On the motion of Trustee Muldowney seconded by Trustee Davida and unanimously carried

Mayor Scordino opened the meeting at 7:13 p.m.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried

Mayor Scordino adjourned the meeting at 7:53 p.m.

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was lead by Trustee Muldowney

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO: approve the minutes of the previous meeting and dispense with the reading of the same.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: approve the actions taken at the meeting of the Fire Council November 15, 2011.  Placed Laura Kelland of the Rescue Squad on sick leave as of November 22, 2011.  Took Giuseppe Pergolotti of the Fire Patrol off sick leave as of November 2, 2011 with medical clearance.  Placed Barbara Maier on the Driver’s list of Unit 1-2-10.  Placed Robert Carnival on the Driver’s list of Unit 1-2-6.  Accepted Timothy J. Bridges as a Probationary Member of Electric Hose Company No. 4. 

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried

WHEREAS A Public Hearing was held on Tuesday, November 22, 2011

BE IT hereby enacted, Local Law #8 of 2011, Add Chapter 211 and amend Chapter 365-21 pertaining to tattoo and body piercing parlors (previously proposed as Local Law #8 – which also included adding Chapter 212 pertaining to psychic and fortune teller establishments that portion of the law has been eliminated)

Local Law #9 Amend Chapter 365-26G pertaining to Solar panel installation, to add 365- 26G-6 which requires notification to the fire department of installation.

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO: grant permission to Babylon Village Chamber of Commerce for a number of buildings in the Village to use outdoor speaker systems for holiday music the night of Old Fashioned Village Christmas from Friday, December 2, 2011 to Monday, December 26, 2011.

On the motion of Trustee Vandervledt, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO: hire Richard Heuwetter as a full time highway Laborer with an annual salary of $20,800 effective November 7, 2011.   

On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

RESOLVED TO: issue a refund below, as per Court Ordered Stipulations attached.

RESOLVED TO: accept the contract with EcoTest Laboratories Inc. to Perform Storm Water Testing Services for the Village of Babylon.  See attached.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: grant permission to Babylon Village Chamber of Commerce to place bags on the meters for the holiday season, prior to the Old Fashioned Village Christmas.  

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: hire Deborah Kolovich at a rate of $25.00 per hour not to exceed 15 hours per week for accounting services performed for the Treasurer’s Office for the fiscal year 2011/2012.

On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

RESOLVED TO: accept the proposed settlement of Real Property Tax Claim, as per the attached, regarding the following:

Section 13   Block  2  Lot  24.4 for the 2008-2009 through 2011-2012 tax years

For a Total refund of $7,000.00

On the motion of Trustee Muldowney, seconded by Trustee Vandereveldt and unanimously carried it was

RESOLVED TO:  accept the proposed settlement of Real Property Tax Claim, as per the attached, regarding the following: 

Section  10  Block  3  Lot 41.2 

Total refund in the amount of $1,700 to be made in two payments.  First payment of

$850.00 within 45 days, and the second payment of $850 on or before July 15, 2012.

And

Section  10  Block 3  Lot 44 for the 2008-2009 through 2011-2012 tax years.

Total refund in the amount of $3,500 to be made in two payments.  First payment of $1,750 with 45 days, and the second payment of $1750 on or before July 15, 2012.

RESOLVED TO: accept the official request of Prosward Hampton to retire from the Village of Babylon effective November 24, 2011.  

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was

RESOLVED TO: issue a refund in the amount of $25.00 to the following for the return of one (1) ZBA sign for a partial refund

RESOLVED TO: restore to the tax roll the following exempt property

Section  5  Block  2   Lot  29

175 Litchfield Ave. formerly owned by Lucy Gisonda a Veterans Eligible Fund Exemption in the amount of $1200 and bill new owner Jaclyn Pappas in the amount of $104.14 for 254 days @ $0.41 cent a day for the 2011-2012 tax year.

In addition a Senior Citizen Exemption in the amount of $3075 and bill new owner $269.24 for 254 days @ $1.06 a day for the 2011- 2012 tax year.

On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried it was  

RESOLVED TO: approve the application of Monsoon to maintain a temporary banner on the building located at 48 Deer Park Ave. for 8 to 10 weeks.  See attached.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO: approve the following warrant for November 22, 2011.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO: grant permission to St. Joseph Church to maintain two (2) temporary signs on the Church lawn as per the attached.

On the motion of Trustee Basile, seconded by Trustee Davida and unanimously carried it was

RESOLVED TO: grant permission to Babylon Village Chamber of Commerce for a number of buildings in the Village to use outdoor speaker systems for holiday music the night of Old Fashioned Village Christmas from Friday, December 2nd to Monday, December 26th 2011.

Trustee Basile announced that the Conklin House will be hosting the cookie contest on Thursday, December 1st; December 2nd is the night of Old Fashioned Village Christmas.

The Conklin House will be open Friday night from 6-9 p.m. and Saturday, from 2-4 p.m.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried

WHEREAS A Public Hearing was held on Tuesday, October 11, 2011 for Tidewater grill and Tavern

BE IT: hereby resolved to adopt the covenants and restrictions determined by the Village Attorney.

Announcements:

Mayor Scordino announced that Village offices will be closed on Thursday, November 24th in observance of the Thanksgiving Holiday.

There will be no second Board Meeting in December and there will be three Public Hearings held on Tuesday, December 13, 2011.
