A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, November 28, 2017.  On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the meeting opened at 7:10 p.m.  On the motion of Trustee Basile, seconded by Trustee Adams and unanimously carried, the meeting adjourned at 7:55 p.m.

Regular meeting of the Board of Trustees opened at 8:05 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 14th, 2017, regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated November 26, 2017:

At the regular monthly meeting of the Fire Council held November 21, 2017, the Fire Council took the following actions and we await your approval:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the Fire Departments actions as read.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to re-appoint Lynn Dunlop to the Architectural Review Board for a three year term which will be through November, 2020.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to extend the appointment of Robert Waters to the Planning Board through November 2017; and

ALSO RESOLVED to re-appoint Robert Waters to the Planning Board for a five year term which will be through November 2022.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to re-appoint Judy Skillen to the Planning Board for a five year term which will be through November 2022.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to re-appoint Mary Lou Bartsch to the Architectural Review Board for a three year term which will be through November, 2020.

Trustee Basile announced the upcoming holiday events at the Conklin House; Thursday, November 30th, is the annual Cookie Contest; Friday night, December 1st, during the Old Fashioned Night of Shopping, there will be tours of the decorated rooms of the Conklin House between 6:00 p.m. and 9:00 p.m., and Holiday photos can be taken Sunday, December 3rd, between 1:00p.m. and 4:00p.m.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $100.00 to MM Sign and Awning for an Architectural Review Board Application fee that was paid in error, as the property is not in the Village of Babylon. [Property address:  661 Deer Park Ave.]

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to appoint Jeanette Yantz as Secretary to the Architectural Review Board replacing Jean Parker, with an annual salary of $1,000.00, effective December 4, 2017.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to correct the Warrant of November 14, 2017, and increase the General Fund by .33.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to approve the following warrant for November 28th, 2017:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $250.00 to Steven Ramirez for 2017-18 Winter Mooring.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Jeanette Yantz as a full-time clerk typist in the Building Department with an annual salary of $29,120.00 effective November 13, 2017.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 27th, 2017, to hear the application of Brooke Jankow for approval for changes made to Swell Taco, 135 Deer Park Ave,

and

WHEREAS the application for the outdoor expansion was approved at the regular meeting of the Board of Trustees on November 14, 2017, subject to Covenants & Restrictions to follow,

BE IT HEREBY RESOLVED to accept and adopt the amended Covenants & Restrictions for Swell Taco, 135 Deer Park Avenue, as per the attached.

Trustee Muldowney announced that boats and lines must be removed from Village berths by December 1st.  He reminded everyone to be sure to remove the lines as well, as these interfere with ice breaking efforts; summonses will be issued if lines are left on poles.  Trustee Muldowney also commented that winter mooring is available; anyone interested in winter mooring should inquire at the Village Clerk’s Office.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the Annual Financial Report Update Document for the Village of Babylon for the Fiscal Year Ended May 31, 2017.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS A Public Hearing was held on Tuesday, November 14th, 2017,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #11 of 2017, is HEREBY ADOPTED as:

Local Law 11 of 2017, amending Chapter 343-1-3 A; pertaining to Traffic Offenses

Mayor Scordino made the following announcements:

-           Please be advised that the December meeting of the Board of Trustees will be held on Wednesday, December 13, 2017 in the Upstairs Conference Room.

-           The Board of Trustees of the Village of Babylon will hold a Public Hearing on Wednesday, December 13, 2017, at 7:00 p.m. to consider the following:

Application of Richard Bedrosian of New York Burger Bar to open a Burger Bar Restaurant at 1 West Main Street, the current location of 1 Main Restaurant. Copy of application and plans may be examined at the Office of the Village Clerk, Monday through Friday, between the hours of 10:00 a.m. and 4:00 p.m.

-           There will be no second board meeting in December.

Mayor Scordino thanked the Babylon Beautification Society for all the work involved with the Holiday decorations for the lamp post decorating and expressed appreciation for how beautiful the Village looks decorated for the season. He commented on all the upcoming Holiday events in the Village, starting this Friday night, December 1st, with the Chamber of Commerce Old Fashioned Night of Shopping, the tours of the Conklin House and the pictures with Santa on Sunday; the tree lighting at Argyle Park on Sunday, as well as the Wassail Bowl and annual Boy Scout Spaghetti Dinner.  He also thanked Carolyn James of the Beacon for covering these exciting events in the Beacon.

The meeting was opened to the public;

Frank Curtin, 420 Fire Island Avenue; inquired about Local Law 12 of 2017 regarding requirements for rental inspections and winter mooring. 

[The Mayor explained that the State requires us to allow outside private inspectors as well as Village inspectors to perform inspections of residential rental properties; Trustee Muldowney clarified that winter mooring is available at East Creek and in certain circumstances, at Argyle Boat Basin.]

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, the Meeting adjourned at 8:23 p.m.
