Public Hearing February 26, 2019 - Local Laws 3 & 4 of 2019

PUBLIC HEARING WAS HELD IN THE BOARD ROOM,

153 WEST MAIN STREET, BABYLON, NEW YORK,

ON TUESDAY,

FEBRUARY 26, 2019

The meeting opened at 7:01 p.m.

The Pledge of Allegiance was led by Trustee Muldowney.

The Village Clerk read the legal notice:

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 26, 2019, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #3 of the year 2019, to amend Chapter 336 Trees by deleting Article II and adding Sections 336-1 through 336-7.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Trustee Adams explained that the purpose of this proposed Local Law is to establish the Village of Babylon as a “Tree City USA”.  Having this Tree Ordinance in place is a stipulation of being designated as a “Tree City”.  Once this is adopted, the Village can apply for grants which can be used for the Arbor Day Celebration being held on April 27th, 2019, by the Bayman Statue.  The Village, along with the Beautification Society, will hold the Arbor Day Celebration; the Babylon Library will participate as well. Two trees will be planted by the statue in honor of Isabella Gallagher, the founder of the Babylon Beautification Society. 

Trustee Adams commented that being designated as a “Tree City USA” helps home values and businesses overall.  The Mayor spoke about the Village’s tree planting program and commented that approximately 35 trees have been planted this year, adding value to our community. Going forward, the Babylon Beautification Society will be responsible for tree planting as part of the downtown revitalization of the Railroad Business District.

No one spoke in opposition to this proposed Local Law.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to reserve decision.

The Village Clerk read the legal notice:

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 26, 2019, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #4 of the year 2019, authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Attorney Gerard Glass explained that this proposed Local Law is a pro forma Local Law that the Village adopts each year; it is a “hope for the best, plan for the worst” law, which allows the Village, if necessary, to pierce the tax cap.  This is a means to prepare for any unforeseen contingency and is a ‘safety net’ to avoid the potentially dire ramifications if we happen to exceed the Tax Cap.

The Mayor and Attorney Glass both reiterated that the tax rate has had a 0% increase for the past four (4) years.
