A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, November 27, 2018. On the motion of Trustee Silvestri, seconded by Trustee Davida and unanimously carried, the meeting opened at 7:55 p.m.  On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried the meeting adjourned at 8:05 p.m.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARD ROOM,

Regular meeting of the Board of Trustees opened at 8:15 p.m.

The Pledge of Allegiance was led by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the November 13th, 2018 regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated November 23, 2018:

At the regular monthly meeting of the Fire Council held November 20, 2018, the Fire Council took the following actions and we await your approval:

Placed on Sick Leave:

            Michael Sasuk effective November 3, 2018

Took off Sick Leave with Medical Clearance:

            Robert Santos effective November 2, 2018

Accepted New Probationary Members:

            Corine Tillinghast – Fire Patrol

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the Fire Department actions as read.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to St. Joseph Church to maintain a temporary sign, 60” wide x 24” high, on the northeast end of Main Street by the Kiwanis sign at the foot of Route 231. The sign will advertise the concert, “The Messiah and Other Sacred Masterpieces” to benefit the Mercy Inn Soup Kitchen.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, November 27th, 2018,

BE IT HEREBY RESOLVED to approve the application of Christopher Paulicelli, 101 Deer Park Avenue LLC., to add an entryway on the north side of the building located at 99-101 Deer Park Avenue, subject to covenants & restriction to follow.               [Section 10 / Block 4 / Lot 8]

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to re-appoint Caitlin Alfano to the Architectural Review Board for a three-year term which will be through December 2021.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for November 27th, 2018:

Trustee Adams announced some of the special events in the Village this upcoming weekend; Friday is the Chamber of Commerce Old Fashioned Night of Shopping; Sunday is the 100th Annual Tree Lighting. Prior to the Tree Lighting, the Babylon Theater will perform excerpts from the children’s show, The Happy Elf.  After the tree lighting the Wassail Bowl will be held at the Historical Society.

On the motion of Trustee Silvestri, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to remove the exemptions as per the attached Assessor Petitions and bill the new owners the Exempt Property Restoration for the Tax Years as indicated on the attached chart.

Trustee Silvestri announced the upcoming special events at the Conklin House; Cookie submissions for the Conklin House Cookie Contest can be dropped off this Thursday between 4:00 p.m. and 6:00 p.m.; contest winners will be announced at the Holiday Open House on Friday from 6:00 p.m. to 9:00 p.m.; Saturday is the Dicken’s Wonderland for Seniors, and Sunday between 10:00 a.m. and 5:00 p.m. is ‘Picture Perfect’ Day at the Conklin House.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the budget transfers listed on the attached to cover current year expenditures.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to the Babylon Little League to hold “Picture Night” on Wednesday, April 3rd, 2019 and Friday, April 5th, 2019 at Village Hall.  This permission is granted contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ Agreement.

Trustee Muldowney announced that boats must be out of slips by this weekend, December 1st.  There are some winter mooring slips available on East Creek; applications should be submitted to the Village Clerk’s Office.

On the motion of Mayor Scordino, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED that the Board of Trustees of the Village of Babylon is the Lead Agency regarding Local Law #5 of 2018, extending the expiration date of the restaurant moratorium established in Local Law #2 of 2018,

and therefore,

BE IT RESOLVED that the Board of Trustees has determined this action will not have an adverse impact on the environment.

Mayor Scordino read the following and polled the Board:

WHEREAS a Public Hearing was held on Tuesday, November 27th, 2018,

BE IT HEREBY ENACTED that the following Local Law, proposed as Local Law #5 of 2018, is HEREBY ADOPTED as:

Local Law 5 of 2018, extending the expiration date of Local Law 2 of 2018 regarding the restaurant moratorium, from December 31, 2018 to December 31, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, December 11, 2018, to consider the adoption of Local Law 6 of 2018, a Local Law to establish a Moratorium on new applications for partition, or subdivision in the A-11 residential zoning districts of the Village of Babylon.

Mayor Scordino made the following announcement:

The Board of Trustees meets once in December (December 11, 2018).  There will be no second Board meeting in December.
