A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, NOVEMBER 28, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga, Trustee Cardali, and Attorney Charles Casolaro. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:03 PM. On the motion of Trustee Cardali, seconded by Trustee Bencivenga, and unanimously carried, the work session ended at 7:55 PM.

Regular meeting of the Board of Trustees opened at 8:00 PM.
The Pledge of Allegiance was led by Trustee Seibert.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to approve the minutes of the November 14, 2023 regular meeting of the Board of Trustees and dispense the with the reading of the same.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to Kieran O’Halloran to hold a basketball tournament at the Park Avenue Courts on May 19th, 2024 from 1:00 PM until 5:00 PM. There will be 32 teams of 3 (96 players total) with spectators. He is also asking permission to have local vendors set up on the grass by the dog park. All money raised will be donated to OneTribe, a non-profit which raises awareness for athlete mental health & building basketball courts on low-income communities.
This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as signed and notarized hold harmless agreements, from OneTribe CE and any vendors that participate.
On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED that the Mayor is authorized to sign an agreement with 60 Fire Island Avenue, Realty LLC, regarding the lease of the driveway at 60 Fire Island Avenue to provide access to the parking area behind 60 Fire Island Avenue and to the parking area adjacent to the Babylon Village Argyle Theater. The lease agreement is for a three (3) year term, commencing April 1st, 2024, and ending March 31, 2027, with an annual rent of $1,200.00.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to accept the resignation of Jennifer Lister, Office Assistant, effective December 1, 2023.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to grant permission to the Babylon High School Class of 2025 to host a Color Run through the trails of Southards Pond on Sunday, May 19, 2024, from 9:00 AM to approximately 11:00 AM. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.
On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was
RESOLVED to issue a refund in the amount of $16.35 to Paul McPherson for overpayment of 2023 taxes for parcel SBL 009-02-4 (47 Caledonia Avenue).
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream Truck in the Village of Babylon for the 2024 season. This permission is granted contingent upon timely receipt of required certificate of insurance with the Village of Babylon listed as an additional insured, and a signed and notarized hold harmless agreement
On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to approve the following warrant for November 28, 2023:
General Account: $ 546,879.05
Conklin House: $ 800.00
Total General Fund: $ 547,679.05
Trust Fund: $ 3,199.44
TOTAL: $ 550,878.49
Mayor Adams read the following Resolution and polled the Board:
RESOLVED to authorize the Village attorney to seek a restraining order to prohibit occupancy of 167 Araca Road, Babylon, NY.
WHEREAS, pursuant to New York State Village Law, the Code of the Village of Babylon, and the New York State Building Code, to occupy a residential dwelling there must be issued from the Village Building Department a Certificate of Occupancy;
WHEREAS, the Village now has evidence that the dwelling known as 167 Araca Road, Babylon, New York (“Subject Premises”) is being illegally occupied and there is a propane/gas generator being used for cooking and heating;
WHEREAS, this condition is not only illegal, but extremely dangerous, with the generator producing a deafening sound, disturbing the peace and quiet of the surrounding neighbors;
NOW THEREFORE, BE IT RESOLVED, that by this Resolution, the Board of Trustees hereby authorizes the Village Attorney to commence an action in the Suffolk County Supreme Court to seek a Restraining Order to prevent occupancy of the Subject Premises.
WHEREFOR, this RESOLUTION, hereby adopted by vote of the Board of Trustees on November 28, 2023, shall be promptly recorded in the Office of the Village Clerk, and made part of the public record.
