A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, November 12, 2019.  On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, the meeting opened at 7:15 p.m. On the motion of Trustee Adams, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:55 p.m. to discuss current litigation.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Executive Session ended at 8:10 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, the meeting adjourned at 8:10 p.m.

Regular meeting of the Board of Trustees opened at 8:14 p.m.

The Pledge of Allegiance was led by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the October 22nd, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated October 29, 2019:

At the regular monthly meeting of the Fire Council held October 22, 2019, the Fire Council took the following actions and we await your approval:

Placed on Sick Leave:

            Gilbert W. Hanse effective September 5, 2019.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that as of November 6, 2019, after completing her six-month probation period with the Greenhouse Department as a full-time employee, Cindy Angiporti receive a $1,000.00 increase in salary.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees hereby acknowledges that pursuant to Section 2019-a of the Uniform Justice Court Act, the required 2018-2019 Fiscal Year (10/1/2018 to 9/30/2019) Audit of the Justice Court of the Incorporated Village of Babylon was performed by the Certified Public Accounting firm of Skinnon and Faber on October 17, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to appoint Bruce Humenik as a Standing Hearing Officer for Civil Service Law Section 75 Disciplinary Cases with a salary of $100.00 per hour effective November 12, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried,

WHEREAS a Bid Opening was held on Thursday, October 31, 2019, for the Requirements Contract for Drainage Work,

BE IT HEREBY RESOLVED to award the bid to:

RESOLVED to set the fee for any application pursuant to Section 365 Article XIII of the Village Code, Wireless Telecommunication Towers and Facilities, at $5,000.00 effective November 12, 2019.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue refunds in the amounts indicated to the applicants listed on the attached chart for the return of ZBA sign(s) for partial refund.

RESOLVED to hold a Public Hearing on Tuesday, December 10th, 2019 at 7:00 p.m., to consider the adoption of proposed Local Law 9 of 2019 to amend Village Code, Chapter 365, Article IV, 365-13, District Regulations, Residence A-11 Districts.  Complete text of this proposed Local Law will be available beginning November 20th, 2019, through the Office of the Village Clerk and on the Village website.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to hold a Public Hearing on Tuesday, December 10th, 2019 at 7:00 p.m., to consider the adoption of proposed Local Law 10 of 2019 to amend Village Code, Chapter 365, Article IV, 365-20, Subsection A (4), Retail Business Districts.  Complete text of this proposed Local Law will be available beginning November 20th, 2019, through the Office of the Village Clerk and on the Village website.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to hold a Public Hearing on Tuesday, December 10th, 2019 at 7:00 p.m., to consider the adoption of proposed Local Law 11 of 2019 to amend Village Code, Chapter 343, Article XI, Schedules, 343-67, Stop Intersections.  Complete text of this proposed Local Law will be available beginning November 20th, 2019, through the Office of the Village Clerk and on the Village website.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #8 of 2019, pertaining to Chapter 281; Rental Property

and therefore,

BE IT RESOLVED that the Board of Trustees has determined that this action will not have an adverse impact on the environment.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, November 12, 2019,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 8 of 2019, is HEREBY ADOPTED as:

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to authorize the Mayor to execute a contract for legal services with the law firm of Tate, Grossman, Kelly, and Iaccarino, LLP, in connection with the Opioid Crisis Litigation.  The fee shall be contingent upon a recovery in this litigation.

The meeting was opened to the public; no one addressed the Board.

The meeting adjourned at 8:28 p.m.
