A work session was held by the Board of Trustees of the Village of Babylon on TUESDAY, AUGUST 4, 2020. On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 4:13 p.m. On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the work session ended at 5:13 p.m.

The applicant, Frances Beiro, explained that in 2018 they opened as a market and were overseen by the New York State Department of Agriculture. In February of this year the Department of Agriculture came in with the Suffolk County Department of Health because NoaMar was operating more as a restaurant than a market. The Department of Health said that NoaMar needs to convert to a restaurant and will be overseen by the Department of Health. This is expected to happen as soon as the permit with the Department of Agriculture expires in October. In order to continue to operate as a restaurant, a larger grease trap needs to be installed. Mrs. Beiro wanted to get approval from the Board of Trustees before expending a large amount of money to make the necessary changes.
Mrs. Beiro stated that she will not be changing the amount of seating, which is currently 38 seats. She plans to rearrange the deli counter in front and the market area will remain. In addition to adding a sink, she intends to add an outdoor freezer on a slab. The freezer will be attached to a wall, fenced-in and locked. There will be no change to the refuse pick-up.
The current liquor license is for wine and beer, but Mrs. Beiro would like to be able to offer specialty liquor. She emphasized that she has no intention of ever being a bar, noting that her hours of operation confirm that.
The Board pointed out that the occupant load permit had expired and that an electrical underwriter certificate had never been issued because there was an open Building permit, which has also expired. Mrs. Beiro agreed to follow up with the Building Department about these issues this week.
On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was
RESOLVED to reserve decision.
