A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, November 17, 2020. On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, the meeting opened at 4:04 p.m. On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the work session ended at 5:30 p.m.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 7:07 p.m. On the motion of Trustee Davida, seconded by Trustee Bencivenga and unanimously carried, the Board entered into executive session at 7:17 p.m. to discuss current litigation, at which time the work session was ended on the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried.

RESOLVED to accept the Fire Department actions as read.
On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to hire James Bender as a part-time highway laborer with a salary of $10.00 per hour effective November 16, 2020.
On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to increase the salary of Luigi Dellamonnica $.48 per hour effective November 23, 2020.
On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to increase the salary of Marc Fisch $.48 per hour effective November 23, 2020.

RESOLVED to accept the request of Paul Schulhaus to retire from the Village of Babylon effective October 31, 2020.

RESOLVED to accept the DRAFT Audited Financial Statements for the Village of Babylon for the Fiscal Year Ended May 31, 2020.
On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to amend the Covenants & Restrictions originally adopted on September 8, 2020 for NoaMar Restaurant, to correct the hours of operation and clarify the only outside storage permitted, as per the attached.
On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to grant permission to the Suffolk County Police Department First Precinct C.O.P.E. Unit and the Police Athletic League to use the Locust Avenue baseball field and lights on Tuesdays from 5:00 PM to 6:30 PM for approximately 6 weeks, to hold a non-contact, social- distanced Football Skills Camp [from December 8th, 2020 to January 19th, 2021, weather dependent].
This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as signed and notarized ‘Hold Harmless’ agreements.
On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to appoint Frank J. Seibert as a Trustee of the Village of Babylon to fill the unexpired term of Trustee Mary Adams which is to April 2021, effective November 24, 2020.
On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to re-appoint Mary Lou Bartsch to the Architectural Review Board for a three-year term which is through November 2023.
On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to re-appoint Lynn Dunlop to the Architectural Review Board for a three-year term which is through November 2023.
On the motion of Trustee Silvestri, seconded by Trustee Davida and unanimously carried, it was
RESOLVED to appoint Trustee Dominic Bencivenga to the Dock & Golf Committees previously held by retired Trustee Kevin Muldowney.
On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to accept the Management Comment Letter and Corrective Action Plan for the Financial Statement Audit for Year Ended May 31, 2020.
Trustee Silvestri commented on the recent events held at the Conklin House; Santa Paws went very well and over 60 families participated in Picture Perfect. Upcoming at the Conklin House is the cookie contest on December 3rd, and, if Governor Cuomo’s governance allows, December 4th will be the holiday house tours, reservations are required. Coming in the Spring of 2021 will be the Conklin House Community Garden. Residents, organizations, and local businesses will be able to adopt an area of the gardens to plant, maintain, and harvest. More information will be posted on the Conklin House social media pages.
On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to issue a pro-rated refund in the amount of $120.00 to Richard Viverito for boat slip #13 at Main Dock, which was sublet to another boater from October to the end of the 2020 boating season.
On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to accept the recommendations of the Dock Committee to make the Mud Creek Dock Program permanent.
Trustee Bencivenga read the memo from the Dock Committee, “The Dock Committee of the Incorporated Village of Babylon has determined that the Mud Creek Pilot Mooring Program shall be made permanent and recommends that the Village Board of Trustees codify this amendment and the inclusion of Northeast Lewis Pond in Chapter A369 of the Village Code.”
On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to approve the engagement letter with Skinnon and Faber Certified Public Accountants, P.C. for the three years ended May 31, 2021, May 31, 2022, and May 31, 2023. They will provide the audit of the Village’s financial statements of governmental activities, each major fund, and note disclosures, which collectively comprise the basic financial statement for the years noted above.
On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to schedule a public hearing to be held on January 12th, 2021 at 7:00 PM to consider proposed Local Law #1 of 2021 regarding Chapter A369 Dock Rules and Regulations to amend §A369-15 to include Northeast Lewis Pond in the title and to add §A369-17 A. Mud Creek.
On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to approve the following warrant for November 24, 2020:

Trustee Bencivenga commented on the fantastic work the golf course team has been doing and that the boat season officially ends on December 1st. Trustee Bencivenga reminded residents that boats should not be stored within the front yard line and there must be at least one clear side yard of 10 feet. If winter mooring is needed, contact the Village Clerk’s Office.
Mayor Adams read the following regarding proposed Local Law 4 of 2020 and polled the Board:
RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #4 of 2020 amending Chapter 93-8, Bicycles,
And therefore,
BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment
And,
WHEREAS a Public Hearing was held on Tuesday, November 10, 2020, BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #4 of 2020, is HEREBY ADOPTED as:

Mayor Adams made the following announcements:
- Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Thursday, November 26, 2020, in observance of the Thanksgiving Day Holiday. Residents should not put rubbish or recycling out to the curb on holidays.
- This Friday evening, November 27th, the Chamber of Commerce will be ‘lighting the night’ in downtown storefront windows beginning at 5:00 PM to honor and commemorate the life and legacy of Mayor Ralph A. Scordino. At 6:00 PM the Christmas tree in Argyle Park will be lit as Village residents and merchants may share a memory or pay tribute to the late Mayor. Mayor Adams gave special thanks to the Chamber of Commerce, the Highway Department, and Code Enforcement for all their help in coordinating this special event.
- This Saturday, November 28th, is Small Business Saturday. All are encouraged to shop locally and support our Village merchants.
- Trustee Robyn Silvestri will be heading up the Babylon Village Volunteer Corp, originally started by Mayor Scordino and his wife, Linda. Tomorrow the Volunteer Corp will be hosting a clean-up at the Locust Avenue parking lot. Monthly clean-ups will be hosted with more information to be posted on the Facebook page. Mayor Adams mentioned that any residents who are in need of help can contact the Volunteer Corp at BVVCorps@gmail.com
- Trustee Dominic Bencivenga will be added to the Budget Committee.
On the motion of Mayor Adams, seconded by Trustee Bencivenga and unanimously carried, it was
RESOLVED to name Argyle Falls the Ralph A. Scordino Memorial Falls at Argyle Lake.
Mayor Adams commented on the huge outpouring of support from so many and thanked all who have donated to the Argyle Falls restoration project in memory of Mayor Scordino. The renovation project was so important to Mayor Scordino; we look forward to fulfilling his vision of having the Falls restored and anticipate the completion of this project in the Spring.
Mayor Adams welcomed newly appointed Trustee, Frank J. Seibert, as Deputy Mayor.
She spoke of his involvement in the Village, as a former member of the Architectural Review Board, Planning Board and the Zoning Board of Appeals, in addition to his tremendous contributions within the community through his participation in so many organizations.
Mayor Adams wished all a Happy Thanksgiving, and reminded everyone, in the words of Mayor Scordino, “to remain Babylon Village smart, wear face coverings, sanitize, and practice social distancing.”
