A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, June 28th, 2016.  On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the meeting opened at 7:25 p.m.  On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the meeting adjourned at 8:03 p.m.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the June 14th, 2016, regular meeting of the Board of Trustees and dispense with the reading of the same.

The Village Clerk read the letter from the Fire Department dated June 24, 2016:

RESOLVED to issue a pro-rated refund in the amount of $93.00 to John McNeill for the return of Apartment Parking Decal #25.

RESOLVED to increase the salaries for Lifeguards at the Village Pool using the following schedule effective June 26, 2016:

                                    Second Year:  $10.25 per hour

                                    Third Year:      $10.50 per hour

                                    Fourth Year:    $10.75 per hour

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund in the amount of $5,000, as per the attached signed Stipulation of Settlement on 400 Park Avenue for 2012, 2013, and 2014 taxes.       [Section 5 / Block 1 / Lot 33]

Trustee Davida commented that the Pool officially opened last Friday and is being enjoyed by many.  He thanked Skip and his entire crew for working so hard to make the pool and surrounding area so beautiful.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $93.00 to Lauren Lucas for the return of Apartment Parking Decal #26.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $525.00 to Jaclyn Caputo for the return of Non-Resident Reserved Parking Decal #2254.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the changes as per the attached Assessor Petitions for:

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of Carol Amelia as Trustee of the Village of Babylon effective June 16, 2016.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to appoint Mary Adams as Trustee of the Village of Babylon to fill the unfinished term of Carol Amelia which expires March of 2017.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS, the Building Inspector has informed the Board of Trustees that the building on the Premises located 53 Melbury Road, Babylon, New York , is unsafe; and

WHEREAS, the Building Inspector has previously notified the Owner of the Premises of the unsafe conditions and demanded that the owner take corrective action; and

WHEREAS, the Owner of the Premises has failed to take corrective action; and

NOW, THEREFORE, be it RESOLVED, that the Village Board hereby certifies, pursuant to Section 4-412 of the Village Law, Section 786 of the General Municipal Law and Chapters 113 and 237 of the Village Code that the Building at 53 Melbury Road, Babylon, New York, is unsafe and that demolition and removal thereof are necessary and appropriate to protect the health, safety, and welfare of the Village residents; and be it further

RESOLVED, that the Village Attorney and its special counsel are authorized to provide notice pursuant to Village Code and State Law and to Petition the Supreme Court of the State of New York to secure an Order authorizing the demolition and removal of the Building; and be it further

RESOLVED, that the Departments of Highways and of Sanitation under the direction and supervision of the Building Inspector are authorized to demolish and remove the Building; and be it further

RESOLVED, that the Village Treasurer shall account for all the costs incurred by the Village to secure the Supreme Court Order and to demolish and remove the Building and shall certify the aggregate sum thereof to the Assessor; and be it further

RESOLVED, that the Assessor shall assess the aggregate sum of all such costs as a special assessment against the Premises to assure reimbursement and collection thereof.
