PUBLIC HEARING WAS HELD IN THE BOARDROOM

153 WEST MAIN STREET, BABYLON, NEW YORK ON TUESDAY,

FEBRUARY 28, 2017

PRESENT:

Trustee Kevin Muldowney

Meeting opened at 7:00 p.m.

The Pledge of Allegiance was led by Trustee Basile.

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 28, 2017, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of the following Local Laws:

Local Law #1 of the year 2017, authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Local Law #2 of the year 2017, amending current Village Code 365-12A, regarding first floor requirements.

Local Law #3 of the year 2017, pertaining to Outdoor Fire Pits and Chimineas

Complete texts of the above Local Laws are available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Proposed Local Law #1 of 2017 is to authorize a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Mayor Scordino read the text of proposed Local Law #1 of 2017 and commented that the Village has been passing this Local Law for the past 4 years.  Attorney Joel Sikowitz explained that this Local Law will allow the Village to pierce the tax cap only if necessary; he also clarified that the tax cap is actually much lower than 2%.

The meeting was opened to the public; no one addressed the Board.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

Proposed Local Law #2 of 2017 is to amend Chapter 365-12A regarding first floor requirements.  Attorney Sikowitz explained that removing this section from the code allows the Building Inspector to determine the starting point for building.

The meeting was opened to the public; no one addressed the Board.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

Proposed Local Law #3 of 2017 pertains to portable outdoor fireplaces. Attorney Sikowitz explained that this Local Law is being advocated by the Fire Chief and the Building Inspector to move open Fire pits 30’ away from structures or combustible materials for safety purposes.

The meeting was opened to the public; no one addressed the Board.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the meeting was adjourned at 7:10 p.m.
