A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, May 14, 2019.  On the motion of Trustee Muldowney, seconded by Trustee Davida and unanimously carried, the meeting opened at 7:29 p.m. On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Board entered into Executive Session at 7:46 p.m. to discuss sensitive properties.   On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the Executive Session ended at 8:05p.m. and the meeting adjourned.

The Pledge of Allegiance was led by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the April 23rd, 2019 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Silvestri, seconded Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the Babylon Public Library to hold the following 2019 Summer Reading Club Events:

RESOLVED to issue a refund in the amount of $10.00 to Dellafranca Landscaping for overpayment of 2019 landscaper permit #P9-01633.

On the motion of Trustee Silvestri, seconded Trustee Muldowney and unanimously carried, it was

RESOLVED to terminate the employment of Michael Adrien as a part-time Sanitation laborer effective March 25, 2019.

On the motion of Trustee Silvestri, seconded Trustee Muldowney and unanimously carried, it was

Trustee Silvestri commented that the Children’s Tea at the Conklin House is coming up the beginning of June.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to change Cindy Angiporti from a part-time greenhouse laborer to a full-time greenhouse laborer with an annual salary of $29,120 effective May 6, 2019.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Beautification Society to hold a fundraiser event on Saturday, August 10, 2019, from 6:00 p.m. to 9:30 p.m. at the Gazebo area for phase two of their project to beautify the area surrounding the Babylon Train Station.  This event will include a band playing at the Gazebo, one or two local food merchants selling food along the dock, and the BBS selling beer and wine. This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ agreement, from the Babylon Beautification Society and all participating vendors.

ALSO BE IT RESOLVED that the Open Container Section of the Village Code, Chapter 256, is hereby waived for the Babylon Beautification fundraiser event at the Gazebo area on Saturday, August 10th, 2019, from 6:00 p.m. to 9:30 p.m.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that TERESA ALLAR be appointed as VILLAGE ASSESSOR for one year with an annual salary of $35,000.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that ROBERT BRINK be appointed as ATTORNEY FOR THE PLANNING BOARD for one year at a rate of $175 per hour.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to appoint JOHN FARRELL to the ZONING BOARD OF APPEALS for a five-year term, which will be April of 2024.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED that the liens highlighted on the attached chart were added to the 2019/20 Tax Bills.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to hire Sarah McLean as a part-time clerk/typist in the Building department with a salary of $10.50 per hour effective April 22, 2019.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to Babylon Christ Episcopal Church to hold their annual Bike to Build bike ride benefitting Habitat for Humanity on Saturday, May 18, 2019, from Smithtown to Babylon.  The approach into the Village will be from Belmont Lake State Park, turning east onto Park Avenue, south onto North Carll Ave., crossing Main Street to South Carll Avenue, and ending at the church.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as a signed and notarized ‘Hold Harmless’ agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that JAMES GOWAN be appointed as SPECIAL COUNSEL FOR TAX AND CERTIORARI PROCEEDINGS for one year at a rate of $175 per hour.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that DAVID ROTH be appointed as ATTORNEY FOR THE ZONING BOARD OF APPEALS for a total of four years at a rate of $175 per hour, as well as SPECIAL COUNSEL to the VILLAGE BOARD at the same rate.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED that THOMAS SPREER be appointed as SPECIAL COUNSEL TO THE VILLAGE OF BABYLON at a rate of $175 per hour.

Trustee Davida commented that the work at the pool is progressing; this Saturday is the second day for pool registration and swim lesson registration.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to approve the following warrant for May 14th, 2019:

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to grant permission to Suffolk Marine to use the Village Municipal Dock from Saturday, June 1, 2019 in the afternoon through Sunday, June 2, 2019 in the evening for the Striped Bass Tournament to be held on Sunday, June 2, 2019.  This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed an ‘Additional Insured’, as well as a signed & notarized ‘Hold Harmless’ Agreement.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $660 to Frank Feis for boat slip #12 at Southeast Lewis Pond, which will be sublet for the 2019 season.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $65 to Stuart Myers for switching from 11’ wide boat slip #88 at Lewis Pond to 13’ wide slip #14 at East Creek.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to issue a refund in the amount of $65 to Geraldine Olson for switching from 12’ wide boat slip #18 at Lewis Pond to 11’ wide slip #88 at Lewis Pond.

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to accept the attached agreement with Geesebusters for Geese Control at the Golf Course for the 2019 Season.    (#1497)

On the motion of Trustee Muldowney, seconded by Trustee Silvestri and unanimously carried, it was

RESOLVED to hire Jonathan Dixon as a Sanitation Laborer with an annual salary of $29,120, effective January 28, 2019.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to authorize the Mayor to execute an intermunicipal services agreement with the Town of Babylon as may be agreed to between the parties.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant a license to the following applicant to drive a taxi cab for Sunset Taxi in the Village of Babylon:  Nicholas Gioglio

Mayor Scordino made the following announcement:

Village of Babylon Offices will be closed and there will be no rubbish or garbage pick-up on Monday, May 27, 2019, in observance of the Memorial Day Holiday.  Residents should not put rubbish or recycling out to the curb on holidays.

The meeting was opened to the Public; no one addressed the Board.
