PUBLIC HEARING WAS HELD IN THE BOARDROOM

153 WEST MAIN STREET, BABYLON, NEW YORK ON TUESDAY,

Meeting opened at 7:03 p.m.

The Pledge of Allegiance was led by Trustee Davida.

The Village Clerk read the Legal Notice:

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 23, 2016, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #1 of the year 2016, which is a Local Law authorizing a property tax levy increase in excess of the limit established in General Municipal Law §3-c.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

The Board explained that with the tax cap set at .12% for the 2016/17 Tax Year, it may be very difficult to stay within the limit, especially with all the mandated increases in expenses.  The purpose of this Local Law is to ensure that the Village isn’t penalized with heavy fines if the tax rate exceeds the .12% cap.  If the Village does not exceed the cap, then this law would be repealed, as was the case last year.

No one spoke in favor of this proposed Local Law.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

The Village Clerk read the legal for Local Law #2 through Local Law #4 of 2016:

PLEASE TAKE NOTICE that Public Hearings will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 23, 2016 at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Laws #2, 3 & 4 of the year 2016, which are Local Laws to amend the current Village Code Chapters shown below:

            Local Law #2   Chapter 343-33 pertaining to boat storage in front yard

            Local Law #3   Chapter 210 pertaining to Landscapers

            Local Law #4   Chapter 295 pertaining to Hoverboards

Complete texts of the above Local Laws are available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Proposed Local Law #2 is to amend Chapter 343-33 D (2) of current Village Code to state, “There must be at least one clear side yard of 10 feet remaining, and the boat must not be placed within the front yard”. 

This law clarifies that boats are not to be stored in the front yard, as opposed to not being stored within the front yard setback, which varies with the different property zones.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

Proposed Local Law #3 is to amend Chapter 210 of current Village Code pertaining to Landscapers;

The Board explained that this law is being amended in an effort to prevent fertilizers and lawn treatment substances from being left on sidewalks, driveways, curbs, and streets, which would eventually run off into catch basins and ultimately, the Great South Bay.  One of the ongoing efforts of the Village to “go green”, this law will help to limit nitrogen from lawn substances from polluting our waterways.

The meeting was opened to the public; no one addressed the Board.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.

Proposed Local Law #4 is to amend Chapter 295 of current Village Code pertaining to Hoverboards and any motorized personal transport device;

The Board explained the necessity of amending this code; it will now include vehicles, such as hoverboards and motorized personal transport devices, which were not in existence when the original law was passed.  This Local Law also details the expanded areas where these devices are restricted from use.

The meeting was opened to the public; no one addressed the Board.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to reserve decision.
