A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, February 25, 2020.  On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:10 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:20 p.m. to discuss current litigation.  On the motion of Trustee Silvestri, seconded by Trustee Muldowney, and unanimously carried, the work session adjourned at 7:20 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Executive Session ended at 7:58 p.m.

Regular meeting of the Board of Trustees opened at 8:04 p.m.

The Pledge of Allegiance was led by Trustee Silvestri.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the February 11, 2020 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated February 22, 2020:

At the regular monthly meeting of the Fire Council held February 18, 2020, the Fire Council took the following actions and we await your approval:

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to use approximately 10 parking spaces in the Argyle Park lot during the Country Fair on September 13th, 2020, to set up a “Specialty Food Market” in the vendor section for the sale of pre-made, pre-packed specialty food items.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Park Avenue tennis courts (north and south side) from 2:30 p.m. to 6:30 p.m., beginning March 9th through June 6th, 2020, for the Varsity, Junior Varsity, and Junior High 2020 Spring Season.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to hold a Bid Opening on Thursday, March 26th, 2020, at 9:30 a.m. for the Restoration of Argyle Falls.  Bid specifications will be available in the Office of the Village Clerk, Monday through Friday, between the hours of 9:00 a.m. and 5:00 p.m., beginning March 2, 2020.

Mayor Scordino thanked Trustee Adams for all her help in coordinating the very successful Winterfest event.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to remove the Alternative Veteran Exemptions on the parcels listed for the 2019/20 Tax Year as a result of the 2019 audit of Alternative Veteran exemptions, as per the attached Assessor Petitions.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Babylon Jr.-Sr. High School to use the Softball field on the north side of Locust Avenue for Junior High Softball team practices Monday through Friday, from 3:00 p.m. to 5:30 p.m., from March 23rd through June 6th, 2020.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #1 of 2020, authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c

and therefore,

BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, February 25, 2020,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #1 of 2020, is HEREBY ADOPTED as:

Local Law 1 of 2020, authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to Save the Great South Bay to maintain temporary signs at various merchants in the Village from March 1st to March 28th, 2020, to advertise the ‘Creek Defender Clean Up’ on March 28th, 2020.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon High School Class of 2020 to host the Second Annual Color Run through the trails of Southard’s Pond on Saturday, May 16, 2020, beginning at 10:30 a.m. Babylon School Security and personnel will work the event. Babylon High School shall comply with its submissions to the Board which form the basis for this approval.  This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed and notarized hold harmless agreement.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the following warrant for February 25, 2020:

Trustee Silvestri announced that the winner of the Conklin House Dinner for Eight was Sharon Sobral.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to St. Joseph’s Church to conduct the annual ‘Stations of the Cross’ around Argyle Lake on Good Friday, April 10, 2020, between 1:00 p.m. and 3:00 p.m. This permission is granted contingent upon timely receipt of the required certificates of insurance with the Village of Babylon listed as an additional insured, as well as a signed & notarized hold harmless agreement.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to allow the Mayor to sign a contract with the State of New York to execute a FEMA Hazard Mitigation grant and a contract with Elizabeth Stuckey of 25 East Shore Drive to execute the Hazard Mitigation Grant.                                                        (#1536)

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to terminate the employment of Joseph Emmi as a part-time highway laborer effective February 10, 2020.

Trustee Muldowney commented that the Golf Course should open in approximately one month.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicant to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:          David Pentecost

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to deny a license to an applicant to drive a taxi cab in the Village of Babylon.

Mayor Scordino made the following announcements:

The Village of Babylon has requested proposals for the Food Concession at the Village Pool. Sealed proposals should be submitted to the Office of the Village Clerk by 9:30 a.m., Thursday, March 5, 2020.

The Board of Trustees will hold a public hearing on March 10, 2020 at 7:00 p.m. to consider the adoption of proposed Local Law 2 of 2020, regarding a Moratorium on 24 Hour uses in the Business District.  Complete text of this proposed Local Law will be available in the Office of the Village Clerk and on our website beginning February 27th, 2020.

Mayor Scordino noted that no one was present in the audience to address the Board.

The meeting adjourned at 8:18 p.m.
