A Special Meeting of the Board of Trustees was held on FRIDAY, JANUARY 29, 2021.  On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the meeting was opened and the Board immediately entered into executive session at 4:15p.m. On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the executive session ended at 5:30 p.m. 

A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, FEBRUARY 2, 2021.  On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, the meeting opened at 4:40 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, the Board entered into executive session at 5:40 p.m. to discuss current litigation, at which time the work session was ended on the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried.  On the motion of Trustee Cardali, seconded by Trustee Seibert and unanimously carried, the executive session ended at 6:35 p.m.

Regular meeting of the Board of Trustees opened at 8:08 p.m.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Mayor Adams, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to approve the minutes of the January 26, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the Babylon Lions Club to hold their annual barbeque fund raiser event at the Village pool on Friday, July 30th, 2021, provided the Village pool is open and CDC and NY State COVID guidelines can be followed.  Permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to Michael Durso, New York State Assemblyman, to use the Babylon Train Station north parking lot on Saturday, February 27th, 2021 from 11:00 am to 2:00 pm to hold a food drive to benefit Island Harvest, sponsored by Michael Durso and Kevin McCaffrey, Suffolk County Legislator.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement from NY State 9th Assembly District and Suffolk County 14th Legislator District.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to hold a Bid Opening on Thursday, February 25, 2021, at 9:30 AM, for the Shore Road Bulkhead Reconstruction, Phase One.  Bid specifications and plans can be obtained from the Village Clerk’s Office between the hours of 9:00 AM and 5:00 PM, Monday through Friday, beginning Thursday, February 11, 2021.  Upon arrival at Village Hall, call the Village Clerk’s Office at (631) 669-1500 for assistance.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried,

WHEREAS, THE VILLAGE OF BABYLON, with the assistance from THE TOWN OF BABYLON, has gathered information and prepared the 2020 SUFFOLK COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN; and

WHEREAS, THE 2020 SUFFOLK COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN has been prepared in accordance with the Disaster Mitigation Act of 2000; and

WHEREAS, THE VILLAGE OF BABYLON is a local unit of government that has afforded the citizens an opportunity to comment and provide input in the Plan and the actions in the Plan; and

WHEREAS, THE VILLAGE OF BABYLON has reviewed the Plan and affirms that the Plan will be updated no less than every five years;

NOW THEREFORE, BE IT RESOLVED by the BOARD OF TRUSTEES that the VILLAGE OF BABYLON adopts the 2020 SUFFOLK COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN as this jurisdiction’s Natural Hazard Mitigation Plan, and resolves to execute the actions in the Plan.

ADOPTED this 9th day of February 2021 at the meeting of the BOARD OF TRUSTEES.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to use Village facilities and venues for their fundraisers and events to be held in 2021, as per the attached, provided the Village facilities/venues are open, and CDC and NY State COVID guidelines can be followed.

Permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

RESOLVED to grant permission to Suffolk Marine to use the Village Municipal Dock from Saturday afternoon, June 5th through Sunday evening, June 6th, 2021, for the Striped Bass Tournament on Sunday, June 6th, 2021, provided all CDC and NY State COVID guidelines can be followed.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to hold a Bid Opening on Thursday, February 25, 2021, at 9:30 AM, for the Raising of 25 East Shore Drive.  Bid specifications and plans can be obtained from the Village Clerk’s Office between the hours of 9:00 AM and 5:00 PM, Monday through Friday, beginning Thursday, February 11, 2021.  Upon arrival at Village Hall, call the Village Clerk’s Office at (631) 669-1500 for assistance.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED that the Village of Babylon will hold two Shred Days to be held at Village Hall on Carlston Place.  The dates and times are as follows:

-          April 17, 2021, from 9:00 AM to 1:00 PM

-          September 25, 2021, from 1:00 PM to 5:00 PM

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED that the Chamber of Commerce will be scheduling Winter Fest Pop-ups at participating businesses and Perfect Pairings events, following COVID restrictions and precautions, as per the attached.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to Christ Episcopal Church to maintain temporary signs at 12 Prospect St. from February 7th through February 17th, 2021 regarding Ash Wednesday.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to accept the attached agreement with PedalShare, Inc. for the bike sharing program in the Village of Babylon, effective September 2020 through September 2022.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried,

WHEREAS the Board of Trustees acknowledges receipt of the application from New York SMSA Limited Partnership d/b/a Verizon Wireless regarding a special use permit for a proposed Verizon Wireless communication facility to be located on the rooftop of the building located at 240 Deer Park Avenue [Section 010 / Block 01 / Lots 017 & 019],

BE IT RESOLVED that the Board of Trustees refers this application to the Village Planning Board for review and advisory recommendation.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, February 23, 2021, by video conference to consider the adoption of proposed Local Law 3 of 2021, a local law authorizing a property tax levy increase in excess of the limit established in General Municipal Law 3-C.  Complete text of proposed Local Law 3 of 2021 will be available in the Office of the Village Clerk and on our website beginning February 11, 2021.  The public can view the livestream video conference from a link on the Village website, www.villageofbabylonny.gov, and will have 14 days after the hearing to comment by mail or email.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to change Anthony Cordovano from a part-time highway laborer to a full-time Custodian-1 position with an annual salary of $29,120.00, effective February 8, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Park Avenue tennis courts (north and south side) from March 1st through May 8th, 2021, between 2:30 p.m. and 6:30 p.m., for the Junior Varsity and Junior High Tennis schedules.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, February 23, 2021, by video conference to consider the adoption of proposed Local Law 2 of 2021, to extend the expiration of Local Law 2 of 2020, regarding the moratorium on 24-hour uses in the Business District. On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the following warrant for February 9th, 2021:

            General Account:                              $ 197,428.63

            TOTAL GENERAL FUND:              $ 197,428.63

            Trust Fund:                                         $     1,393.28

            TOTAL:                                                $ 198,821.91

The Mayor made the following announcements:

-    Village Offices will be closed and there will be no rubbish or garbage pick-up on Monday, February 15th, 2021, in observance of the Presidents’ Day holiday.  Residents should not put rubbish or recycling out to the curb on holidays.

-    Please be advised that summer job applications will be available starting Tuesday, February 16th, 2021.  Applications can be picked up at Village Hall; upon arrival call the Mayor’s Office at (631) 669-1212.  Applications will also be available on the Village website:  www.villageofbabylonny.gov    Applicants for summer jobs must be at least 16 years old.  However, applications will be accepted for residents 15 years of age, and will be kept on file to be used only if additional students are needed.

-    Grievance Day will be held at the Municipal Building, 153 W. Main Street, on Tuesday, February 16th, 2021, from 3:00 p.m. to 7:00 p.m.  Upon arrival at Village Hall, contact the Assessor’s Office at (631) 669-1300 for further instructions.

Mayor Adams thanked the Babylon Fire Department and EMS for safely rescuing someone from the cracked ice at Argyle Lake.  She thanked Code Enforcement and the Highway & Sanitation Departments for the wonderful job they did during the recent storms, and gave a shout-out to the Babylon Village Volunteer Corps for all their help with the shoveling needs of many residents.

The Mayor reminded all to continue to social distance, wear masks, wash hands, and stay safe!
