A work session of the Board of Trustees of the Village of Babylon was held in the upstairs conference room on TUESDAY, JANUARY 23, 2024. Present were: Mayor Adams, Trustee Seibert, and Trustee Bencivenga. Trustee Cardali, Trustee Miga and Village Attorney Charles J. Casolaro was absent.

On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the work session opened at 7:07 PM. On the motion of Trustee Seibert seconded by Trustee Bencivenga and unanimously carried, the work session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:02 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the minutes of the January 9, 2024 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the correspondence from the Fire Department dated January 9, 2024:

At the regular monthly meeting of the Fire Council held December 19th, 2023 the Fire Council took the following actions and we await your approval:

    On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

    RESOLVED to accept the Fire Department actions as read.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to schedule a public hearing to be held on Tuesday, February 13, 2024 at 7:00 PM to consider the adoption of proposed Local Law 0213PH-Tax Cap of 2024 regarding the Tax Cap. Complete text of the above Local Law will be available beginning February 1st, 2024 in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED that the Board Trustees or a majority thereof shall constitute the Board of Review to hear complaints in relation to assessments on Tuesday, February 20, 2024 at the Municipal Building, 153 West Main Street, Babylon, New York, between the hours of 3:00 PM and 7:00 PM Eastern Standard Time.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Village Chamber of Commerce to hold the 2024 events in the Village of Babylon, including sidewalk access, as per the attached. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as signed and notarized hold harmless agreements, from the Chamber of Commerce and any vendors that participate

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to issue refund in the amount indicated to the applicant listed below for the return of Board of Trustee sign [Hearing Date: 1/9/2024]

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED, to grant permission to the Babylon Village Arts Council to use Argyle Park, the area in front of playground, east of the September 11th Memorial, on Saturday, May 18th, 2024, from 10:00 AM to 4:30 PM (rain date Sunday, May 19th, from 11:00 AM to 4:30 PM) for the 16th Annual Art by the Falls outdoor art exhibit. This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harness agreement.

      On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

      RESOLVED to approve the following warrant for January 24, 2023:

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED that the Receiver of Taxes for the Village of Babylon be authorized to close the Tax Year 2023-2024 on January 23, 2024, and return the Tax Roll and Warrant as required by section 1426 of the Real Property Tax Law.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to M. Roman to hold a Pride Parade on Sunday, June 2, 2024. Meet-up will begin at 1:30 PM at the Fitness Incentive rear parking lot, 157 Deer Park Avenue. Announcements and sponsor recognition will be at 2:30 PM and the car parade is expected to start at 3:00 PM. The parade will complete two loops, escorted by Village Code Enforcement. Permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

      On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

      RESOLVED to grant permission to the Babylon Lions Club to maintain temporary 8 ½ x 11” window signs at local merchants and 5 large signs around the Village from April 1st to April 15th, 2024, to advertise their pancake breakfast on April 14th, 2024. [The Village Highway Department will assist in displaying the 5 large signs around the Village.]

        On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

        RESOLVED to approve the Special Use Permit for Dish Wireless LLC / QualTek Wireless LLC to be added to the Ralph Avenue cell tower. [Letter of Authorization attached]

        On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, it was

        RESOLVED to accept the attached contract renewal for the Street Lighting Agreement between the Town of Babylon and the Village of Babylon for the year January 1, 2024 through December 31, 2024.

          On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to issue a refund in the amount of $3.99 to Jean Marie Parker, Receiver of Taxes. Resident Ann Fagan paid the 2023-2024 taxes for parcel SBL 008-01-115 (1 East Gate) with a bank check in the amount of $995. Tax amount due was $991.01. Village Clerk gave the resident change from the cash drawer for the overpayment amount. The check to the Receiver of Taxes will reconcile the use of the Clerk’s petty cash.

          On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

          RESOLVED to hire Marie Rogate as a full time Office Assistant at an annual salary of $35,000 effective January 2, 2024.

            On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

            RESOLVED to terminate Michael Gioe, full time Laborer effective December 12, 2023.

              On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

              RESOLVED to change Radford Toomer from part time laborer to full time Laborer effective December 18, 2023.

                On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                RESOLVED to accept the request of Irene Ivanoff to retire from the Village of Babylon effective January 27, 2024.

                  On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED increase the Employee Parking Permit fees to $45.00 effective January 19, 2024.

                    On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                    RESOLVED to accept the resignation of Laura Milazzo, full time clerk, with an amended effective date from December 15th to the corrected date of January 2, 2024.

                      On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                      RESOLVED to increase the fees at the E. Donald Conroy Golf Course for the 2024 season as indicated below, effective January 18, 2024.

                        On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                        RESOLVED to grant permission to St. Paul’s Reformed Church to hold a dawn worship service at the Argyle Park Gazebo on Easter Sunday, March 31, 2024, at 5:30 AM to 7:00 AM. This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                          On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                          RESOLVED to accept the DRAFT Audited Financial Statements for the Village of Babylon for the Fiscal Year ended May 31, 202

                          And,

                          ALSO RESOLVED, to accept the Management Comment Letter and Corrective Action Plan for the Financial Statement Audit for Year Ended May 31, 2023.

                            On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, it was

                            RESOLVED to approve the following warrant for January 23, 2024:
