A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, APRIL 20, 2021.  On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 4:45 p.m.  On the motion of Trustee Seibert, seconded by Trustee Cardali and unanimously carried, the work session ended at 7:15 p.m.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:05 p.m.  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:15 p.m. to discuss current litigation, at which time the work session was ended on the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried.  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the executive session ended at 8:00 p.m.

Regular meeting of the Board of Trustees opened at 8:03 p.m.

The Pledge of Allegiance was led by Trustee Cardali.

Mayor Adams congratulated the Fire Department members who were elected to serve their Companies as Company Officers or Wardens on the Fire Council.

On the motion of Mayor Adams, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to approve the minutes of the April 13, 2021 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated April 21, 2021:

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to hire Lisa Tripp as secretary to the Mayor with an annual salary of $49,140.00 effective April 15, 2021.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Park Avenue tennis courts (north and south side) from April 26th through June 12th, 2021, between 2:30 p.m. and 6:30 p.m., for the Varsity, Junior Varsity and Junior High Boys Tennis teams.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to grant permission to Teresa Striker to maintain two temporary signs [18” x 24”] in the storefront windows of 10 Grove Place to announce Argyle Toys coming soon.  This permission is granted from April 28, 2021 until approval of the permanent sign by the Architectural Review Board.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to make the following adjustment to the proposed 2021/22 budget:

            Reduce expenditure:

Account Code A1420.400 LAW CONTRACTUAL EXPENSES in the amount of $75,000

            Increase expenditure:

Account Code A1420.106 LAW-PERSONAL SERVICES in the amount of $75,000

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried,

WHEREAS a Budget hearing was held on April 5, 2021 to consider the proposed Budget for the 2021/22 fiscal year,

BE IT HEREBY RESOLVED to adopt the Budget for the fiscal year 2021/22 as adjusted.

On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

RESOLVED to add the liens highlighted on the attached chart to the 2021/22 Tax Bills

And,

ALSO RESOLVED to add the property maintenance charges highlighted on the attached chart to the 2021/22 tax bills.

Trustee Silvestri mentioned some of the upcoming events around the Village:

- Kentucky Derby Fundraiser at the Conklin House from 5 PM to 7 PM this Saturday, May 1st

- Bike Belmont on Saturday, May 8th

- Bike Rodeo on Wednesday, May 12th as part of National Bike Safety month

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to increase the annual salary of Anthony Nunez to $45,760 effective April 27, 2021.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to grant permission to Robert Verdi to maintain temporary signs at various properties in the Village from April 19th through May 19th, 2021, regarding the Board of Education election.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to increase the Commercial Building Inspection fees to $250.00 for a three-year period effective April 27, 2021.

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to accept the following rates at the Babylon Village Pool for the 2021 season:

            Family Pass:                $125.00

            Adult Pass:                  $  60.00

            Child Pass:                  $  40.00

            Senior Pass:                 25.00

            Sunrise Swim:               40.00

            Daily Pass:

On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the following warrant for April 27, 2021*:

Trustee Cardali commented that the pool is scheduled to open for the season on June 25th, 2021; applications are still being accepted.  Registration will begin Saturday, May 14th.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to accept the request of Suzanne Schettino to retire from the Village of Babylon effective April 30, 2021 with her last day of work April 29, 2021.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the softball field on the north side of Locust Avenue from May 10th, 2021 through June 12th, 2021, between 3:00 p.m. and 5:30 p.m., for the Junior High Softball team practices.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Arts Council to display temporary signs from April 30th to May 15th, 2021 at the three entrances to the Village indicated below to advertise the Arts by the Falls outdoor art exhibit:

      By the intersection of John Street and Cooper Street

      Deer Park Avenue and Washington Street (by the Church)

      East Entrance to the Village on Main Street

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a refund in the amount of $660.00 to Catherine Daly, as we will be subletting her boat slip #4082 at East Creek for the 2021 season.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to issue a refund in the amount of $55.00 to Howard Raftery for switching from boat slip #1038 at Argyle Basin to sublet slip #5085 at Lewis Pond for the 2021 season.

On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

RESOLVED to assume lead agency status pursuant to SEQRA concerning proposed Local Law 3 of 2021 and issue a negative declaration pursuant to SEQRA.

And,

WHEREAS a Public Hearing was held on Tuesday, April 13, 2021,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #3 of 2021, is HEREBY ADOPTED as:

Local Law 3 of 2021, to amend Village Code Chapter 93-4; to change the subheading and to add subsection (C) regarding No Bike Zones.

Trustee Bencivenga congratulated Michael Williams for the first hole-in-one at the Golf Course this season.  He also commented that I.D. is required for everyone at the golf course.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Maureen Rigelhaupt as a part-time employee in the Office of the Village Clerk with a salary of $11.00 per hour effective January 14, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to set the pay scale for Directors working in the Babylon Village Summer Recreation Program from June 28 to August 6, 2021.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the salary schedule for the Summer Youth Employment Program for 2021, as per the attached.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Rotary Club to host the induction fundraiser at the Village pool from 6:00 PM to 9:00 PM on Wednesday, July 7, 2021 (rain date July 14, 2021) following all local, county, and state COVID guidelines.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Village of Babylon will hold the 2nd Annual Pickleball tournament on June 12th and 13th, 2021.

Trustee Seibert commented that pickleball clinics will be held on Mondays and Tuesdays from June to October.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to schedule public hearings to be held Tuesday, May 11, 2021 for the following proposed Local Laws:

            Local Law 4 of 2021-

                        to amend Chapter 365 to add 365-153 through 365-157 regarding restrictions on the sale of vaping and marijuana products

            Local Law 5 of 2021-

to amend Chapter 365-3, 365-17, 365-20, and 365-21 regarding Urgent Care Facilities.

            Local Law 6 of 2021-

                        to amend Chapter 237 regarding abatement of nuisances.

            Local Law 7 of 2021-

                        to amend Chapter 302 regarding Solid Waste

Mayor Adams congratulated Babylon Village resident Melissa Muma who was honored by Suffolk County and Legislator Kevin McCaffrey as a ‘Woman of Distinction’ for the organization she formed, Babylon Strong.
