A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, August 17, 2016.  On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the meeting opened at 4:25 p.m.  On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, the meeting adjourned at 6:05 p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the August 9, 2016, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to remove the current exemption and restore full assessment to the property listed, and bill the new owner accordingly for the Tax Year as indicated.

RESOLVED to grant permission to the Post Office Café to hold the 25th Annual 5K for MPS on Saturday, October 15th, 2016.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $350.00 to Mary Zadroga for the return of Non-Resident Reserved Parking Decal # 2233.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Chamber of Commerce to hold the 2nd Annual Halloween Parade on Saturday October 29, 2016 at 12:00pm. This permission is granted contingent upon the Chamber submitting the route of the parade, and timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to hire Frank Gezzi as a part-time Highway Laborer with a salary of $10.50 per hour, effective August 22, 2016.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $25 to Mark Perlman, Principal of Main Street Theatre Partners, LLC, for partial refund for the return of one Board of Trustees sign for the property located at 34 W. Main Street.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the residents of Strong Avenue to hold a Block Party on Saturday, October 22nd, 2016, from 1:00 p.m. to 11:00 p.m., with a rain date of Sunday, October 23rd, 2016.  The street will be blocked between Deer Park Avenue and Siegel Blvd., subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Tres Palms Restaurant to hold an outdoor Oyster Fest on Sunday, October 16th, 2016, from 2:00 p.m. until 6:00 p.m.  This includes permission to allow parking in the Village Pool parking lot.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the attached fee schedule for Savik & Murray effective June 1, 2016.

Trustee Davida commented that the pool is now closed for the season, and that it was a very successful season. The new concession worked out very well with no problems reported.  He also advised information regarding STOP Day on Saturday, September 24th.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached Street Lighting agreement between the Town of Babylon and the Village of Babylon for the year June 1, 2016 through May 31, 2017.          [Rate:  $1,348.45 per month; total $16,181.35 for the year.]

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to appoint Caitlin Alfano as a member of the Architectural Review Board effective 9/13/2016 to fulfill the unexpired term of Mary Adams which is through 2018.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Breast Cancer Coalition to maintain temporary signs at various merchants throughout the Village, from September 14th to October 3rd, 2016, to advertise the ‘Fit for a Cure’ 5K Run/Walk.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $25 to David Smith for partial refund for the return of one ZBA sign for the property located at 167 Araca Road.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to transfer Patricia Duryea from Code Enforcement to the Highway Department, effective August 3, 2016.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to approve the following warrant for August 24th, 2016:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the attached contract with Mesiano Consulting for Grant Writing Services for the 2016/17 fiscal year.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the West Babylon School District to use the Sumpwams Creek Golf Course for the Junior Varsity Boys’ Golf Team season in the Fall of 2016, and the Varsity Girls’ Golf Team in the Spring of 2017.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the North Babylon School District to use the facilities at the Sumpwams Creek Golf Course for the Varsity Golf Team season, from August 22nd through October 21st, 2016.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to Babylon Little League to use the Locust Avenue ball fields on Saturday, October 22nd, 2016, (rain date October 23rd), for the Second Annual “Hits for Hunger” Clinic.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $74.65 to Alexander and Nicole Gilbert for overpayment of 2016 Taxes for the property located at 239 Fire Island Avenue, as per the Assessor Petition dated 8/19/16.      [Section 016 / Block 03 / Lot 021]

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Kristopher Fitzgerald as a part-time Highway Laborer with a salary of $10.50, effective August 18, 2016.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached Inter-municipal Shared Services Agreement with the Babylon School District.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees shall act as SEQRA Lead Agency for purpose of reviewing the application of Mark Perlman and Main Street Theatre Partners, LLC to operate a theatre and performing arts center at the premises known as SCTM# 102-14-1-11, located at 34 West Main Street, Babylon, NY.

WHEREAS, a public hearing was held by the Board of Trustees of the Incorporated Village of Babylon on August 9, 2016 regarding the application of Mark Perlman and Main Street Theatre Partners, LLC to operate a theater and performing arts center at the premises known as SCTM #102-14-1-11, located at 34 West Main Street, Babylon, New York; and

WHEREAS, the Babylon Village Board of Trustees (“Village Board”) has reviewed this application, determined all necessary public meetings were held, conducted an on site inspection of the premises, consulted with its own independent experts, reviewed the official records of the Village of Babylon and heard all the testimony presented at the public hearing regarding this application; and,

WHEREAS, the Village Board, by decision on this date has determined under SEQRA that the proposed approval will not negatively impact the environment and therefore issued a negative declaration; and

WHEREAS, the Babylon Village Planning Board (“Planning Board”) by opinions dated August 9, 2016 and August 16, 2016 has in its advisory capacity made its recommendations concerning the application; and,

WHEREAS, the Village Board has determined that a change in use will not pose any threat to the general public health, safety and welfare of the community, the proposal is in the best interest of the community given the current status of the property, potential uses for the parcel and conditions in the Village, and is the best use for the property; and,

WHEREAS, the Village Board finds the need for a theater and performing arts center in the Incorporated Village of Babylon and local area is substantial as evidenced by lack of same, the need to promote activity in the downtown Business District and the testimony at the public hearing; and,

WHEREAS, this theater and performing arts center will provide a local venue for stage plays and musicals, occasional concerts and comedy acts and children’s and other theater art classes; and,

WHEREAS, with proper restrictions the proposed use will present no additional burden on local services than the previous use as a movie theater, which use is already permitted, is one of the most progressive of development choices for the parcel and will serve as a complimentary use which will benefit the existing restaurants and retail uses in the downtown Business District; and

WHEREAS, utilities, emergency services and the road system are capable of sustaining the use.

NOW, THEREFORE, BE IT RESOLVED, that the application for allowing the use as a theater be approved subject to covenants and restrictions and conditions being agreed to by the applicant in a form acceptable to the Village Board.

RESOLVED to grant a license to the following applicants to drive a taxi cab in the Village of Babylon for Lindy’s Taxi:

Mayor Scordino made the following announcement:

The Village of Babylon, in conjunction with the Department of Environmental Control, will participate in the annual S.T.O.P. (Stop Throwing Out Pollutants) Day on Saturday, September 24th, 2016, from 9:00 a.m. to Noon, at the Village Highway truck bay on Carlston Place.

Again this year there will be a paper shredding truck, available to Village Residents, between the hours of 3:00 p.m. to 5:00 p.m.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that Ralph A. Scordino, as Mayor of the Village of Babylon is hereby authorized and directed to file an application for funds not to exceed the maximum allowable amount of thirty thousand dollars ($30,000.), and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this municipality for the Justice Court Assistance Program.

The meeting was opened to the Public:

Frank Curtin, 420 Fire Island Ave., asked about the Shared Services Agreement with the school district. Also questioned the fact the high school lot seems very full.

Mr. Perlman thanked the Board for their decision to approve the Theatre application.
