A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, APRIL 12, 2022. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the meeting opened at 7:15 PM. On the motion of Trustee Seibert, seconded by Trustee Bencivenga and unanimously carried, the Board entered into executive session at 7:22 PM to discuss Human Resources, at which time the work session was ended on the motion of Trustee Silvestri, seconded by Trustee Cardali and unanimously carried. On the motion of Trustee Bencivenga, seconded by Trustee Seibert and unanimously carried, the executive session ended at 8:00 PM.

Regular meeting of the Board of Trustees opened at 8:04 PM.

The Pledge of Allegiance was led by Trustee Seibert.

On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the minutes of the March 22, 2022 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the General Convention of the Babylon Fire Department dated April 7, 2022:

    The annual meeting of the General Convention of the Babylon Fire Department was held at 8:00 PM on Thursday, April 7, 2022 as prescribed by Article III, Section 1 of the Department Bylaws.

    The purpose of the Convention was to elect nominees for the office of Chief Engineer, First Assistant Chief, Second Assistant Chief and Third Assistant Chief.

    The nominees receiving the plurality of votes were as follows:

    Chief Engineer Matthew B. Arundale

    First Assistant Chief James P. Miga

    Second Assistant Chief William T. Sadousky

    Third Assistant Chief Eric P. Price

    Please forward the results of the General Convention to the Village Board for their confirmation.

    Mayor Adams read the letter from the Fire Department to the Board listing individuals elected to serve their Companies, Squads, or Units as Officers or Wardens.

    On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

    RESOLVED to accept the Fire Department actions as read.

      On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

      RESOLVED to approve a stipend of $2.00 per hour for Alex Iacono-Hall to provide EMT services for the Village effective retroactively as of July 21, 2021.

        On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

        RESOLVED to grant permission to the American Legion Babylon Post 94 to hold the annual Memorial Day parade on Monday, May 30, 2022 at 10:00 AM. The parade will start at Foster Blvd. and Deer Park Avenue, proceed south on Deer Park Avenue to Montauk Highway, then west to the gazebo, where the Memorial Day ceremonies will be held. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

          On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

          RESOLVED to grant permission to the Babylon Rotary Club to hold the 17th Annual Babylon Village Classic Dirty Sock 10K Run on Sunday, August 21, 2022, from 8:00 AM to 11:00 AM, with the start and finish adjacent to the tennis courts on the north side of Park Avenue. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

            On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

            RESOLVED to grant permission to the Babylon Village Arts Council to hold a Petra Puppet Show in Argyle Park east of the falls, on Saturday, May 21, 2022, from Noon to 1:00 PM (rain date to be determined) including access to electric for speakers. This permission is granted contingent upon timely receipt of required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

              On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

              RESOLVED to grant permission to the Babylon Village Committee for the Town of Babylon 150th Anniversary to display temporary signs to advertise Ole Times Day beginning April 30th as indicated below:

              36” x 48” street signs:

                   Main St. and Rt 109 intersection

                   Main St. and Rt. 231 intersection

              24” x 36” street signs:

                   John St. and Cooper St. intersection

                   Deer Park Ave. between Clinton St. & Washington St. (by Cross of Christ Lutheran Church)

                   Park Avenue and Little East Neck Rd. 

              12” x 18” posters in the windows of various merchants in the Village

                On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

                RESOLVED to amend the resolution dated April 4, 2022 and appoint Timothy J. Dunn III as Associate Village Justice for one year at a salary of $200 per court session.

                  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

                  RESOLVED to add the highlighted liens on the attached chart to the 2022/23 tax bills.

                  On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, it was

                  RESOLVED that the Village of Babylon will hold the Annual Snapper Derby on Saturday, August 27, 2022 from 9AM-12 Noon on the main dock for kids 12 and under.

                  Trustee Seibert commented that applications are being accepted for coaches and directors for the summer recreation programs.

                  On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED to increase the annual salary of Alex Iacono-Hall $1,000 effective March 1, 2022, having completed his six-month probationary period.

                  On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED to increase the annual salary of Stephanie Lino $1,000 effective March 20, 2022, having completed her six-month probationary period.

                  On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED to terminate Chris Barrios as full-time laborer effective March 22, 2022.

                  On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED to grant permission to the Babylon High School Class of 2023 to host a Color Run through the trails of Southards Pond on Saturday, May 21, 2022, from 10:00 AM to approximately 12:00 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed and notarized hold harmless agreement.

                  On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                  RESOLVED to grant permission to Christ Episcopal Church to maintain temporary signs (8 1/2” x 11”) at various merchants in the Village from April 10th through May 8th, 2022 to advertise World Labyrinth Day and the Mothers’ Day weekend Plant Sale.

                    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                    RESOLVED to grant permission to the Veterans Yoga Project to host a Duck Derby in Argyle Park at 10:00 AM on Saturday, June 25th, 2022 (rain date June 26th). Permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                    On the motion of Trustee Silvestri, seconded by Trustee Seibert and unanimously carried, it was

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to hire Michael Giossi as a seasonal Golf Pro at a rate of $20 per hour effective June 26, 2022.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to grant permission to the Babylon Village Arts Council to host an Art Walks event in the Business District on Saturday, September 24th, 2022 from 11:00 AM to 3:00 PM, including poetry readings and side walk musicians, with a chalk-a-walk area to be set up, and,
                        ALSO RESOLVED to grant permission to the Babylon Village Arts Council to maintain three temporary signs at the entrances to the Village to promote the Art Walks event from September 9th through September 24th, 2022.
                        This permission is granted contingent upon timely receipt of the required certificate of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to grant permission to the Babylon Village Arts Council to maintain two 36”x48” temporary signs at the two entrances to the Village on Main Street from May 6th through May 21st, 2022 to advertise the Art by the Falls event.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to amend the resolution dated March 22, 2022 and grant permission to the Great South Bay Amateur Radio Club to host the annual International Marconi Day activities in the North Carll Avenue municipal parking lot by Village Hall, 153 W Main Street, on Saturday, April 23, 2022, from 6:00 AM to 6:00 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to issue a refund in the amount of $15.00 to Craig Morgan for moving from an 11’ wide slip at Boynes Canal (#3020) to a 10’ wide slip at Lewis Pond (#5063) as of the 2022 season.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to issue a refund in the amount of $130.00 to James Raffoni for moving from a 14’ wide slip at Main Dock (#8032) to a 12’ wide slip at Main Dock (#8030) for the 2022 season only.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED to issue a refund in the amount of $205.00 to James Rogers for giving up Lewis Pond slip #5039 and moving to Lighthouse slip #9006.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried, it was

                        RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed local law of 2022 amending Chapter §A369 Dock Rules and Regulations,

                        And therefore,

                        BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

                        On the motion of Trustee Bencivenga, seconded by Trustee Cardali and unanimously carried,

                        WHEREAS a Public Hearing was held on Tuesday, April 12th, 2022,

                        BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law of 2022 Chapter §A369, is HEREBY ADOPTED as:

                          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                          RESOLVED to grant permission to Boy Scout Troop #1 to use the gazebo on Thursday, April 14, 2022 from 7:00 PM to 8:30 PM for their troop meeting. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                          RESOLVED to grant permission to Babylon Girl Scout Troop #1043 to use the Gazebo on Thursday, May 12th, 2022 from 6:30 PM to 8:00 PM. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                          RESOLVED to correct the resolution dated March 22, 2022 and grant permission to Bob McKeown and M. Roman to hold a Pride Parade on Sunday, June 5, 2022. The car parade is expected to start at 3:00 PM. The parade will complete two loops, escorted by Village Code Enforcement. Permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured and a signed & notarized hold harmless agreement.

                          On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                            On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                            RESOLVED that the Board of Trustees of the Village of Babylon hereby requests proposals for the Food Concession at the Gilbert C. Hanse Municipal Pool. Sealed proposals should be submitted to the Office of the Village Clerk no later than 9:30 AM, Thursday, May 5th, 2022. The specifications for the Request for Proposal may be obtained at the Office of the Village Clerk during regular business hours, 9:00 AM to 5:00 PM, Monday through Friday, or via email request to jparker@villageofbabylonny.gov.

                            On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                            RESOLVED that the Village of Babylon will hold the Annual Snapper Clinic on Saturday, August 20, 2022 from 9AM-12 Noon in the Gilbert C Hanse Pool parking lot.

                            On the motion of Trustee Cardali, seconded by Trustee Bencivenga and unanimously carried, it was

                            RESOLVED to hold a Bid Opening at 9:30 AM on Thursday, May 5th, 2022, for the Roof of the Gilbert C. Hanse Municipal Pool building. Bid specifications will be available in the Office of the Village Clerk, Monday through Friday, between the hours of 9:00 AM and 5:00 PM, beginning April 21st, 2022. *Postponed until a later date; yet to be determined*

                            Mayor Adams made the following announcements:

                                 - Village offices will close at Noon on Good Friday, April 15, 2022.

                                 - Shred Day will be April 23, 2022 from 9:00 AM to 1:00 PM at the Highway Department on Carlston Place.

                              The meeting was opened to the public; no one addressed the Board.

                              Mayor Adams wished all a Happy Easter and Happy Passover.

                              On the motion of Trustee Seibert, seconded by Trustee Silvestri and unanimously carried, the meeting adjourned at 8:27 PM.
