A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 14, 2015.  On the motion of Trustee Davida, seconded by Trustee Muldowney and unanimously carried, the meeting opened at 7:11 p.m.  On the motion of Trustee Basile, seconded by Trustee Amelia and unanimously carried, the meeting adjourned at 7:45 p.m.

REGULAR MEETING OF THE BOARD OF TRUSTEES

Regular meeting of the Board of Trustees opened at 8:01 p.m.

The Pledge of Allegiance was lead by Trustee Amelia.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the June 23rd, 2015 regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to hire the following:  Annalise Slack, Swim Team Coach ($500/season)

ALSO RESOLVED to have Michael Kamme teach the Lifeguard Training Course at the pool.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to increase the salary of Luke Merz to $14.00 per hour, effective June 29, 2015.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to issue a refund totaling $1,242.18 to Lereta for duplicate payment of taxes on 35 Marlborough Road, Section 2, Block 1, Lot 146.2.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to grant permission to the residents of Tappan Avenue to hold a Block Party on Saturday, August 15th, 2015, from 12:30 p.m. to 11:00 p.m., with a rain date of August 22nd, 2015.  The street will be blocked between East Gate and the Tappan Avenue / Johnson Court inlet, subject to parking restrictions for emergency purposes.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to remove the current exemptions and restore full assessment to the properties attached, and bill the new owners accordingly, for the Tax Year(s) as indicated.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried, it was

RESOLVED to dispose of the items listed on the attached Equipment Disposal Authorization, per the NYS Office of Court Administration.

ALSO RESOLVED to accept and acknowledge receipt of the items listed on the attached Inventory Confirmation Forms, per the NYS Office of Court Administration.

On the motion of Trustee Davida, seconded by Trustee Amelia and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, July 14th, 2015, be it hereby enacted the following Local Law is HEREBY ADOPTED:  Local Law #5 of 2015 to amend Section 171-13 of the current Village Code pertaining to Flood Damage Prevention, and to amend Zoning Article VI section 365-26A, to require applications for Building permits to comply with provisions of Chapter 171, Flood Damage Prevention, where applicable.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to accept the resignation of Anthony Crimi as a Highway employee effective June 13, 2015.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $80.62 to Laurie Garvin for overpayment of taxes on 2 Lee Avenue, Section 20, Block 2, Lot 21.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue refunds in the amounts indicated below to each of the applicants listed for the return of ZBA sign(s) for partial refund:

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Union Free School District to use the Park Avenue Tennis Courts, on both the North and South sides of Park Avenue, for the 2015 Fall Season.  The courts will be used by the Varsity, Junior Varsity, and Junior High Teams, from August 24th through November 5th, 2015, from 2:30 p.m. to 6:30 p.m.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 23, 2015,  BE IT HEREBY RESOLVED to approve the application of Frank Bragaglia and Brad Wilson, to open a restaurant / bar at 111–117 Deer Park Avenue, subject to Covenants and Restrictions to follow.

On the motion of Trustee Amelia, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to approve the following warrant for July 14, 2015:

Trustee Amelia commented that the Summer Recreation Programs, originally at the High School, have been moved to the Grade School and Elementary School.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to grant permission to Maria Siragusa to maintain a 72 in. x 21.5 in. temporary sign on the building located at 14 Deer Park Avenue, to advertise the Grand Opening of Sartoria Maria Boutique-Tailoring-Alterations on August 15th.  This permission is granted from July 14, 2015 until ARB approval.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 23, 2015, BE IT HEREBY RESOLVED to approve the application of MG Enterprises, to add a service bar to accommodate the outdoor area of Molto Vino, located at 45 Deer Park Avenue, subject to Covenants and Restrictions to follow.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a refund totaling $5,249.22, to Wells Fargo Real Estate Tax Service, for duplicate payment of taxes on the following:

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of Thomas Freyer as a Highway employee effective June 20, 2015.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the resignation of Russell Bubel as a Highway employee effective June 12, 2015.

Trustee Basile announced that the Babylon Village Arts Council will hold its annual outdoor concert on the lawn of the Conklin House this Saturday, July 18th, at 7 p.m.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED that the following fees are in effect to purchase a parking sticker to launch a Kayak or Paddle Board from the Babylon Village Ramp:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to dispose of the items listed on the attached chart [from the Village Clerk’s Office], in accordance with the Records Retention and Disposition Schedule, MU-1.

RESOLVED to dispose of the following records as per the New York State archives Records Retention Schedule MU-1:

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED that the Open Container Section of the Village Code, Chapter 256, is hereby waived for the Annual Country Fair to be held on September 13th, 2015, with a rain date of September 20th, 2015.  This pertains only to the Gazebo area of Argyle Park.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the resignation of Kyle Fall as a Highway employee effective July 2, 2015.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to hire Joel Benoit as a seasonal Code Enforcement Officer with a salary of $8.25 per hour effective July 7, 2015.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $100 to Gordon Hubley, 15 Surdi Place, for the return of a Zoning Board of Appeals Application Fee.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to issue a refund in the amount of $9.00 to Terrance & Marcia Haise for overpayment of taxes on 531 Gwynn Street, Section 1, Block 2, Lot 40.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried,

WHEREAS, the Board of Trustees of the Incorporated Village of Babylon, upon the report of Labor Counsel, has been advised that the Village bargaining team has successfully negotiated a collective bargaining agreement with the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL-CIO, Village of Babylon DPW Unit, Suffolk County Local 852 covering the period June 1, 2014 through May 31, 2018.  A copy of the collective bargaining agreement is attached to this resolution;

NOW THEREFORE, BE IT RESOLVED by the Board of Trustees of the Incorporated Village of Babylon that the terms of the collective bargaining agreement are hereby approved and by this resolution, the Mayor is hereby authorized to execute said labor agreement covering the period June 1, 2014 through May 31, 2018.

Mayor Scordino made the following announcement:

The Board of Trustees of the Village of Babylon will hold a Public Hearing on Tuesday, July 28th, 2015, at 7:00 p.m., to consider the application of Christian and Courtney Dyckman, to open a bakery at 199 East Main Street, formerly known as Jacquelines.

Copy of application and plans may be examined at the Office of the Village Clerk, between the hours of 10:00 a.m. and 4:00 p.m., Monday through Friday.

The meeting was opened to the public:

Frank Curtin, 420 Fire Island Avenue, commented on the beautiful renovations at the pool and on the more stringent requirements to enter the pool this season.
