REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARD OF THE MUNICIPAL BUILDING 153 WEST MAIN STREET, BABYLON, NEW YORK ON TUESDAY

 SEPTEMBER 13, 2011

 PRESENT: Mayor Ralph Scordino

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried

 Mayor Scordino opened the work session at 7:02 p.m.

 On the motion of Trustee Kevin, seconded by Trustee Davida and unanimously carried

 Mayor Scordino adjourned the meeting at 7:55 p.m.

 The regular meeting of the Board of Trustees opened at 8:00 p.m.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: approve the minutes from the previous meeting and dispense with the reading of the same.

 Mayor Scordino made an announcement with regard to Local Law #1  dealing with  parking.  The Mayor had received several calls from residents who were confused about the law. Mayor Scordino explained that the purpose of the law is to stop residents from parking in front of their neighbor’s house because they don’t want to park in front of their own house. The law in no way restricts people from parking on the street for parties.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: increase the salary of Jeannine Finelli from $8.25 per hour to $8.50

per hour, effective September 7, 2011 having completed six months with the Village.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: approve the request of the Babylon Breast Cancer Coalition to maintain temporary signs in merchant windows from August 26th to September 26th for the 2011 Golf Skill Challenge Classic on Monday, September 26th 2011, at the Sumpwams Creek Golf Course.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: approve the request of Keely Harris to maintain temporary signs in store fronts for the Randy Zwerlein “Under the Lights” soccer games to be held on Wednesday, September 21, 2011.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: issue a refund to the following for the overpayment of taxes:

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: approve the request of Boy Scout Troop 194 to maintain temporary signs in merchant windows from November 4th to December 4th for the Spaghetti dinner to be held on December 4, 2011.

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: approve the request of Babylon Junior- Senior High School to hold the Homecoming parade and other activities planned for Wednesday, October 11th to Saturday October 15th. See attached.

 On the motion of Trustee Muldowney, seconded by Trustee Vandereveldt and unanimously carried it was

RESOLVED TO; terminate the employment of Richard Racioppi as a Highway Laborer effective August 17, 2011.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: hire Walter Burch, as a part time Sanitation Laborer, with a salary of $8.00 per hour, effective September 8, 2011.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: to change Erik Hansen from a part time Highway Laborer to a full time Highway Laborer with an annual salary of $20,800 effective August 29, 2011.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: accept a renewal agreement with the Suffolk County Department of Health Services for the provision of Corps. Ambulance Services, as per the attached, to expire December 31, 2015.

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

RESOLVED TO: to accept the resignation of Rony Berret as a Highway Laborer effective August 31, 2011.

 On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 RESOLVED TO: issue a refund in the total amount of $50.00 to the following for the return of ZBA sign(s) for a partial refund

 On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 RESOLVED TO: approve the request of the Post Office Café to maintain signs in 4 locations in the Village for the 20th annual 5K run to be held on Saturday, October 15, 2011.  See attached.

 On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 RESOLVED TO: approve the following warrant for September 13, 2011

General Fund:               $581,641.02

Conklin House Trust:  $        882.78

Golf Course Trust:        $     4,696.94

Total General Fund:      $587,220.74

 Trustee Davida announced that the 21st  S.T.O.P. Day for the Village will be on Saturday,

September 24, 2011.

 Trustee Davida thanked his staff at the pool for the great job they did this year and for the job they did preparing for hurricane Irene and the clean up.

 On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 RESOLVED, IN ACCORDANCE with the Service Road Program a portion of the following service road is conveyed to the adjacent property owner:

Part of Section  2  Block  1  Lot  98.2 adjoining 188 Cadman Ave. (Section 2  Block 1 Lot 94)

 On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 RESOLVED IN ACCORDANCE with the Service Road Program a portion of the following service road is conveyed to the adjacent property owner:

Part of Section 5  Block 2  Lot 136.14 adjoining 50 Cadman Ave.  (Section 5 Block 2 Lot 63)

 On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 RESOLVED TO: approve the request of Roomors to use their outdoor parking lot for the semi-annual “Brighton Event in a Tent” to be held on Sunday, October 2, 2011 from 10 a.m. to 4 p.m.

 On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 RESOLVED TO; approve the request of the Babylon Village Women’s Club to hold the annual Post Office Café 5K run on the morning of October 15, 2011.

 On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 RESOLVED TO: accept the resignation of Lenard Spann, as a part time Sanitation Laborer effective August 19, 2011.

 Trustee Basile announced that the Apples & Arts will be held the weekend of October 7th and 8th.  Friday night will be the Artists reception at the Conklin House with Saturday apples fair will be on the grounds of the Conklin House.  October 23rd will be the first Halloween event to be held at the Conklin House.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: extend the Moratorium on bars/restaurants that was approved at the March 22, 2011 meeting of the Board of Trustees for six (6) months.  

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: make a 2011/2012 budgetary transfer for the purchase of a new golf cart at the golf course.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried

 As per resolution naming TD Bank as a Village depository dated August 9th 2011:

 The Board of Trustees of the Village of Babylon

 RESOLVES THAT: The Bank is designated as a depository for the funds of the Governmental Unit and to provide other financial accommodations indicated in this resolution, inclusive of items 2-7 on the attached.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried

 RESOLVED: That Ralph A. Scordino, as Mayor of the Village of Babylon is hereby authorized and directed to file an application for funds not to exceed the maximum allowable amount of thirty thousand dollars ($30,000.) and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this municipality for the Justice Court Assistance program.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: issue a license to the following to drive a taxi in the Village of Babylon for Lindy’s:

 Announcements: 

 Public Hearing will be held on Tuesday, September 27th 2011 at 7:00 p.m.to hear the application of Garrison Gross to open a food establishment located at 14B Railroad Ave.

 S.T.O.P. Day is Saturday, September 24th from 9:00 a.m. to 12 noon.

 Mayor Scordino had some announcements of his own:

 Mayor Scordino reminded residents that the Babylon Beautification fair is this weekend

Sunday, September 18th.  The Mayor recognized the past President of the BBS Patricia Carley and thanked her and all the members of the BBS for the great work that they do in the Village.

 The Mayor thanked Skip and his crew along with Code Enforcement for the great job they did keeping residents safe and clearing the power lines so that LIPA and National Grid could get into those poles and get those people who lost their electric back up. Highway and Sanitation crews were also recognized for the great job they did with cleaning up after the storm.

 Mayor Scordino thanked Evelyn for the wonderful job she did with preparing the Memorial Garden for September 11th.
