A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, August 28, 2018.  On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the meeting opened at 4:01 p.m.  On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried, the meeting adjourned at 5:20 p.m.

A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, September 4, 2018.  On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 4:20 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting adjourned at 6:10 p.m.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:31 p.m. to discuss sensitive properties.

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried the Board returned to public session at 8:07 p.m. and the meeting adjourned.

Regular meeting of the Board of Trustees opened at 8:14 p.m.

The Pledge of Allegiance was led by Trustee Silvestri.

The Mayor began the meeting with a moment of silence to acknowledge the 17th anniversary of the attack on the World Trade Center and the members of our community that we lost. Thoughts and prayers were extended to the families who lost loved ones.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the August 14, 2018 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Deputy Clerk read the letter from the Fire Department dated August 23, 2018:

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to change Jeffrey Weber from a part-time employee in the Treasurer’s Office to a full-time employee with an annual salary of $32,760.00 effective September 17, 2018.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the resignation of Michael Merkle as a Highway Laborer effective August 21, 2018.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to make the assessment change to the 2018/19 Roll as per the attached Assessor Petition.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to restore the Veteran Combat exemption in the name of Mansoor Khan on the property located at 73 Cameron Lane as per the attached Assessor Petitions [008-03-048].

ALSO RESOLVED to void the Exempt Property Restoration charges for the 2017/18 and 2018/19 Tax years for the property located at 73 Cameron Lane [008-03-048]. 

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to accept the attached Street Lighting Agreement between the Town of Babylon and the Village of Babylon for the year June 1, 2018 through May 31, 2019.

[Rate $1,348.45 per month; total $16,181.35 for the year.]

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the Other Home & Community revenue account, A2189, by $17,500 with the anticipated revenue of a Suffolk County Parks, Recreation & Conservation Grant, and increase the expenditure line, A7450.403L, Livingston Center, by $17,500 to make museum improvements.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the revenue account A1710, Public Works Service, by $76,651.13 with the anticipated revenue for reimbursement from The Suffolk County Water Authority for road repairs, and increase the expense account A5110.408, Road Oils & Materials by $76,651.13 to make improvements to roads and parking lots.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to increase the annual salary of Erik Alloy $1,000.00 effective as of June 26, 2018 having completed his probationary period.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the United Methodist Church, 21 James Street, to maintain a 3’x 6’ temporary sign on the fence facing Deer Park Avenue from October 30th to November 25th, 2018, to advertise the James Street Players’ November performances.

Trustee Adams commented that the Babylon Beautification Society Fair will be held this Sunday, September 16th from 9:00 a.m. to 5:00 p.m.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of John Campanelli as a Sanitation Laborer effective August 7, 2018.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $631.89 to Alice Cromarty for overpayment of 2018/19 Taxes on the property located at 13 Lewis Circle.    [Section 016 / Block 04 / Lot 031]

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, August 14th, 2018, to consider the application of Francine Pascone of Bunz, LLC, to open a bakery at 14-A Railroad Avenue, and

WHEREAS the application was approved at the regular meeting of the Board of Trustees held August 14th, 2018, subject to Covenants & Restrictions to follow,

BE IT HEREBY RESOLVED to approve and adopt the attached Covenants & Restrictions for Bunz LLC, 14-A Railroad Avenue.   [Section 010 / Block 01 / Lots 017 & 019]

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached Temporary License Agreement with Tres Palms, pertaining to Employee Parking at the Village Pool for the period July 1, 2018 to June 30, 2019.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the following warrant for September 11, 2018:

RESOLVED to issue a refund in the amount of $567.34 to Matthew Price for overpayment of 2018/19 Taxes on the property located at 12 Shore Road.  [Section 014 / Block 03 / Lot 025]

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $375.00 to John Scharf for subletting his boat slip #4070 on East Creek for the remainder of the 2018 season.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $235.00 to John Zezeski for subletting his boat slip #5047 at Lewis Pond for the remainder of the 2018 season.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the resignation of James Cooper as a Sanitation Laborer effective August 7, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Michael K. Adrien as a part-time Sanitation Laborer with a salary of $10.00 per hour effective September 4, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Roy Anderson as a part-time Sanitation Laborer with a salary of $10.50 per hour effective September 4, 2018.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED, in accordance with the Declared Surplus and Service Road Program, a portion of the following service road, dimensions approximately 7’x75’, is conveyed to the adjacent property owner for the sum of $75.00 plus the cost to the Village of preparing the transfer documents:

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to hire Andrew Reichel as Treasurer for the Village of Babylon with an annual salary of $85,000.00 effective September 5, 2018.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS; the property at 53 Melbury Road, Babylon, NY, has not been occupied by the owner of record, and has not been maintained by the owner of record and

WHEREAS; a boat has been placed on the property in violation of Village Code and the property is unkept and overgrown, and accordingly represents a public nuisance and

WHEREAS; the Village Building Department has reported these conditions represent a nuisance in violation of Village Code, and

WHEREAS; the property owners of record shall be notified of this violation and directed to cure this violation by September 21, 2018;

BE IT RESOLVED that pursuant to Village Code Section 237-2, the Village of Babylon is authorized to remove the boat and remove the offending condition after September 22, 2018 and assess the costs on the premises tax bill.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to add a special assessment to the real property located at 306 Livingston Avenue, Babylon, New York, Suffolk County Tax Map District 102, Section 001, Block 01, Lot 010 of the actual costs to remediate a nuisance condition at that address, plus a $200.00 administrative charge.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that Ralph A. Scordino, as Mayor of the Village of Babylon is hereby authorized and directed to file an application for funds not to exceed the maximum allowable amount of thirty thousand dollars ($30,000), and upon approval of said request to enter into and execute a project agreement with the New York State Unified Court System for such financial assistance to this municipality for the Justice Court Assistance Program.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Lindy’s Taxi in the Village of Babylon:

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicants to drive a taxi cab for Sunset Taxi in the Village of Babylon:          John Seeley

Mayor Scordino made the following announcements:

-          The Babylon Fire Department will be hosting the 2018 Town of Babylon Parade on Saturday evening, September 15, 2018.  The parade will use the traditional Memorial Day Parade route, ending at the Fire Department on North Carll Avenue, and will be followed by a Block Party.  The parade route will be closed to vehicle traffic beginning at 6:00 p.m.; Carlston Place and North Carll Avenue (from Montauk Highway to Railroad Avenue) will be closed from 6:00 p.m. to Midnight.

-          Residents are invited to an informal Village meeting Saturday, September 15th, 2018, from 10:00 a.m. to Noon, for “Coffee and Conversation with the Mayor” to share and discuss any questions or concerns regarding the Village.

-          The Chamber of Commerce will be holding the second Family Fun Block Party Event in the Village on Thursday, September 20th, 2018, from 5:00 p.m. to 9:00 pm.  The following streets will be closed from 4:00 p.m. to 10:00 p.m.: 

        Deer Park Avenue from Railroad Avenue to Main Street

        Fire Island Avenue from Main Street to the South entrance of the 

        Carriage House parking lot.

-          The Village will hold the 27th annual “Stop Throwing Out Pollutants Day” on Saturday, September 22nd, 2018, from 9:00 a.m. to Noon, at the Village Highway Truck Bay on Carlston Place.  On the same day, the Village will host our annual “Shred Day” from 2:00 p.m. to 5:00 p.m., also at the Village Truck Bay on Carlston Place.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $62.71 to the Kamilaris Family Trust for overpayment of 2018/19 Taxes on the property located at 136 Lucinda Drive.
