PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, November 12th, 2019, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of proposed
Local Law #8 of the year 2019
to amend current Village Code, Chapter 281, regarding Rental Property.
Complete text of the above Local Law is available in the office of the Village Clerk, on the Village website: www.villageofbabylonny.gov, or can be requested by calling the Village Clerk’s Office at (631) 669-1500.
All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.
Attorney Gerard Glass explained that this is the second public hearing regarding changes to the current rental ordinance which would prohibit rentals for less than thirty (30) days. This second draft involves a change to section 281-17. It eliminates the real estate broker’s responsibility post-rental. The obligation of the broker continues pre-rental in that they still need to confirm that a rental permit exists, but the reporting obligation post-rental has been removed from this draft.
The Board supported this proposal as they believe that short-term rentals like Airbnb’s have a mostly negative affect on Village neighborhoods (resident safety, property values, street parking, etc.). They are a hinderance to the small-town model of the Village and create quality of life issues.
The meeting was opened to the public; no one present spoke in opposition to this local law
Those who spoke in favor of this local law:
- Russell Bahm, 23 Harbour Road
- Jeffrey Thompson, 8 Waters Edge Court
On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to reserve decision.
Meeting adjourned at 7:10 p.m.
