A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, December 10, 2019.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:40 p.m. On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the Board entered into Executive Session at 7:53 p.m. to discuss current litigation.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Executive Session ended at 8:16 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Davida and unanimously carried, the meeting adjourned at 8:20 p.m.

Regular meeting of the Board of Trustees opened at 8:21 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 26, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Long Island Yacht Club to erect a seasonal tent for various events held at the Yacht Club.  The size of the tent is not to exceed the 35’ wide x 75’ long concrete pad.  This permission is granted contingent upon the Long Island Yacht Club acquiring the proper tent permit from the Building Department, to expire December 31, 2020, at a fee of $100.00.  Board of Trustee approval is required for all renewal permits.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to remove the exemption as per the attached Assessor Petition and bill the new owner the Exempt Property Restoration for the Tax Year as indicated on the attached chart.

RESOLVED to hire Peter Corso as a part-time Parking Meter Officer with a salary of $10.50 per hour, effective December 2, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the attached Fire Protection Agreement with the Town of Babylon for East Beach Fire District No. 54, for a period of three (3) years from December 31, 2019 at 12 o’clock midnight to December 31, 2022 at 12 o’clock midnight.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the attached Fire Protection Agreement with the Town of Babylon for West Beach Fire District No. 53, for a period of three (3) years from December 31, 2019 at 12 o’clock midnight to December 31, 2022 at 12 o’clock midnight.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to terminate the employment of Michael Hayden as a Sanitation Laborer effective November 28, 2019.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant the application of Thomas DelFranceso of T.D. Vending Corporation to operate a Mister Softee Ice Cream Truck in the Village of Babylon for the 2020 season.  This permission is granted contingent upon timely receipt of required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for December 10, 2019:

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Adam Ahlers as a full-time Highway Laborer with an annual salary of $29,120.00, effective November 18, 2019.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $100.00 to Michael Sparacino for Architectural Review Board Application fee for the property located at 223 Deer Park Avenue.

[The application was for temporary/seasonal signage which requires Board of Trustees approval.]

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding proposed Local Law #9 of 2019, pertaining to Chapter 365, Article IV, 365-13, Residence A-11 Districts,

and therefore,

BE IT RESOLVED that the Board of Trustees has determined that this action will not have an adverse impact on the environment.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, December 10, 2019,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law 9 of 2019, is HEREBY ADOPTED as:

Local Law 9 of 2019, amending Chapter 365, Article IV, 365-13, Residence A-11 Districts.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, January 14, 2020, to consider the application Maxine Sterlacci of The Green Fork Babylon, LLC, to increase the seating for The Green Fork, 101 Deer Park Avenue.  Copy of Application and Plans will be available in the Office of the Village Clerk beginning January 2, 2020.

The Mayor made the Following announcements:

There will be no second Board meeting in December.

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Wednesday, December 25, 2019 and Wednesday, January 1st, 2020, in observance of the Christmas and New Year’s Day Holidays.  There will be a special pick up of holiday wrappings, etc. no recycling or large items, on Thursday, December 26th for those regularly scheduled for Wednesday rubbish pickup.  Just a reminder that residents should not put rubbish or recycling out to the curb on holidays.
