A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, OCTOBER 24, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga, Trustee Cardali and Trustee Miga and Attorney Charles Casolaro. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:00 PM. On the motion of Trustee Seibert, seconded by Trustee Miga, and unanimously carried, the work session ended at 7:59 PM.

Regular meeting of the Board of Trustees opened at 8:03 PM.

The Pledge of Allegiance was led by Trustee Miga.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the October 10, 2023 regular meeting of the Board of Trustees and dispense with the reading of the same.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to hire Brian Kuntz as a part time Parking Meter Officer at a rate of $15.00 per hour.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED that the Village accepts the CDBG Grant in the amount of $169,368.04 and directs such funding to be used for infrastructure improvements, the construction of handicap ramps and the installation of red brick pavers within the Village.

      On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

        RESOLVED to approve the following warrant for October 24, 2023:

                                  General Account: $ 282,328.29

                                      Conklin House: $            40.00

                             Total General Fund: $   282,368.29

                                            Trust Fund: $        1,750.00

                                                  TOTAL: $   284,118.29

        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

        RESOLVED to grant permission to the Babylon Lions Club to maintain temporary 8 ½ x 11” window signs at local merchants and 5 large signs around the Village from November 24th to December 8th, 2023, to advertise their “Piano Concert Fundraiser” on December 7th, 2023.
        [The Village Highway Department will assist in displaying the 5 large signs around the Village.]

        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

        RESOLVED to accept GGG Construction Corp. as the contractor for the improvements in the sidewalk, brick work and ADA compliance project under the Community Development Block Grant on Grove Place.

        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried,

          WHEREAS, pursuant to Article 8, Section 1, and 2-a of the New York State Constitution as effectuated and applicable by the General Municipal Law section 119-o municipalities are empowered to enter into agreements for the performance of their respective functions, powers, or duties, and for the sharing and exchanging of services; and

          WHEREAS, the Village of Babylon seeks to have properties that are in mortgage default and/or foreclosure added to a registry pursuant to Babylon’s Foreclosure Registration Ordinance, Chapter 268 of the Code of the Village of Babylon, “Property, Registration or Defaulted Mortgage”;

          NOW THEREFORE, BE IT RESOLVED, that by this Resolution, the Board of Trustees authorizes the mayor to execute the Professional Services Agreement between HERA Property Registry, LLC and the Village of Babylon and hereby adopts and ratifies said agreement.

          WHEREFOR, this RESOLUTION, hereby adopted by vote of the Board of Trustees on October 24, 2023, shall be promptly recorded in the Office of the Village Clerk, and made part of the public record.

          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

          RESOLVED to grant permission to Dominick Pepito of Universal Paranormal to display a temporary sign from November 1, 2023 to December 31, 2023.

          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

          RESOLVED to promote John McArdle to labor Crew Leader with a salary increase of $16,680 effective October 11, 2023.

          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

            WHEREAS, on October 7, 2023, Hamas terrorists launched a coordinated, unprovoked attack on Israel from the Gaza Strip; and

            WHEREAS, Hamas has fired thousands of rockets toward Israel’s major population centers, breached Israel’s borders, infiltrated Israeli communities and kidnapped over 200 civilians from numerous nations, killed more than 1,300 Israelis, and wounded over 3,300 more; and

            WHEREAS, 25 Americans have been declared dead at the hands of Hamas; and

            WHEREAS
            , this is the most significant attack on Israel since the Yom Kippur War, which was launched 50 years ago nearly to the day; and

            WHEREAS, more than 300,000 reserve soldiers were called to defend the state of Israel and Israeli Prime Minister Benjamin Netanyahu declared that Israel was at war to defend itself.

            NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Village of Babylon:

            RESOLVED, that the Village of Babylon unequivocally condemns Hamas for this deplorable and unprovoked attack on Israel.

            RESOLVED, that the Village of Babylon stands in solidarity with the State of Israel and condemns this unprovoked attack by Hamas against Israel and its citizens and supports Israel's right to defend itself and protect its citizens from indiscriminate violence and terrorism.

            RESOLVED, The Village of Babylon unequivocally supports the right of the State of Israel to exist as a sovereign and independent nation, with the full recognition of its borders and territory.

            RESOLVED, that this resolution shall take effect immediately from and after its passage, and it is accordingly so resolved.

            On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

            RESOLVED to accept the resignation of John Broderick, part time Parking Meter Officer, effective October 1,2023.

            On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

            RESOLVED to accept the attached intermunicipal agreement for shared services between the Board of Education of the Babylon Union Free School District and the Village of Babylon, for a term of July 1, 2023 through June 30, 2024,

            And

            ALSO RESOLVED to authorize the mayor to execute the agreement. [Contract #1468]

            On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

            RESOLVED to grant permission to the Babylon Public Library to hold a “Jamming with Josh” program at the gazebo on Wednesday, October 25th, 2023, from 10:00 AM- 10:45 AM. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

            On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

            RESOLVED to change laborer Shawn Barnes from part time to full time at the same rate of pay.
