REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM OF THE MUNICIPAL BUILDING153 WEST MAIN STREET, BABYLON NEW YORK ON TUESDAY,

 

OCTOBER 9, 2012

PRESENT: Mayor Ralph Scordino

Trustee: Kevin Muldowney

Trustee: Alice Vanderveldt

Trustee: Debbie Basile

Trustee: Tony Davida

Attorney: Joel Sikowitz

 

On the motion of Trustee Davida seconded by Trustee Basile and unanimously carried

 

Mayor Scordino opened the meeting at 7:10 p.m.  

 

On the motion of Trustee Muldowney seconded by Trustee Vanderveldt and unanimously carried

 

Mayor Scordino adjourned the meeting at 8:00 p.m.

 

Regular meeting was opened at 8:06 p.m.

 

The Pledge of Allegiance was lead by Trustee Vanderveldt

 

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the minutes of the previous meeting and dispense with the reading of the same.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED, That pursuant to New York State General Municipal Law section 104 (b), Mayor RALPH SCORDINO, the TRUSTEES, PATRICIA C. CARLEY, Village Clerk,

IRENE IVANOFF, Acting Court Clerk, CHARLES GARDNER, Superintendent of Public Works, SUZANNE SCHETTINO, DEBORAH LONGO, TIMOTHY SHELLHORSE, and PAUL TWARDY and MICHAEL SASUK, of the Babylon Village Fire Department are responsible for purchasing.

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: make the following budget transfers to allow for cost of new roof for parks building:

Parks Equipment:  increase budget line A7110.200  $8,100.00

Contingency Line:  decrease budget line A199040 <$8100.00>

 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the following warrant for October 9, 2012

 

General Account:

$212,225.74

Conklin House:

$       277.95

Golf Course Account:

$    1,331.00

Total General Fund:

$213,834.69

Trust Fund:

$       657.05

Total:

$214,491.74

 

 

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 

RESOLVED TO: to terminate the employment of Sean Daniel, as a full time Sanitation Laborer, effective September 24, 2012 for failure to report to work.

 

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried

 

WHEREAS: A Bid Opening was held on Thursday, September 6, 2012 for Contract No. 2 Geometrical and Solar Panel Contract

 

BE IT HEREBY RESOLVED: to award the Bid to Sunation Solar Systems as they were the lowest, responsible bidder with a bid of $84,317.00.

 

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 

RESOLVED in accordance with Chapter A39-4 (D) of the Babylon Village Code, boat berth at #40 Main Dock, is hereby revoked, and will not be renewed for the 2013 boat season.  Boat can remain in the berth until the close of the 2012 season. 

Boat owner will be notified by mail in accordance with Chapter A39-10.

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 

RESOLVED TO: grant permission to Herb Hemindinger to post temporary signs on his property located at 48, 51, and 56 Shore Rd., from October 9th 2012 to November 6th 2012.  See attached

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 

RESOLVED TO: grant permission to Herbert Hemindinger to post temporary signs at various locations from October 9th 2012 to November 6th 2012.  See attached.

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

 

RESOLVED that the Board of Trustees as listed below, constitute the Trustee of the “Service Agreement” and are authorized signers for the aforementioned Service Award Trust

Deborah Basile

 

AGREEMENT: by your signature you agree that the account is governed by our Commercial Deposit Account Agreement.  All items defined in that agreements apply.

You acknowledge receipt of that agreement, the fee schedule the disclosure about your ability to withdraw funds, the disclosure and fee schedule for electronic fund transfers (if contracted) and any addenda to those documents.  You have read and agreed to the documents.

 

RESOLVED, that the Trustees of the “Service Award Trust” authorizes Empire National Bank to draw periodic checks to pay the entitlement award eligible participants as listed on the attached schedule.  These payments will not change and will continue until instructed otherwise by the Trustees.

 

RESOLVED, that the checks will be drawn for an Empire National bank central check issue account which will be funded, as acquired through a charge to “ Service Award Trust”  account maintained at Empire National Bank.

 

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried

 

WHEREAS A PUBLIC HEARING WAS HELD ON Tuesday, September 25, 2012

 

BE IT HEREBY enacted that Local Law #3 of the year 2012 be adopted.

 

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO: accept the amended Covenants and Restrictions for Matheis Land Development LLC property located at THE SOUTHEAST CORNER OF Park Ave. and North Carll Ave. in the Village of Babylon.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 

RESOLVED TO: grant permission to the Babylon Beautification Society, to use the garage for the following events:

Saturday, November 24th to cut up the greenery in the morning.

Sunday, November 25th to distribute decorations for the lamppost decorating.

 

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

 

RESOLVED TO: grant permission to the Babylon Beautification Society, to use the front porch of the Conklin House to hand out hot chocolate after lamppost decorating.

 

Trustee Basile announced that Friday, October 20th will be the Artists Reception at the Conklin House, the Apple Festival will be on Saturday and the Conklin House will be

open on Sunday to view the art.

Trustee Basil also announced that Karen Petz will receive the Conklin House award this year.  

 

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously

carried it was

 

RESOLVED TO: approve the following applicants a license to drive a taxi cab in the Village of Babylon for Sunset

Leone R. Fedele

Brian Burke

 

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 

RESOLVED TO: approve the following applicant a license to drive a taxi cab in the Village of Babylon for Lindy’s

Paul Delmonico
