Public Hearing May 22, 2018; Local Law 2 of 2018- Restaurant Moratorium

PUBLIC HEARING WAS HELD IN THE BOARD ROOM,

153 WEST MAIN STREET, BABYLON, NEW YORK,

ON TUESDAY,

MAY 22, 2018

PRESENT:

Trustee Kevin Muldowney

Trustee Debbie Basile

Trustee Tony Davida

Trustee Mary Adams

Attorney Gerard Glass

The meeting opened at 7:05 p.m.

The Pledge of Allegiance was led by Trustee Davida.

The Deputy Clerk read the legal notice:

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, May 22, 2018, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #2 of the year 2018, confirming a restaurant moratorium.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Attorney Gerard Glass explained that this Local Law aims to refine the previously adopted moratorium and ‘loosen up’ the restrictions in order to allow certain uses.  It will provide the ability for smaller places to open, where the primary focus of is the business is not for sit-down restaurant use.  (ie., Businesses that are primarily retail with food sales and the ancillary use of tables.)

Even though this is a clarification of the existing restaurant moratorium, the expiration date of the moratorium stays the same.

The Board agreed that this Local Law will provide the flexibility that the moratorium needs.

It was noted that no one was present (other than Carolyn James of The Beacon) to address the Board with any comments or concerns.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

The meeting adjourned at 7:13 p.m.
