PUBLIC HEARING
WAS HELD IN THE BOARD ROOM,
153 WEST MAIN STREET, BABYLON, NEW YORK,
ON TUESDAY,
SEPTEMBER 23, 2025

The meeting opened at 7:04 pm.
The Pledge of Allegiance was led by Trustee Cardali.
The Village Clerk read the following Legal Notice:
NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, September 23rd, 2025, at 7:00 p.m. at Babylon Village Hall, 153 West Main Street, New York 11702, or as soon thereafter as can be heard, to consider proposed Local Law 0923PH of 2025:
A local law that expressly prohibits any restaurant or commercial establishment from offering Roof-Top dining, whether that Roof-Top dining is outdoors or indoors. Roof-Top dining shall be expressly prohibited everywhere within the Village of Babylon.
PLEASE TAKE FURTHER NOTICE that at said hearing all interested parties will be given an opportunity to be heard on said proposed Local Law at the place and time aforesaid. Copies of the proposed Local Law will be available at the Village Hall at least five (5) days before the public hearing and may be seen during the regular business hours.

Mayor Adams stated that the law is self-explanatory and opened the discussion to the Board.
Trustee Seibert stated that it is a safety issue with the buildings in the downtown village area, may be a possibility in new structures, but not most buildings in the Village.
Trustee Bencivenga stated he had no real comments. It is not the right idea for the Village. He supports the proposed local law.
Trustee Cardali continued off of Trustee Seibert comments; the buildings in the village are very old, lack the emergency access features that would need to be added and will not be architecturally pleasing or safe.
The meeting was opened to the public and no one addressed the Board.
Trustee Seibert asked Trustee Cardali if there were any restaurants in the Town of Babylon offering roof-top dining. Trustee Cardali answered that he did not know about any in the Town of Babylon, stated the Village buildings are not equipped to put elevator towers in to make the rooftop dining handicap accessible and outside stairs would be dangerous. Trustee Cardali feels it is more of an architectural issue.
Mayor Adams also noted that restaurants already have occupancy limits; does this add to or take away from current occupancy limits, and parking limits. Trustee Cardali also commented this brings up concerns with noise, parking and people smoking.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to reserve decision.
