Public Hearing Sept. 26, 2017- Local Law #10 of 2017 & Long Island Beach Bowls

A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, September 19th, 2017.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 4:10 p.m.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting adjourned at 6:00 p.m.

The meeting opened at 7:00 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

The Village Clerk read the legal notice:

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, September 26th, 2017, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #10 of the year 2017, amending Chapter 343 pertaining to Parking in the vicinity of Fire Island Avenue south of Merman Place, Nereid Place and East Court.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

The Board explained that this proposed Local Law was a step in the right direction; it is a starting point to limit street parking in the residential areas around Tres Palms restaurant by designating ‘no parking’ areas from 6:00 pm to 6:00 a.m.  Special parking permits and guest passes will have to be issued to residents in these areas to avoid summonses.  The Board reiterated that this is a ‘work-in-progress’ and there has to be a compromise, as street parking in these areas cannot be completely eliminated.

The meeting was opened to the public; the following residents approached the Board:

            Haydee Trager, 11 East Court

            Vincent Burns, 11 Nereid Place

            Ellie & Joseph Rubino, 630 Fire Island Avenue

            Natalie Mendolia, 7 East Court

These residents spoke in favor of limiting parking, but requested that the ‘no-parking’ time be extended, possibly starting at 3p.m., Noon, or even 10:00 a.m.

Other suggestions included:  

-         signs indicating ‘Resident Parking Only’ or ‘Parking by Special Permit Only’;

-         allowing restaurant customers to use the Village Pool parking lot;

-         requiring Tres Palms to valet park in the Village Pool parking lot;

-         increased enforcement of Fire code violations

Attorney Sikowitz explained that any modifications to this Local Law as proposed will require a new Public Hearing.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, September 26th, 2017, at 7:00 p.m. or as soon thereafter as can be heard, to consider the application of Sal Cataldo for approval to open Long Island Beach Bowls, an Acai Fruit Bowl Café, at 14B Railroad Avenue.

Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10am and 4pm Monday through Friday.

All interested persons should appear at the above time and place and they will be given the opportunity to be heard.  All applicants and their duly appointed representatives must appear in person at the above hearing.

Mr. Cataldo explained that he has already gone to the Planning Board.  The only ‘snag’ to date has been with Suffolk County Sewer District regarding the grease trap, which is holding up the permit from the Board of Health.

He mentioned his other locations of Long Island Beach Bowls, but indicated that this is not a franchise.  This is primarily a take-out business (approximately 80% to 90% take-out). There will be a maximum of 18 seats, there will be no live music, and no alcohol will be served or sold.  The hours will be from 8:00 a.m. to 9:00 p.m., with three to four employees per shift.

When questioned about the dumpster, Mike Delucca, representing the owner of the Building, stated that there is a seven or eight-car parking lot in the back of the building which he believes has plenty of room for a dumpster.  The Board clarified that Mr. Cataldo would be responsible for maintaining the dumpster.

The meeting was opened to the public; no one spoke for or against this application.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.
