A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, OCTOBER 15, 2024. Present were Mayor Adams, Trustee Seibert, Trustee Cardali, and Trustee Bencivenga. Absent were Trustee Miga and Village Attorney Charles J. Casolaro. On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the work session opened at 6:30 PM. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session ended at 7:09 PM.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to approve the minutes of the October 8th, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.
The Village Clerk read the letter from the Fire Department dated October 18th, 2024:

RESOLVED to accept the Fire Department actions as read.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to terminate Joseph Rivituso, full time parking meter officer, effective October 8, 2024.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to hire Jacob Walker, full time laborer, at an annual salary of $29,120, effective August 12, 2024.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to hire Rahmel Beal as part time laborer at a rate of $13.00 per hour effective June 10, 2024.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to reappoint Bruce Zappia to the Planning Board for another 5-year term, effective November 2024.

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding Proposed Local Law 1022PH 365-20J of 2024; §365-20J, amending the Village code:
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment, and
WHEREAS, a Public Hearing was held on Tuesday, October 22, 2024,
BE IT HEREBY ENACTED that the following Local Law, Proposed Local Law 1022PH 365-20J of 2024, to amend the Village Code Chapter §365-20J, is HEREBY ADOPTED as:

Trustee Seibert read the following and polled the Board:
WHEREAS, the Mayor and the Board of Trustees have determined that for the purpose of promoting the general welfare, to control and regulate development within certain recognized zoning districts, to maintain the aesthetic quality of life in the Village, and to better manage costs and expenses associated with the Village’s Building Department, and in furtherance of those legitimate governmental objectives, does hereby RESOLVE:
RESOLVED, that there shall be the requirement of a non-refundable Village Façade Improvement Fee on all new and/or substantially new construction projects in which fee shall be an amount equal to two dollars ($2.00) per square foot; and
BE IT FURTHER RESOLVED that the payment of the Façade Improvement Fee shall be paid as follows: one half of the full amount shall be payable upon the issuance of the Building Permit, and the balance shall be payable upon the issuance of a Certificate of Completion or Certificate of Occupancy, as determined by the Building Inspector; and
BE IT FURTHER RESOLVED that the Façade Improvement Fee shall be in addition too, and not be made part of, the usual and customary building permit fee;
WHEREFOR, this RESOLUTION, hereby adopted by unanimous vote on October 22, 2024, before a duly constituted meeting of the Board of Trustees, shall be promptly recorded in the Office of the Village Clerk, and made part of the public record.

RESOLVED to increase the annual salary of Peggy Cohen by $1,000 effective October 18, 2024, having completed her six-month probationary period.

RESOLVED to accept the resignation of Rahmel Beal, part time laborer, effective June 21, 2024.

RESOLVED to hire Esdros Granados as a full-time laborer with an annual salary $45,760, effective August 26, 2024.

RESOLVED that the Village of Babylon will hold a General Election on Tuesday, March 18, 2025, for two Trustees and a Village Justice, each for a term of four years.

RESOLVED to accept the request to retire from full time laborer, Michael Ramaglia, effective September 26, 2024. (Date correction)

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding Proposed Local Law 1022PH 281-5 of 2024; §281-5, amending the Village Code to remove the following subsections of this chapter of the Village Local Law:
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment, and
WHEREAS a Public Hearing was held on Tuesday, October 22, 2024,
