On the motion of Trustee Silvestri, seconded by Trustee Davida and unanimously carried, the meeting opened at 7:07 p.m. 

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to rescind the resolution to approve the adoption of Local Law 4 of 2020, to allow the public 14 days for comments.

On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, the Board entered into executive session at 7:10 p.m. to discuss current litigation. On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the executive session ended at 7:57 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, the work session ended at 7:58 p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was led by Trustee Bencivenga.

Mayor Adams began the meeting with a moment of silence in memory of Mayor Ralph A. Scordino.

On the motion of Mayor Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the minutes of the October 27, 2020 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Kerklon Beckford as a part-time highway laborer with a salary of $10.50 per hour effective August 31, 2020.

On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue refunds in the amounts indicated to the applicants listed on the attached chart for the return of ZBA sign(s) for partial refund.

On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve a petty cash allotment to the Mayor’s Office of $50.00 effective November 10, 2020.

On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the following warrant for November 10, 2020:

            General Account:                                $ 472,616.91

            Conklin House:                                   $     1,488.12

            TOTAL GENERAL FUND:               $474,105.03

Mayor Adams thanked Trustee Davida and the Fire Department for the Firematic services for Mayor Scordino and acknowledged all that Trustee Davida did to make that happen.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED to hire Anthony Pittman as a part-time highway laborer with a salary of $10.00 per hour effective September 21, 2020.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED that the Village of Babylon will hold an Election on Tuesday, March 16, 2021, for Mayor for two years to fill the unexpired term, and for two Trustees and the Village Justice, each for a term of four years.

On the motion of Trustee Silvestri, seconded by Trustee Bencivenga and unanimously carried, it was

RESOLVED, by the Board of Trustees of the Village of Babylon that Retention and Disposition Schedule for New York Local Government Records (LGS-1), issued pursuant to Article 57-A of the Arts and Cultural Affairs Law, and containing legal minimum retention periods for local government records, is hereby adopted for use by all officers in legally disposing of valueless records listed therein. 

FURTHER RESOLVED, that in accordance with Article 57-A:

(a)   only those records will be disposed of that are described in Retention and Disposition Schedule for New York Local Government Records (LGS-1), after they have met the minimum retention periods described therein;

(b)   only those records will be disposed of that do not have sufficient administrative, Fiscal, legal or historical value to merit retention beyond established legal minimum periods.

Trustee Silvestri mentioned the upcoming events at the Conklin House; November 15th - pictures with pets, November 27th - family pictures, December 3rd – the annual cookie contest, and December 4th - an open house at the Conklin House (reservations are required).  See the Conklin House Facebook page for more information.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the request of Jayne Barth to retire from the Village of Babylon effective October 31, 2020.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, it was 

RESOLVED that the Board of Trustees hereby acknowledges that pursuant to Section 2019-a of the Uniform Justice Court Act, the required 2019-2020 Fiscal Year (10/1/2019 to 9/30/2020) Audit of the Justice Court of the Incorporated Village of Babylon was performed by the Certified Public Accounting firm of Skinnon and Faber on October 23, 2020.

Trustee Bencivenga commented on the record weekend at the Golf Course, noting that it has been a welcomed refuge for so many during the pandemic.  Trustee Bencivenga also mentioned that the water will go off at the docks by mid-November. December 1st begins the winter mooring season.  Anyone needing winter mooring should contact the Village Clerk’s office.

Mayor Adams made the following announcements:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up tomorrow, Wednesday, November 11th, 2020, in observance of the Veterans’ Day Holiday.

Just a reminder - Residents should not put rubbish or recycling out to the curb on holidays.

American Legion Post 94 will be hosting a Veterans Day car parade tomorrow beginning at 10:00 a.m. at Foster Boulevard. Residents who decide to participate are asked to please practice social distancing and wear face masks.

Mayor Adams expressed a heartfelt thank you to all the Village residents and guests for their continued support and prayers during this difficult time as we continue to mourn the passing of Mayor Ralph A. Scordino. We continue with his vision and honor his legacy. Please keep his family in your thoughts and prayers.  In the words of Mayor Scordino, Mayor Adams asked that residents please continue to be “Babylon Village smart” and continue to practice social distancing, wear face masks, and sanitize.

On the motion of Trustee Bencivenga, seconded by Trustee Silvestri and unanimously carried, the meeting adjourned at 8:14 p.m.
