A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 24, 2018.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:15 p.m.

On the motion of Trustee Basile, seconded by Trustee Adams and unanimously carried, the Board entered into Executive Session at 7:25 p.m. to discuss sensitive properties.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, the Board returned to public session at 8:06 p.m. and the meeting adjourned.

The Pledge of Allegiance was led by Trustee Basile.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the July 10, 2018 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in amount of $2,895.67 to Lereta LLC for duplicate payment of 2018/19 taxes on the following:

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $149.30 to Joseph T. Conley, III, for overpayment of 2018/19 Taxes for the property located at 14 Deeringwood Lane.     [Section 017 / Block 02 / Lot 061] (Assessor Petition dated June 12, 2018)

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Tuna Club to hold their Annual Snapper Derby at the Village docks on Saturday, August 25th, 2018 from 8:00 a.m. to 1:00 p.m.

This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Tuna Club to hold their Annual Snapper Derby Clinic at the Village docks on Saturday, August 18th, 2018 from 9:00 a.m. to 12:00 Noon.

This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for July 24, 2018:

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the residents of Ketewamoke Avenue to hold a Block Party on Saturday, August 25th, 2018, from 3:00 p.m. to 11:00 p.m. The street will be blocked between Deer Park Avenue and Wampum Rd., subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Babylon Fire Department to maintain temporary signs at various merchants throughout the Village from August 15th to September 15th, 2018, to announce the Town of Babylon Firemen’s Parade to be held on September 15th.

Trustee Davida described the parade; ten Fire Departments in the Town of Babylon and the Wheatley Heights Ambulance Corp. participate in the parade. The route is similar to that of the Memorial Day parade but ends at the Fire House and is followed by a celebration in the street on North Carll Avenue outside the Fire House.  Trustee Davida encouraged all to attend.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Post Office Café to hold the 27th Annual 5K for MPS on Saturday, October 20th, 2018. This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to grant permission to the Post Office Café to maintain temporary signs in the Village of Babylon, at the 4 locations listed, to advertise the 27th Annual 5K Run to be held October 20th, 2018:

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $21.00 to William Woodward for overpayment of 2018/19 Taxes on 20 Woodrow Pkwy. [Section 005 - Block 01 - Lot 014.003]

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to issue a refund in the amount of $119.44 to Property Tax Adjusters, Ltd., as per the attached court-ordered settlement for the Tax Years and parcel listed.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to increase the salary of Kathleen Matty, Court Reporter, to $200.00 for Tuesday Court sessions and $210.00 for night sessions effective August 1, 2018.

Trustee Davida announced that this is the last week of swim lessons and the annual swim meet will be held on Saturday at 9:00 a.m.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Village Chamber of Commerce to plan two Thursday evenings, August 23rd and September 20th, 2018, from 5:00 pm to 9:00 p.m., for family fun events to be held in the Business District, with the following street closures:  Deer Park Avenue from Railroad Avenue to Main Street, and Fire Island Avenue from Main Street to the South entrance of the Carriage House parking lot. There will be no alcohol service outside of restaurants or their secured areas.  The Chamber shall also comply with its submissions to the Board which form the basis for this approval.

This permission is granted contingent upon timely receipt of the required Certificates of Insurance with the Village of Babylon listed as an ‘Additional Insured’, as well as signed & notarized ‘Hold Harmless’ Agreements from the Chamber of Commerce and any vendors that participate.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to appoint Jean Marie Parker as Receiver of Taxes of the Village of Babylon effective July 16, 2018 to fulfill the unexpired term of Patricia Carley which is to April 2019.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Union Free School District to use the Park Avenue Tennis Courts, on both the North and South sides of Park Avenue, for the 2018 Fall Season.  The courts will be used by the Varsity, Junior Varsity, and Junior High Teams, from August 30th through November 7th, 2018, from 2:30 p.m. to 6:30 p.m.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the residents of Cadman Avenue to hold a Block Party on Saturday, August 18th, 2018, from 11:00 a.m. to 11:00 p.m. The street will be blocked between Locust Avenue and Park Ave., subject to parking restrictions for emergency purposes.

Trustee Muldowney commented that the various leagues at the Golf Course have been doing very well.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, July 10th, 2018, to consider the application of Margaret Drew of MADD Bartini, Inc. to maintain the business at 124 North Carll Avenue, currently known as Bartini, and

WHEREAS the application was approved at the regular meeting of the Board of Trustees held July 10, 2018, subject to Covenants & Restrictions to follow,

BE IT HEREBY RESOLVED to approve and adopt the attached Covenants & Restrictions for Bartini, 124 North Carll Avenue.   [Section 009 / Block 01 / Lot 032]

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to Bicycle Shows U.S. to hold their annual ‘Ride to Montauk’ bicycle event from the Babylon Long Island Railroad Station to Montauk on Saturday, September 15th, 2018.  Set-up will begin the afternoon of Friday, September 14th, and be removed by Monday, September 16th.  This permission is granted contingent upon timely receipt of the required Certificate of Insurance with the Village of Babylon listed as an “Additional Insured” as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to the residents of Tompkins Avenue to hold a Block Party on Saturday, September 22nd, 2018, from 12:00 Noon to 10:30 p.m., with a rain date of Sunday, September 23rd. The street will be blocked between Little East Neck Road South and #47 & #48 Tompkins Ave. (just East of Mayhew Ave.), subject to parking restrictions for emergency purposes.

Trustee Basile acknowledged and expressed her gratitude to those who helped with the Beer & Barbeque event at the Conklin House; The Villager and The Local contributed food, the Babylon Village Art Council provided the music, Skip and Dante provided helping hands, and the Steering Committee outdid themselves.

Trustee Basile expressed her appreciation to the community, the Board and the employees for their help and for the pleasure of serving on the Board.

RESOLVED to grant a license to the following applicant(s) to drive a taxi cab for Sunset Taxi in the Village of Babylon:     Pierre Filsaime

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, August 14th, 2018, to consider the adoption of Local Law #4 of 2018, a Local Law to adopt new zoning maps that reflect changes made after March 1998.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to schedule a Public Hearing to be held at 7:00 p.m. on Tuesday, August 14th, 2018, to consider the application of Francine Pascone of Bunz, LLC, to open a bakery at 14A Railroad Avenue, formerly the location of Metro PCS.

Mayor Scordino announced that there will be no second Board Meeting in August.

The meeting was opened to the public;

D. Ude, 57 Mason Ave., thanked the Board for the quick response regarding the construction fence that had been blocking the sidewalk by Mansfield Ave.

Frank Curtin, 420 Fire Island Ave., inquired about Local Law 4 and the Covenants & Restrictions for Bartini.
