A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, JUNE 27, 2023. Present were: Mayor Adams, Trustee Seibert, Trustee Bencivenga and Trustee Cardali. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:30PM. On the motion of Trustee Seibert seconded by Trustee Bencivenga and unanimously carried, the work session ended at 8:02 PM.

Regular meeting of the Board of Trustees opened at 8:09 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the minutes of the June 13, 2023, regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the correspondence from the Fire Department dated June 20, 2023:

At the regular monthly meeting of the Fire Council held June 20, 2023, the Fire Council took the following actions and we await your approval.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to hire Charles J. Casolaro as the attorney for the Village of Babylon with a monthly retainer of $1,750 and a rate of $225 per hour for all litigation and non-retainer items, effective May 19, 2023.

    Trustee Seibert read the following

    RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law 0627PH 365-20 of 2023 – Land Use Regulations for the Downtown Business District, and therefore,

    BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment, and

    WHEREAS a Public Hearing was held on Tuesday, June 27, 2023,

    BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 0627PH 365-20 of 2023- Land Use Regulations for the Downtown Business District is HEREBY ADOPTED as:

    Local Law # 4 of 2023, amending Chapter §365-20 Land Use Regulations for the Downtown Business District.

    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

    RESOLVED to change the title of Paul Turner from Part Time Park Attendant to Part Time Laborer effective June 1, 2023.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to accept the attached agreement between the Village and Higbie Towing, for a period of two years.

    On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

    RESOLVED to issue a refund in the amount of $470.00 to Stephen Hoberman, for a partial refund for boat slip #7012 in S.E. Lewis basin. Resident sold his boat.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

    BE IT RESOLVED, that the calendars for the appointed and elected officials listed on the attached chart are hereby accepted as an accurate accounting of the average number of days worked per month per year.

    And therefore,

    BE IT RESOLVED, that the Village Board of the Village of Babylon, hereby establish standard workdays for the purpose of determining days worked reportable to the New York State and Local Employee’s Retirement system:

    All Elected and Appointed Officials: Six-hour day

    Mayor’s Secretary, Treasurer, Village Clerk, Village Justice Court, all clerical staff:

    Seven-hour day

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to grant permission to Christ Episcopal Church to host a Bike & Brunch fundraiser on Saturday, October 7, 2023 from 9:00 AM to 2:00 PM. The bike ride will consist of 11 miles, starting and ending at the church. The ride will be on residential streets and have two water stops, one at the village pool and one on Gamecock Lane. Code Enforcement is requested for bicyclist safety.

    On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to approve the following warrant for June 27, 2023:

    Mayor Adams made the following announcement:

    Village Offices will be closed on Tuesday, July 4th in observance of Independence Day. Have a safe and happy holiday!
