A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, SEPTEMBER 8, 2020, via Zoom and available to be viewed through the YouTube link:

On the motion of Trustee Davida, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 7:05 p.m.  On the motion of Trustee Bencivenga, seconded by Trustee Adams and unanimously carried, the Board entered into executive session at 7:12 p.m. to discuss current litigation and adjourned the work session.  On the motion of Trustee Bencivenga, seconded by Trustee Adams and unanimously carried, the executive session ended at 7:43 p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was led by Trustee Bencivenga.

The Mayor welcomed Trustee Bencivenga to his first Board meeting and commented that all Village Board meetings will continue to be held via ZOOM because the Governor extended the suspension of in-person meetings until October.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the minutes of the August 11, 2020 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated August 19, 2020:

At the regular monthly meeting of the Fire Council held August 18, 2020, the Fire Council took the following actions and we await your approval:

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to terminate the employment of Erik Alloy as a Highway Laborer effective July 14, 2020.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED that the Mayor and Board of Trustees of the Village of Babylon hereby authorize and direct the Babylon Village Justice Court to apply for a JCAP grant in the 2020-2021 grant cycle up to $30,000.00, and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this court.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to approve the following warrant for September 8, 2020:

            General Account:                               $ 319,967.80

            Conklin House:                                  $        449.00

            TOTAL GENERAL FUND:              $ 320,416.80

            Trust Fund:                                         $        200.04

            TOTAL:                                                $ 320,616.84

Trustee Silvestri spoke about the upcoming events at the Conklin House, starting with Health & Safety Day on September 20th, a composting workshop on October 3rd, the 25th anniversary of the Apples & Arts Festival with a digital art show and workshops, and pumpkin painting and scarecrow making on October 18th.  She recommended checking the Conklin House Facebook page for more details.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the annual salary of Jeanette Yantz $7,000.00 effective August 17, 2020.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried,

Whereas a Public Hearing was held on Tuesday, August 11, 2020,

BE IT HEREBY RESOLVED to approve the application of Frances and Jose Beiro of NoaMar Markets, 238 Deer Park Avenue, to convert to a restaurant.

ALSO BE IT RESOLVED to approve and adopt the attached covenants and restrictions for NoaMar, 238 Deer Park Avenue.           [Section 010/ Block 01/ Lots 017 & 019]

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED, that the calendars for the appointed and elected officials listed on the attached chart are hereby accepted as an accurate accounting of the average number of days worked per month per year,

And therefore,

BE IT RESOLVED, that the Village Board of the Village of Babylon, hereby establish standard workdays for the purpose of determining days worked reportable to the New York State and Local Employee’s Retirement system:

All Elected and Appointed Officials:             Six-hour day

Mayor’s Secretary, Treasurer, Village Clerk, Village Justice Court, all clerical staff:

Seven-hour day

Superintendent of Public Works and laborer staff:

Trustee Adams mentioned the upcoming events in the Village this weekend, including the pickleball tournament, dance lessons, and snapper clinic.  Information for these events can be found on the Village Facebook page.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to terminate the employment of Liam McGoldrick as a highway laborer effective July 25, 2020.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $262.50 to David Stewart as he will not be using his boat slip, East Creek slip #93, for the remainder of the 2020 boating season.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Lindy’s Taxi in the Village of Babylon, retroactive to September 1, 2020:  Georgios Drineas

Trustee Bencivenga thanked Kevin Muldowney for the time spent reviewing golf course and dock information with him.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to increase the annual salary of Melissa Kalhorn $1,000.00 effective August 18, 2020, having completed the six-month probationary period.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $301.60 to Forchelli Deegan Terrana LLP for the 2019 and 2020 Tax years as per the attached court-ordered settlement and assessor petitions for the property located at 97 Peninsula Drive.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the attached Temporary License Agreement with Tres Palms pertaining to employee parking at the Village pool for the period July 11, 2020 to July 10, 2021.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to allow the Mayor to enter into an agreement with Suffolk County Water Authority regarding the paving restoration for Coppertree Lane, Babylon.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to reschedule the 2020 S.T.O.P. / Shred Day to be held on Saturday, September 26, 2020.  S.T.O.P. Day will be between 9:00 a.m. and Noon, and a paper shredding truck will be available to Village residents from 1:00 p.m. to 5:00 p.m.


The Mayor asked any members of the press listening to this meeting to please help spread the word about the change of date for the annual S.T.O.P. and Shred Day to be held on Saturday, September 26th, 2020.  He reiterated that the S.T.O.P Day portion will be from 9:00 AM to Noon on Saturday, September 26, 2020, and a paper shredding truck will be available to Village residents from 1:00 to 5:00 PM on Saturday, September 26th, 2020.
