A work session was held by the Board of Trustees of the Village of Babylon on Tuesday, July 5th, 2016.  On the motion of Trustee Muldowney, seconded by Trustee Adams and unanimously carried, the meeting opened at 5:00 p.m.  On the motion of Trustee Davida, seconded by Trustee Basile and unanimously carried, the meeting adjourned at 5:53 p.m.

Regular meeting of the Board of Trustees opened at 8:01 p.m.

The Pledge of Allegiance was led by Trustee Adams.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the minutes of the June 28th, 2016, regular meeting of the Board of Trustees and dispense with the reading of the same.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to accept the formal request of George Lindemann to retire from the Village of Babylon effective June 30, 2016.

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried, it was

RESOLVED to remove the current exemptions and restore full assessment to the properties attached, and bill the new owners accordingly, for the Tax Year(s) as indicated.

Section 003   Block 01   Lot 023;  612 DEER PARK AVE. – formerly owned by Carol Walczyk, remove an Eligible Fund Exemption with an assessed value of 550, and bill the new owners, Robert & Gissel Brangenberg, a total of $98.68;

     $16.56 for the 2015/16 Tax Year (72 days @ .23 per day)

     $82.12 for the 2016/17 Tax Year

Section 005   Block 02   Lot 011.1;  329 PARK AVE. – formerly owned by Joann A. Secor, remove an Eligible Fund Exemption with an assessed value of 600, and bill the new owners, Cyntine LLC, a total of $117.08;

     $27.50 for the 2015/16 Tax Year (110 days @ .25 per day)

     $89.58 for the 2016/17 Tax Year

On the motion of Trustee Davida, seconded by Trustee Adams and unanimously carried,

WHEREAS a Bid Opening was held on Thursday, June 16, 2016, for Residential Sidewalks, Curbs and Aprons,

BE IT HEREBY RESOLVED to award the bid to:

Sager Concrete Co., Inc.

Sager Concrete Co. was the lowest responsible bidder with prices as indicated:

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to approve the following warrant for July 12th, 2016:

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to accept the attached agreement between the Village of Babylon and Margaret O’Sullivan for maintenance of the Pernennial Gardens at the Conklin House starting June 27, 2016 through October 31, 2016, at a rate of $12.00 per hour, total amount not to exceed $1,000.00.

On the motion of Trustee Basile, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED to issue a pro-rated refund in the amount of $93.00 to Anna Dellamonica for the return of Apartment Parking Decal #5.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to issue a refund in the amount of $7,779.83 to Farley Realty LLC for the property located at 41 John Street as per the attached Covenant of Settlement for the 2016/17 Tax Year.          [Section 7 / Block 2 / Lot 82.3]

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Union Free School District to use the Park Avenue Tennis Courts, on both the North and South sides of Park Avenue, for the 2016 Fall Season.  The courts will be used by the Varsity, Junior Varsity, and Junior High Teams, from August 22nd through November 3rd, 2016, from 2:30 p.m. to 6:30 p.m.  This permission is granted contingent upon timely receipt of required Certificates of Insurance, with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Adams, seconded by Trustee Davida and unanimously carried, it was

RESOLVED to grant permission to the Babylon Tuna Club for the following 2016 Events, contingent upon timely receipt of required Certificates of Insurance with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized “Hold Harmless” agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Union Free School District to use the Sumpwams Creek Golf Course and facilities for the 2016 Fall Season.  The course will be used by the Varsity Golf Team on August 25, September 1st, 8th, 29th, and October 4th, 2016.  This permission is granted contingent upon timely receipt of required Certificates of Insurance, with the Village of Babylon listed as an “Additional Insured”, as well as a signed and notarized Hold Harmless agreement.

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to grant permission to the Babylon Carriage House to maintain a 2’x6’ temporary sign on the building located at 21 Fire Island Avenue, advertising the “Wednesday Night Lobster Bake.”  This permission is granted for one month from date of approval.            (July 13th – August 13th, 2016)

On the motion of Trustee Muldowney, seconded by Trustee Basile and unanimously carried, it was

RESOLVED to accept the transfer of Barry Holmes from Mechanic to Sanitation Laborer effective June 26, 2016.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that the Board of Trustees shall act as Lead Agency for purpose of reviewing the Argyle Lake Shoreline Restoration EAF.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS, the Board of Trustees of the Incorporated Village of Babylon are Lead Agency for the purpose of the State Environmental Quality Review of the following project:

Argyle Lake Shoreline Restoration

BE IT RESOLVED, that the Board of Trustees in their capacity as Lead Agency hereby ACCEPT the Negative Declaration NOTICE OF DETERMINATION OF NON – SIGNIFICANCE dated June 28, 2016 for this project.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried, it was

RESOLVED that Ralph Scordino, as Mayor of the Village of Babylon, or his designee, is hereby authorized and directed to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $500,000, and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to this Village of Babylon for the Historic Argyle Park Shoreline Restoration Project and, if appropriate, a conservation easement/preservation covenant to the deed of the assisted property.

On the motion of Mayor Scordino, seconded by Trustee Muldowney and unanimously carried,

WHEREAS a Public Hearing was held on Tuesday, June 14th, 2016,

BE IT HEREBY RESOLVED to deny the application [dated May 23, 2016] of Keith Dahmen, Principal of Gino’s Pizza, 258 Deer Park Avenue, to extend the hours of operation on Friday and Saturday to 3:00 a.m.

In 2004, Gino’s submitted a plan to stay open to 11:00 pm. each evening except Friday and Saturday, when Gino’s would stay open until midnight.

The Village of Babylon takes the position that the request of the hours violates the original agreed to covenants and, as such, the application is hereby denied.

The meeting was opened to the public;

Frank Curtin, 420 Fire Island Avenue, asked about the State Funding for Argyle Shoreline Restoration.

The following Boy Scouts from Troop #1, working towards the “Citizenship in the Community” Badge, approached the Board:

Andrew Timson, Simon Street

Milton and Andrew asked if the Pedestrian crosswalk on Montauk Highway connecting Willow Street and Cooper Street could be moved from the East side of these streets to the West side (Bike Shop Side), for safety purposes.  They feel that vehicles turning to head East on Montauk highway are not always aware of people in the cross walk.  If the cross walk were on the West side, it may be less dangerous.
