A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, MAY 23, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga and Trustee Miga. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:15 PM. On the motion of Trustee Seibert seconded by Trustee Bencivenga and unanimously carried, the work session ended at 7:20 PM. On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the Board entered into executive session at 7:21 PM to discuss human resources issues and ongoing litigation. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the executive session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:05 PM.

The Pledge of Allegiance was led by Trustee Miga.

Mayor Adams began by saying that she would like to have a moment of silence to acknowledge the severe losses suffered by the village and the Babylon Village Fire Department with the loss of members Bill Bender and Tom Dottinger. They were valued members of the community and the fire department and they will be greatly missed.

On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

RESOLVED to approve the minutes of the May 9, 2023, regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the correspondence from the Fire Department dated May 16, 2023:

At the regular monthly meeting of the Fire Council held May 16, 2023, the Fire Council took the following actions and we await your approval.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to change the location of The Babylon Chamber of Commerce Sidewalk Chalk event on June 3, 2023 to Grove Place. Street closure would be as normal at The Legion Hall. James Street would only need to be closed to the first entrance (west side) of the parking lot to Fitness Incentive.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to amend the Zoning change of the property known as 258 West Main Street, Babylon, New York 11702 (SBL 013.00-01.00-061.001) to RES O. Per Board of Trustees approval back on August 13, 2002, this parcel was inadvertently changed to A-11 but should have remained RES O.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to hire Lindsay Henry as the Attorney for the Village of Babylon Court, at a yearly salary of $10,000, effective May 22, 2023.

    On the motion of Trustee Seibert, seconded by Trustee Miga and unanimously carried, it was

    RESOLVED to issue refunds in the amounts indicated to the applicants listed below for the return of ZBA signs. [Hearing date: 5/17/2023]

    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to approve proposal from Weis Security & Communications as a vendor to service and install Village security cameras.

    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to hire Sean O’Connor, full time laborer, at a yearly salary of $45,760, effective April 10, 2023.

    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $1,500.00 to Steve Neary for boat slip #2025 in Beach Canal. Resident is giving up boat slip permanently as of the 2023 Season because he is moving out of state.

    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to approve the following warrant for May 23, 2023:

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED that the Stormwater Management MS4 annual report for the period ending March 9, 2023 is available for review on the Village website, www.villageofbabylonny.gov, and in the Office of the Village Clerk during normal business hours.

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to increase the salary of Dante Giovanniello, full time laborer, to $45,760 annually, as a CDL B license holder as per CSEA contract.

    On the motion of Trustee Miga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to grant permission to the residents of Fire Island Avenue to hold a block party on Saturday, August 5, 2023, from 11:00 AM - 11:00 PM, with a rain date of Saturday, August 12, 2023. The street will be blocked between Virginia Road and Robbins Avenue, subject to parking restrictions for emergency purposes.

    Mayor Adams read the following:

    WHEREAS a bid opening was held on May 11, 2023 for the Shore Road Bulkhead Resurfacing – Phase II,

    BE IT HEREBY RESOLVED to award the bid to:

    With a bid price of $944,830.00.
