Public Hearing February 12, 2019; 96 E Main & Proposed Local Law 2 of 2019

A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, January 29, 2019.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 4:08 p.m.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, February 12th, 2019, to consider the adoption of Local Law #2 of 2019, to amend Chapter 365, Article IV, Section 20, Subsection C, Retail Business Districts, pertaining to building height requirements on Railroad Avenue and Depot Place, between Deer Park Avenue and North Carll Avenue.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the work session closed at 4:15 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Adams and unanimously carried, the Board entered into Executive Session at 4:16 p.m. to discuss sensitive properties.  On the motion of Trustee Adams, seconded by Trustee Muldowney and unanimously carried the Executive Session closed at 5:00 p.m. and the meeting adjourned.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, the meeting opened at 4:10 p.m.  On the motion of Trustee Davida, seconded by Trustee Silvestri and unanimously carried the meeting adjourned at 5:40 p.m.

The Pledge of Allegiance was led by Trustee Silvestri.

The Village Clerk read the legal notice:

NOTICE IS HEREBY GIVEN that the Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, February 12, 2019, at 7:00 p.m. or as soon thereafter as can be heard to consider the application of Jason Lee of Long Island Pekin, to open a restaurant at 96 East Main St., the former location of N’Joy.

Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10am and 4pm Monday through Friday.

All interested persons should appear at the above time and place and they will be given the opportunity to be heard.  All applicants and their duly appointed representatives must appear in person at the above hearing.

Mr. Lee addressed the Board; he explained his 17 years in the restaurant business and discussed his plans to open his 13th restaurant, a traditional Pekin Duck & Pork Dumpling Restaurant at 96 East Main Street. His plans include removing the sushi bar, moving the hostess stand and extending the bar to accommodate 8 seats, with televisions at each end of the bar.  Dinner service is available all week with lunch service also available on Saturday and Sunday; take-out service only during the daytime hours Monday through Friday.

Attorney Gerard Glass clarified that the hours of 11:00 a.m. to 10:30 p.m., Sunday through Saturday, encompasses the overall hours of operation.  The Board commented that the bar use should be in connection with food service, the dumpster should be maintained as outlined in the Planning Board letter, and any music would be background music only.

The meeting was opened to the public; no one spoke for or against this application.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to reserve decision.

PLEASE TAKE NOTICE that a Public Hearing will be held at the Municipal Building, 153 West Main Street, Babylon, NY, on Tuesday, February 12th, 2019, at 7:00 p.m., or as soon thereafter as can be heard to consider the adoption of Local Law #2 of the year 2019, a Local Law to amend Village code, Chapter 365 Article IV, Section 20, Subsection C, Retail Business District, pertaining to building height requirements on Railroad Avenue and Depot Place, between Deer Park Avenue and North Carll Avenue.

Complete text of the above Local Law is available in the office of the Village Clerk.

All interested persons should appear at the above time and place, and they will be given an opportunity to be heard.

Attorney Gerard Glass explained that this proposed Local Law was to amend Chapter 365, Retail Business District, specifically the Railroad District.  In an ongoing effort to revitalize the Business District, the Village wants to encourage development and attract entrepreneurship to this area.  The intention is to ‘spruce up’ the area; provide additional housing opportunities with apartments above retail and remove the one 1st floor apartment that currently exists.  The Babylon Beautification Society is also making a proposal to revitalize and beautify this area.

The meeting was opened to the public;
