NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, May 11, 2021, at 7:00 p.m. by video conference to consider the adoption of proposed

Local Law #4 of the year 2021

amending Village Code Chapter 365 to add sections §365-153 through §365-157 regarding restrictions on the sale of Vaping and Marijuana Products, Vape Shops, Hookah Lounges, Marijuana Dispensaries and Marijuana Shops and restrictions on the locations of such lounges and shops and requirements for the posting of signs regarding the sale of such products.

The Mayor thanked the Trustees for putting the health and safety of our residents first; this Local Law is something that the Village was looking to do prior to NY State instituting the new laws regarding marijuana products and dispensaries. The Board spoke in favor of keeping these types of businesses out of our downtown business district and felt this local law was a good safety measure.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was


RESOLVED to reserve decision.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, May 11, 2021, at 7:00 p.m. by video conference to consider the adoption of proposed

Local Law #5 of the year 2021

to amend Village Code regarding Urgent Care Facilities:

-          §365-3-A to add a definition of “Urgent Care Facility”

-          §365-17-B (1) (b) and (c) pertaining to uses permitted by special permission of the Board of Appeals in the Residential Office District for businesses conducted and operated through and by appointments only

-          §365-20-A (2) pertaining to permitted uses in Retail Business Districts excluding urgent care facilities in a building with livable floor area not exceeding 1,000 square feet

-          §365-20-B (3) pertaining to uses permitted by special permission of the Board of Appeals in the Retail Business District including urgent care facilities in a building with livable floor area of more than 1,000 square feet

-          §365-21-A pertaining to uses permitted in the Industrial District including urgent care facilities

Mayor Adams explained that Local Law 5 is to amend Village code to distinguish between a physician’s office and an urgent care facility and to determine where an urgent care facility would be best suited, and where they would be permitted in the Village of Babylon.

The Board commented that this is a common-sense approach since urgent care is a newer business that was not around at the time this code was written.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

Local Law #6 of the year 2021

to amend Village Code Chapter §237 Nuisances and the abatement thereof by:

-          revising §237-8 a. - Penalties for offenses

-          adding §237-10 - Emergency corrections

-          adding §237-11 - Legislative intent.

Mayor Adams explained that Local Law 6 also has to do with the health and safety of our residents.  The Village will make every effort for the owner to remediate, however, if there is a clear and present danger to the life or safety of our residents, this law gives the Village the right, if need be, to remediate.  The Board agreed with this local law, as it is in the interest of safety.


On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

Mayor Adams explained the purpose for this Local Law is a result of the excessive debris that the Sanitation Department is at times seeing on our streets, debris which is more appropriate for a dumpster.  Village Code is being amended to update the fines in these situations.

The Board commended the Sanitation Department for the great job they do, particularly during the pandemic when many people put a tremendous amount out for pick-up.  The Sanitation Department can’t be expected to do this all the time.   Some people take advantage when they move and leave a household of debris behind.  The Board believes that leaving excessive debris abuses the privileges of the services that are being offered.


On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was
