REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM OF THE MUNICIPAL BUILDING, 153 WEST MAIN STREET, BABYLON, NEW YORK ON TUESDAY,

 SEPTEMBER 27, 2011

PRESENT: Mayor Ralph Scordino

Trustee: Kevin Muldowney

Trustee: Alice Vanderveldt

Absent: Trustee Debbie Basile

  Attorney: Joel Sikowitz

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried

 Mayor Scordino opened the work session at 7:15 p.m.

 On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried

 Mayor Scordino adjourned the meeting at 7:55 p.m.

 Prior to the Public Meeting Mayor Scordino honored three Firemen for their service to the Department:

Leland McLaughlin – 50 years of service

Charles Reeves – 55 years of service

George Wright – 55 years of service

 Regular meeting of the Board of Trustees opened at 8:15 p.m.

 The Pledge of Allegiance was lead by Trustee Vanderveldt

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: approve the minutes of the previous meeting and dispense with the reading of the same.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: approve the following actions taken at the monthly meeting of the Fire Council held on Tuesday, September 20, 2011.  Placed Michael McCarthy of the Electric Hose on sick leave as of August 15, 2011.  Took Leland McLaughlin of Electric Hose off sick leave as of July 13, 2011 with medical clearance.  Took Theodore Lutz of the Hook & Ladder off sick leave as of August 6, 2011 with medical clearance. Letter from the Argyle: Hose placing Gerald Luca on sick leave as of August 1, 2011.  Placed Jonathon Zocchia of the Hook & Ladder off sick leave as of August 26, 2011 with medical clearance.  Placed Giuseppe Pergolotti of the Fire Patrol on sick leave as of September 16, 2011.  Placed Dwayne McKay of the Fire Patrol on sick leave as of September 9, 2011.  Place James Schellhorn of the Phoenix Hose on sick leave as of July 1, 2011.

Accepted Ann Marie DeMayo as an Active FFE Member following completion of her Probationary period.  Accepted James Harty as an active member of Sumpwams Hose Company No. 2 following completion of his Probationary Period.  Accepted Angelina Sfoglia as a Probationary FFE member.  Changed the status of Eugene Brunjes of the Argyle Hose from Senior Member to Senior Inactive Member.  Accepted, with regret, the resignation of Matthew Parker from the Hook & Ladder.

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: re-appoint Patrick Kevin Brosnahan as Special Counsel to the Village of Babylon at a rate of $175.00 per hour.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried

 RESOLVED TO: give Sean Daniel, Sanitation Laborer, the customary increase of $1,000.00 as he has successfully completed six months with the Village effective September 21, 2011.  

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: accept the resignation of Charles Klopfer, effective September 30, 2011.

 On the motion of Trustee Vanderveldt, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: hire Nancy Kaiser, as a part time clerical in the Village Clerk’s Office with a salary of $8.25 per hour effective September 20, 2011.

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: grant permission to the residents of East Jackson Ave. to hold a block party on Saturday, October 22, 2011 from 12:00 noon to 11:00 p.m. with a rain date of Saturday, October 29, 2011.  The street will be blocked between East Shore Drive and East Jackson Ave.

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: increase the salary of Caitlin Munson to $8.75 per hour effective as of September 26, 2011 having completed six months with the Village.

 On the motion of Trustee Muldowney, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO:  hire James Emmons Simmons, as a part time Highway Laborer with a salary of $8.50 per hour, effective September 19, 2011.

 On the motion of Trustee Davida, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: amend resolution from the September 13, 2011 Board Meeting regarding the increase of salary for Jeannine Finelli of 25 cents per hour to amend her hourly wage to $8.75 in lieu of $8.50.

 On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: grant permission to Thomas Gargiulo to maintain temporary lawn sized signs on various resident properties throughout the Village.

 On the motion of Trustee Davida, seconded by Trustee Vanderveldt and unanimously carried it was

 RESOLVED TO: approve the following warrant for September 27, 2011

General Fund:                $123,695.06

Conklin House Trust   $       100.00

Golf Course Account    $    2,277.49

Total General Fund       $126,072.55

Trust                            $     5,560.00

Total                            $131,632.80

 Trustee Davida announced that S.T.O.P. day was very successful with as many as70 residents participating.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried it was

 RESOLVED TO: approve the following applicant for a license to drive a taxi in the Village of Babylon for Sunset Taxi.

 On the motion of Mayor Scordino, seconded by Trustee Muldowney

 BE IT RESOLVED: that the Village of Babylon execute the extension and accord outlining contract terms with the CSEA, Local 1000 who represent a segment of the full time Village employees.   

 Before Mayor Scordino and the Board adopted Local Laws 1-7 the Mayor explained the reasoning behind these laws and that at this time Local Law #8 is being tabled so that the Board can make a more informed decision. 

 On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried

BE IT HEREBY ENACTED, after a Public Hearing held on August 9, 2011, the following local laws are hereby adopted:

Proposed as:

Local Law #1: Amending Chapter 365-64 pertaining to off-street parking

Proposed as:

Local Law #2: Adding Chapter 365-26G with regards to rooftop solar panels

Proposed as:

Local Law #3: Amend Chapter 343-50-58 regarding snow removal

Proposed as:

Local Law #4: Amend Chapter 343-20 pertaining to parking restrictions

Proposed as:

Local Law #5: Amending Chapter 296 regarding property maintenance/lighting

Proposed as:

Local Law #6: Amending Chapter 96 pertaining to grounding gas piping

Local Law #7: Add Chapter 270 regarding the planting and growing of bamboo
