A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, MAY 9, 2023.  Present were: Mayor Adams, Trustee Seibert, Trustee Cardali, Trustee Bencivenga and Trustee Miga. On the motion of Trustee Bencivenga, seconded by Trustee Miga and unanimously carried, the work session opened at 7:05 PM.  On the motion of Trustee Miga seconded by Trustee Bencivenga and unanimously carried, the work session ended at 7:07 PM.  On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the Board entered into executive session at 7:08 PM to discuss legal and personnel issues.  On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the executive session ended at 8:02 PM.

Regular meeting of the Board of Trustees opened at 8:07 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the April 25, 2023, regular meeting of the Board of Trustees and dispense with the reading of the same.

Trustee Seibert read the following:

WHEREAS a Public Hearing was held on Tuesday April 11, 2023, to consider the application of Cliff Weinstein of The Pizzeria of Babylon LLC to open a restaurant, The Pizzeria, 217 E. Main Street, Babylon.

And

WHEREAS the application was approved at the work session of the Board of Trustees held April 11, 2023, subject to the covenants and restrictions to follow.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to approve and adopt the attached Covenants & Restrictions for The Pizzeria of Babylon, 217 E. Main Street. [Section 010/ Block 04 / Lot 057.001 & 059.001]

      On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

      RESOLVED to terminate Jesus Garcia, full time laborer, effective April 27, 2023.

      On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

      RESOLVED to accept the resignation of Village Attorney, Matthew McDonough, ESQ, effective May 1, 2023.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to grant permission to Hope Floats Babylon Pride to display signs at various locations throughout the Village from May 8th, 2023 – June 4th, 2023 advertising the Babylon Pride Parade taking place on June 4th, 2023.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a refund in the amount of $820.00 to Robert Kraft, Jr. for boat slip #5097 in Lewis Pond.  Resident’s boat is damaged and will not make it into the water for the 2023 Season.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a refund in the amount of $75.00 to Richard Montani for moving from boat slip #31 to #35 in Boynes Canal.  Resident moved to accommodate us placing a bigger boat that needed his original slip.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to issue a refund in the amount of $900.00 to Kristofer Adams for boat slip #7015 at S.E. Lewis; resident giving up slip permanently as of the 2023 Season.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to accept the attached agreement between Babylon Village and Rave Mobile Safety.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to hire William Howard as part time parking meter officer at a rate of $14.00 per hour, effective April 27, 2023.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to Cub Scout Pack 99 to use the Gazebo on June 12th, 2023 from 5:30 PM to 7:30 PM for their Blue & Gold end of year ceremony. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

      On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to approve the following warrant for May 9, 2023:

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to terminate Brayan Garcia, full time laborer, effective April 27, 2023.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to grant permission to Friends of the Babylon Library to display signs at various locations throughout the Village from May 28th, 2023 – June 3rd, 2023 advertising the Friends Book Sale taking place on June 2nd & 3rd, 2023.

      On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

      RESOLVED to issue refunds in the amounts indicated to the applicants listed below for the return of ZBA signs.   [Hearing date: 3/15/2023]

      Mayor Adams spoke about the boating accident and the missing boater, James Jaronczyk.  She thanked the Fire Department, Suffolk County Police and the Coast Guard for all their efforts.  The search is still going and we pray that he is found to be able to give some comfort to his family.  She asked that everyone keep James and his family in their prayers.
