A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, AUGUST 10, 2021.  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:01 PM.  On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:10 PM to discuss current litigation, at which time the work session was ended on the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried.  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the executive session ended at 8:00 PM.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON

Regular meeting of the Board of Trustees opened at 8:06 PM.

The Pledge of Allegiance was led by Trustee Silvestri.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the July 27, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to grant permission to the Chamber of Commerce to change the date of the September Street Fair from September 19th to September 26th, 2021.  (The original date conflicted with the rain date for the annual BBS Country Fair at Argyle.)

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, September 14, 2021 at 7:00 PM to consider the adoption of proposed Local Law 10 of 2021 to amend Chapter 256-3 A. of Village code to prohibit contractors from working on Sundays in the Village of Babylon.  Complete text of the above Local Law will be available beginning September 2nd in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried,

BE IT RESOLVED, that the calendars for the appointed and elected officials listed on the attached chart are hereby accepted as an accurate accounting of the average number of days worked per month per year.

And therefore,

BE IT RESOLVED, that the Village Board of the Village of Babylon, hereby establish standard workdays for the purpose of determining days worked reportable to the New York State and Local Employee’s Retirement system:

        All Elected and Appointed Officials:                             Six-hour day

        Mayor’s Secretary, Treasurer, Village Clerk, Village Justice Court, all clerical staff:

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED that the Village of Babylon will hold the annual S.T.O.P. (Stop Throwing Out Pollutants) and Shred Day on Saturday, September 25, 2021 from 9:00 AM to 12:00 Noon, with a paper shredding truck available to Village residents from 1:00 PM to 5:00 PM.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to the residents of Walbridge Avenue to hold a block party on Saturday, September 18, 2021, from 1:00 PM to 11:00 PM.  The street will be blocked between Little East Neck Road South and Mayhew Avenue, subject to parking restrictions for emergency purposes.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, September 14, 2021 at 7:00 PM to consider the adoption of proposed Local Law 9 of 2021 to amend Chapter 343-74 of Village Code to require parking by special permit only on Merman Place and on the east side of Fire Island Avenue, between Nereid Place and Merman Place. Complete text of the above Local Law will be available beginning September 2nd in the Office of the Village Clerk and the Village website, www.villageofbabylonny.gov.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, September 14, 2021 at 7:00 PM to consider the application of Grace Iazbeck of Haus of Grace, 10 James Street, for a change of use permit to add a Physician’s Assistant specializing in dermatology and cosmetic services. Copy of the application and plans will be available beginning September 2nd in the Office of the Village Clerk.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to increase the hourly rate of Golf Starter William Doxey to $9.75 per hour, retroactively effective to May 25, 2021.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $330.00 to Robert Cerrone for boat slip #5023 at Lewis Pond for the remainder of the 2021 season.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $260.00 to Richard Grempel for boat slip #4072 at East Creek for the remainder of the 2021 season.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED that the Metropolitan PGA will hold the Junior PGA Golf Tournament at the Village Golf Course on Monday, August 23, 2021.  A certificate of insurance with the Village listed as an additional insured as well as a notarized hold harmless agreement are to be provided.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Mayor and Board of Trustees of the Village of Babylon hereby authorize and direct the Babylon Village Justice Court to apply for a JCAP grant in the 2021-2022 grant cycle up to $30,000.00, and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this court.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to schedule a public hearing to be held on Tuesday, September 14, 2021 at 7:00 PM to consider the adoption of proposed Local Law 11 of 2021 regarding fishing regulations.  Complete text of the above Local Law will be available beginning September 2nd in the Office of the Village Clerk and on the Village website, www.villageofbabylonny.gov.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

Mayor Adams made the following Announcements:

-          There will be no second Board meeting in August.

-          Village of Babylon Offices will be closed and there will no rubbish or garbage pick-up on Monday, September 6, 2021 in observance of the Labor Day Holiday.  Residents should not put rubbish or recycling out to the curb on holidays

The mayor presented a floral arrangement to the Board that was prepared and delivered by resident Donna Jeansonne of Foster Lane, as a ‘thank you’ to the Mayor and Board for everything they do on a daily basis.
