A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 9, 2013.  On the motion of Trustee Muldowney, seconded by Trustee Basile, and unanimously carried, the meeting was opened at 7:10 p.m. On the motion of Trustee Basile, seconded by Trustee Muldowney, and unanimously carried, the meeting was adjourned at 8:00 p.m.

 

REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF BABYLON WAS HELD IN THE BOARDROOM 153 WEST MAIN STREET BABYLON, NEW YORK ON TUESDAY,

JULY 9, 2013

Regular meeting of the Board of Trustees opened at 8:00 p.m.

The Pledge of Allegiance was lead by Trustee Davida.

On the motion of Mayor Scordino, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the minutes of the June 25, 2013 regular Board of Trustees meeting and dispense with the reading of the same.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue refund totaling $3,176.94 to Wells Fargo Home Mortgage for duplicate payment of taxes on the following properties:

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to terminate the employment of Walter Burch as a part-time Sanitation Laborer effective as of June 3, 2013.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to hire Martin E. Carman as a full-time Sanitation Laborer with a salary of $20,800, effective July 1, 2013.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to remove the following exemption, and restore full assessment to

Section 9   Block 1   Lot 11

192 LOCUST AVE- formerly owned by Ann Burke, a Veterans Non-Combat

Exemption with an assessed value of 300 and an Alternative Veterans Combat Exemption with an assessed value of 500, and bill the new owner, Peter Burke:

                        $  65.54  (226 days @ .29₵ per day for the 2012-2013 tax year)

                 +    $ 113.92  (For the entire 2013-2014 tax year)

     TOTAL:    $ 179.46

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Open Container section of the Village Code, Chapter 256, is hereby waived for the Annual Country Fair on September 8, 2013, with a rain date of September 15, 2013.  This pertains only to the gazebo area of Argyle Park.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the application of Danny O’Donnell, (Tres Palms), situated at 16 East Court, for request to modify the conditions of the prior approval, is hereby referred to Special Counsel for review and preparation of proposed findings.

Trustee Basile announced that this year’s recipient of the annual Conklin House Award for Volunteerism is the entire Babylon Village Fire Department.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to increase the salary of Michael Augello to $12.00 per hour as relief manager of the Village Pool, effective July 6, 2013.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Tuna Club to maintain temporary signs advertising the Tuna Tournament from July 15th to August 12th, 2013 at the following locations:

Route 231, the Post Office, the West end of Montauk Highway, and Deer Park Avenue

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue refund in the amount of $25 to John Murphy, 11 Florence Court, as he moved from boat berth #13 at Argyle Basin to sublet #43 at Lewis Pond.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue refund in the amount of $797.44 to the County of Suffolk for duplicate payment of taxes on:

Section 12 Block 1 Lot 70

10 Bacon Lane

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue refund in the amount of $256 to Wells Fargo Home Mortgage for overpayment of taxes on:

Section 1 Block 1 Lot 14.1

429 Midwood Road

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to increase the salary of Laura Milazzo $1000 effective July 2, 2013, having completed her six month probationary period.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Willie L. Jones as a full-time Sanitation Laborer with a salary of $20,800 effective July 1, 2013.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to hire Nicholas Russo as a part-time Sanitation Laborer with a salary of $8.50 per hour, effective June 25, 2013.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue refund in the amount of $662.76 to Wells Fargo Home Mortgage for overpayment of taxes on:

Section 1 Block 1 Lot 21

253 Cadman Avenue

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue refund totaling $6,704.20 to Corelogic Real Estate Tax Service for duplicate payment of taxes on the following properties:

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to remove the following exemption, and restore full assessment to

Section 4   Block 1   Lot 20

120 VILLAGE LINE ROAD- formerly owned by Jane MacQuarrie, a Senior Citizen

Exemption with an assessed value of 2923, and bill the new owner, The Estate of Jane MacQuarrie:  $ 392.16, which is for 344 days @ $1.14 per day for the 2013-2014 Tax Year.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to extend the expiration date of Taxi Cab Driver Licenses from August 14th, 2013 to September 30th, 2013.

On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the following warrant for July 9, 2013:

Trustee Davida announced that the Village Pool is now open and operational. The opening weekend was very successful and he anticipates a good season.

On the motion of Mayor Scordino, seconded by Trustee Basile and unanimously carried,

WHEREAS A PUBLIC HEARING was held on July 9, 2013, for The King of Cupcakes.com Inc, BE IT HEREBY RESOLVED to approve the application of Garrison Gross to expand his business, A.G.’s Cupcakery, subject to Covenants and Restrictions to be determined by the Village Attorney.

Mayor Scordino made the following announcement:

The Board of Trustees of the Village of Babylon will hold a Public Hearing at 153 West Main Street, on Tuesday, July 23, 2013 at 7:00 p.m. to consider the application of Massimiliano Gargiulo, Principal of Molto Vino, 45 Deer Park Avenue, to expand his business at 43 and 45 Deer Park Avenue.  Copy of application and plans may be examined at the office of the Village Clerk, between the hours of 10:00 a.m. and 4:00 p.m. Monday through Friday.
