A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, October 22nd, 2019.  On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:15 p.m. On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:52 p.m. to discuss current litigation.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Executive Session ended at 8:05 p.m.  On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, the meeting adjourned at 8:05 p.m.

Regular meeting of the Board of Trustees opened at 8:13 p.m.

The Pledge of Allegiance was led by Trustee Adams.

Lisa Belinsky, from Long Island Transit Solutions, presented the Mayor with the Gold Award for the Village’s outstanding participation in Car Free Day Long Island 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the October 8th, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Girl Scouts to use the Argyle Gazebo on Saturday, December 7, 2019, from 10:30 a.m. to 2:00 p.m., for their annual Holiday Gathering.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Breast Cancer Coalition to maintain temporary signs at various merchants in the Village from October 23rd to November 8th, 2019, to advertise their fundraising event, “An Evening of Light”.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that the Mayor is authorized to sign an agreement with the Town of Babylon for Community Development Block Grant Funds.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for October 22nd, 2019:

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Jennifer Gromus, of Leading Edge Real Estate, to maintain a temporary banner, 22½” tall x 28’ long, on the building located at 170 Deer Park Avenue, beginning November 1st, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $50.00 to Margaret Drew of MADD Bartini Inc. for the return of one Board of Trustees Public Hearing sign for partial refund.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to hold a Bid Opening on Thursday, November 7, 2019, at 9:30 a.m., for the Restoration of Argyle Falls Re-bid.  Bid specifications are available in the Office of the Village Clerk, between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that Donna Jurasits produce the Village Newsletter at $1,800 for the Winter Edition, effective October 22, 2019.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to Babylon Girl Scout Troop 616 to go on a nature walk around Southards Pond on Thursday, October 24, 2019, between 3:00 and 3:30.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $104.51 to Cronin & Cronin Law Firm as per the attached court-ordered settlement for the Tax Year(s) and parcel listed.

RESOLVED to grant permission to St. Joseph Church to maintain temporary signs from November 15th to December 15th, 2019, at the locations indicated below to advertise the St. Joseph’s Choir concert, “The Messiah and Other Sacred Masterpieces” to benefit the Mercy Inn Soup Kitchen.

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #9 of 2019, pertaining to Chapter 365, Retail Business Districts;

and therefore,

BE IT RESOLVED that the Board of Trustees has determined that this action will not have an adverse impact on the environment.

WHEREAS a Public Hearing was held on Tuesday, October 8, 2019,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 9 of 2019, is HEREBY ADOPTED as:

The Mayor made the following announcement:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, November 11th, 2019, in observance of the Veterans Day Holiday.

Just a reminder that residents should not put rubbish or recycling out to the curb on holidays.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to continue the Public Hearing on proposed Local Law 8 of 2019 (renumbered from proposed Local Law 7 of 2019) on November 12th, 2019 at 7:00 p.m. A full copy of the text of this amended Local Law is available in the Office of the Village Clerk.
