current litigation, at which time the work session was ended on the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried.  On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, the executive session ended at 5:50 p.m.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, January 12th, 2021, at 7:00 p.m. by video conference to consider the application of Grace Iazbeck of Haus of Grace, LLC to open a beauty parlor at 10 James Street, the former location of the Center for Communication Care.

Copy of application and plans may be examined by contacting the Village Clerk’s Office at (631) 669-1500, between the hours of 10:00 AM and 4:00 PM Monday through Friday.

Attorney Gerard Glass explained that this application is for a beauty parlor with a cosmetologist, an esthetician, and a massage therapist.  Applications involving personal service use that exceeds 1000 square feet requires Board approval. Although this does not exceed the limit, the Planning Board referred this application to the Board of Trustees because it involves a change of use at this location.

Having reviewed the application and plans, the Board felt that it was very straightforward and did not have any questions.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was


RESOLVED to reserve decision.

Local Law #1 of the year 2021

to amend Village Code Chapter A369 Dock Rules and Regulations to amend §A369-15 to include Northeast Lewis Pond in the title and to add §A369-17 A. Mud Creek.

Attorney Glass explained that this hearing was proceeded by two public informational meetings regarding a proposed pilot program to include in the Village’s dock program the public land being used by the neighborhood.  It was also proceeded by the November 24th, 2020 Board meeting in which Trustee Bencivenga presented his letter to the Board, recommending that the Mayhew Dock Pilot Program be made permanent.  The Board in turn passed a resolution to accept this recommendation and also passed a resolution to set the fee for Mayhew docking.

This Local Law is to codify these changes and establish certain rules/conditions for the use of the slips in this location, as this location is different than other existing dock spaces in the Village.  This law also addresses certain sections of the code that are no longer applicable, which have nothing to do with Mayhew Docking.


Mayor Adams commented that after the 14-day period allotted for comments, she would like to schedule a Zoom meeting for residents originally involved in the meetings for the pilot program, to answer any questions and clarify any concerns they may have.


On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
