A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, June 23rd, 2015. On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the meeting opened at 7:50 p.m. On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, the meeting adjourned at 8:10 p.m.

Regular meeting of the Board of Trustees opened at 8:10 p.m.
The Pledge of Allegiance was lead by Trustee Amelia.
Mayor Scordino requested all to remain standing as he made the following announcement:
“It is with a great deal of sadness that I announce the untimely passing of Patrick Kevin Brosnahan, a personal friend and Special Counsel to the Village of Babylon. Kevin practiced law in our Village for more than thirty years. He was generous to so many; he was passionate as an attorney and an advocate for those he represented. He will be missed by his many clients, friends, and people he befriended and cared for over these many years.”
The Mayor requested a moment of silence in honor of Patrick Kevin Brosnahan.
On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was
RESOLVED to approve the minutes of the June 9th, 2015 regular meeting of the Board of Trustees and dispense with the reading of the same.
The Village Clerk read the letter from the Fire Council dated June 20th, 2015:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was
RESOLVED to accept the Fire Department actions as read.
On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was
RESOLVED to issue a refund in the amount of $55.00 to John O’Farrell for switching from Boat Berth #43 at Main Dock to Boat Berth #49 at Lewis Pond.
On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was
RESOLVED to grant permission to the residents of Cadman Avenue to hold a Block Party on Saturday, July 4th, 2015, from 1:00 p.m. to 11:00 p.m. The Street will be blocked between Locust Avenue and Park Avenue, subject to parking restrictions for emergency purposes.
On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was
RESOLVED to issue a pro-rated refund in the amount of $1285.00 to Ann & Raymond Nettuno for Boat Berth #9 at Main Dock which they will no longer be using.
Trustee Muldowney announced the Jr. PGA Golf Tournament to be held at the Village Golf Course on June 29th, 2015.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was
RESOLVED to grant permission to Peter Delbianco of Fairfield Properties to maintain a temporary sign, 4’ high X 20” wide, on a 9’ pole, on the property located at 163 Fire Island Avenue, to advertise “Fairfield Victorian South Luxury Rental Residences”. This permission is granted until the sign approval is granted by the ARB.
On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to make adjustments to the 2015/16 Budget as indicated:

Trustee Davida announced that the Village Pool will open for the season this Friday, June 26th at Noon, and swim lessons will begin Monday, June 29th.
On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was
RESOLVED to hire Cindy Angiporti as a part-time laborer in the greenhouse, with a salary of $8.50 per hour, effective June 16, 2015.
On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was
RESOLVED to grant permission to the residents of Mayhew Avenue to hold a Block Party on Saturday, August 8th, 2015, from 12:00 Noon to 11:00 p.m., with a rain date of Sunday, August 9th, 2015. The Street will be blocked within the limits of the Village of Babylon, with barricades at Wilson Drive and Meade Avenue, subject to parking restrictions for emergency purposes.

Trustee Amelia announced that registration for the Summer Recreation Program is under way, the last two sign-ups are tomorrow and Thursday. The basketball and tennis programs begin Monday, June 29th, and gymnastics begins on Tuesday, June 30th.

Local Law #3 of 2015 to amend Chapter 365-33 of Village Code pertaining to enforcement of Covenants & Restrictions
On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,
WHEREAS a Public Hearing was held on Tuesday, June 23, 2015, be it hereby enacted the following Local Law is HEREBY ADOPTED:
Local Law #4 of 2015 to amend Chapter 343-21 of Village Code pertaining to parking.
On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,
WHEREAS A PUBLIC HEARING WAS HELD on Tuesday, May 12th, 2015, to hear the application of Michael Sparacino to open an express café at 223 Deer Park Avenue, and WHEREAS the application was approved on May 26th, 2015,
BE IT HEREBY RESOLVED to adopt the Covenants and Restrictions for Jack Jack’s Coffee House, 223 Deer Park Avenue, as per the attached.
On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,
WHEREAS A PUBLIC HEARING WAS HELD on Tuesday, May 26th, 2015, to hear the application of The Villager Inc., to change the building façade at 262 Deer Park Avenue, and WHEREAS the application was approved on June 9th, 2015,
BE IT HEREBY RESOLVED to adopt the Covenants and Restrictions for The Villager, 262 Deer Park Avenue, as per the attached.
Mayor Scordino made the following announcements:
Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Friday, July 3, 2015, in observance of the Independence Day Holiday. Residents should not put rubbish or recycling out to the curb on holidays.
The Board of Trustees will hold a Public Hearing on Tuesday, July 14, 2015, at 7:00 p.m., to consider the adoption of Local Law #5 of 2015, which is a local law to amend the current Village Code with reference to the Flood Damage Prevention Section, 171-14 I, and to amend Zoning Article VI Section 365-26 A, to require applications for Building Permits to comply with provisions of this chapter and Chapter 171 Flood Damage Prevention.

Mr. Curtin inquired about the public hearing that was originally scheduled regarding the Local Law for Parades. Mayor Scordino explained that the Local Law was tabled for the time being, as it is to be discussed with Special Counsel.
Mr. Curtin also inquired about the Public Hearing regarding closed foundations on raised houses, which is scheduled for July 14th, 2015.
