A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, October 10, 2017.  On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried, the meeting opened at 7:15 p.m.  On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the meeting adjourned at 8:05 p.m.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM,

Regular meeting of the Board of Trustees opened at 8:06 p.m.

The Pledge of Allegiance was led by Trustee Davida.

Mayor Scordino expressed his appreciation and presented letters of Commendation to three Village Code Enforcement Officers, Raymond Peterson, Alexander Weber, and Vincent Weiss.  The Mayor read a memo explaining how their efforts and assistance this past July helped the Suffolk County Police Department in the recovery of a stolen school bus and the arrest of the offending drunken driver.  (See attachments book for copy of memo and letters of commendation.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the September 26th, 2017, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED, that pursuant to New York State General Municipal Law section 104(b), Mayor Ralph Scordino, the Trustees, Patricia Carley, Village Clerk, Irene Ivanoff, Court Clerk, Charles Gardner, Superintendent of Public Works, Suzanne Schettino, Deborah Longo, Thomas Steffann,  and  Scott Glenn and Michael Golub of the Babylon Village Fire Department, are responsible for purchasing.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $50.00 to Glass & Glass (representing Conor Hartnett) for the return of one Board of Trustees Public Hearing sign for partial refund.     [Property: Mary Carroll's, 121 Deer Park Ave.]

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, September 26, 2017,

BE IT HEREBY RESOLVED to approve the application of Sal Cataldo to open Long Island Beach Bowls, an Acai Fruit Bowl & Smoothie Café, at 14B Railroad Avenue.

ALSO BE IT RESOLVED to approve and adopt the attached Covenants & Restrictions for Long Island Beach Bowls, 14B Railroad Avenue [Section 10 / Block 1 / Lots 17 & 19].

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund to Alice Cromarty in the amount of $25.00 for overpayment of taxes on 13 Lewis Circle.    [Section 16 / Block 4 / Lot 31]

Trustee Basile announced that the Conklin House will be hosting the annual Apples and Art festival the weekend of October 20th to 22nd, the same weekend as the Chamber of Commerce Street Fair.  Artwork from local artists will be on display at the Conklin House on Friday, from 7:00pm to 9:00pm (during the Artists reception); Saturday, from 11:00 a.m. to 4:00 p.m., and Sunday, from 12 Noon to 3:00 p.m.  On Saturday, the Apple Festival will be held on the lawn of the Conklin House.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the New York Youth Club to fundraise in the Village of Babylon on Saturday, October 14th, and Sunday, October 15th, 2017, with the following conditions:   

                        - Fundraising activities may be conducted from Noon until 4:00 p.m.

- All Volunteers must wear L.I. Youth Club identification badges at all times.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to terminate the employment of Derrick Quill as a part-time Sanitation Laborer effective September 26, 2017.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to approve the following warrant for October 10th, 2017:

General Account:                     $ 232,208.42

Conklin House:                         $         111.20

TOTAL GENERAL FUND:    $ 232,319.62

Trust Fund:                              $     2,215.73

TOTAL:                               $ 234,535.35

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED that the Village establish a Safe Harbor standard measurement period of one year for a new, variable hour employee.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED that the Village has established a Safe Harbor standard measurement period of one year, from October 1st to September 30th, for the purpose of determining on-going variable hour employees.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the resignation of Tajuan Crum as a Sanitation Laborer effective September 22, 2017.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the West Islip School District to use the Sumpwams Creek Golf Course for the Boys’ and Girls’ Golf Teams during the Fall 2017 and Spring 2018 Seasons.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to amend the Covenants and Restrictions dated June 4, 2015, for Jack Jack’s Coffee House, 223 Deer Park Ave., and remove the requirement for the parking lot to be paved and striped.   [Section 10 / Block 2 / Lot 39]

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicant to drive a taxi cab for Sunset Taxi in the Village of Babylon:

Mayor Scordino made the following announcement:

The Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, October 24, 2017, at 7:00 p.m. to consider the following:

-         Proposed Local Law #10 of 2017, to amend Chapter 343 of Village Code, regarding parking restrictions in the vicinity of Fire Island Ave. south of Merman Place, Nereid Place, and East Court.

Complete text of this proposed Local Law will be available in the Office of the Village Clerk, beginning October 12th, 2017, Monday through Friday, between the hours of 10:00 a.m. and 4:00 p.m.

The meeting was opened to the public:

Frank Curtin, 420 Fire Island Avenue, asked about the upcoming Public Hearing for the Local Law regarding parking restrictions

Dennis Stefanak, 48 Edward Avenue, inquired about check valves for storm drains and the grants other municipalities were getting to install these valves

Meeting adjourned 8:25 p.m.
