Legal notice was read by the Deputy Village Clerk:


NOTICE IS HEREBY GIVEN: that the Board of Trustee of the Village of Babylon will hold a Public Hearing on Tuesday, March 26, 2013 at 7:00 p.m. or as soon thereafter as can be heard to consider the application of Anthony Labiento/ The Long Island Yacht Club 307 Little East Neck Road S., Babylon New York to replace two structures damaged by hurricane Sandy, with one structure.   The new structure will not exceed the total square footage of the two previous structures.


Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10am and 4 pm Monday through Friday.


All interested persons should appear at the above time and place and they will be given the opportunity to be heard.  All applicants and their duly appointed representatives must appear in person at the above hearing.

Mr. Russo stated that the proposed new building is fully compliant with Village Building codes and FEMA requirements.  He noted it is replacing building in kind and also noted that the design was more in character with the homes in the area.


Attorney Joel Sikowitz questioned the building height of 21’ to the ridge and stated that the Long Island Yacht club needs to re-check Village code for accessory building height requirements.  He also asked about hours of operation and food and beverage service, liquor licenses, and any music that will emanate from this new building.


Mayor Scordino noted that the application needs to list the EXACT hours of operation for both food service and beverage service.


Mr. Labiento stated that food service would be from noon until 8:00 p.m. daily, and beverage service would be from noon until 8:00 p.m. Monday through Thursday, noon until 11:00 p.m. Friday and Saturday, and noon until 9:00 p.m. on Sunday.  However, Mr. Russo pointed out that people would still be using the site, even though services have ended.



Trustee Davida questioned the length of the season, and how many people frequented the yacht club on a weekend evening, and utilize the bar.  He also questioned the size of the new bar, stating that it was significantly larger than the existing bar.  He also questioned the positioning of the bar, as it is shown on the plans to face the houses on Waters Edge Court, and questioned why it wasn’t positioned to face east.

The following residents spoke against the application, and expressed extreme concern over the excessive noise and other activities that are occurring at the Yacht Club that are against regulations.  They do not believe the Yacht Club to be a good neighbor at all.

Mayor Scordino confirmed that he has received multiple complaints regarding noise from the Yacht Club in the past and that he has addressed issues with the Yacht Club on numerous occasions.


The Mayor stressed the importance of residents calling him personally, at any time, whenever they witness something questionable occurring at the Yacht Club.  Mayor Scordino assured all residents that he would immediately have all complaints addressed.



On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried it was


RESOLVED TO: reserve decision.
